Plaintiff is presently in the U.S. on authorized military leave in connection with his estranged wife's, Ida Nobantu Tonui, recent death which occurred on or about August 12,2005 in Harrisburg, Pennsylvania. 4. The Defendants are Philip New and Mary New adult individuals currently residing at 936 Willc1iff Drive, Mechanicsburg, Cumberland County, P A, 17055 5. Plaintiff seeks sole legal and physical custody of the following children: Name Joseph Kipchumba Korir Last Known Residence 303B North Pitt Street Carlisle, P A Age Nine (9) Years 6. The child was born of the marriage of the Plaintiff and his deceased wife, Ida Nobantu Tonui. 7. The Plaintiff believes and avers that his wife and child resided together at 303B North Pitt Street, Carlisle, P A 17013 from approximately January or February 2003 until June or July 2005. 8. The Plaintiff also believes and avers that sometime in or about July or August 2005 that his wife became ill and was hospitalized at the Hospice of Central Pennsylvania. 9. Plaintiff further believes and avers that sometime during or after the hospitalization of his wife or after her death that the child was placed in the custody of the Defendants, Philip and Mary New, who currently reside at 936 Willc1iffDrive, . Mechanicsburg, Cumberland County, P A 17055 and/or either of both of the Defendants have relevant knowledge regarding the current location of the child. 10. The Plaintiff believes and avers that during the past five years, the child has resided with the following persons at the following addresses: Persons Emiliano Kipkorir and Ida Nobantu Tonui Addresses Dates October 2000 - January or February, 2003 Nairobi, Kenya Ida Nobantu 303B North Pitt Street Carlisle, P A 17013 January or February 2003 - July or August 2005 Present location unknown. July or August 2005 - Present 11. As stated above, the mother of the child is, Ida Nobantu Tonui, who recently died on or about August 12,2005. 12. The mother of the child was married to the Plaintiff up until the time of her death, however, she was estranged from the Plaintiff since approximately January or February 2003. 13. The Plaintiff believes and avers that the mother and child were residing in or about the area of Carlisle, Cumberland County, Pennsylvania since that time without the Plaintiffs knowledge. . . . 14. The father ofthe child is the Plaintiff, Emiliano Kipkorir Tonui, temporarily residing at 670 South Crawford Rd., Hummelstown, Dauphin County, Dauphin County, P A, 17036. 15. The father was married to the mother up until the time of her death.. 16. The relationship of the Plaintiff to the child is that of biological father. 17. The Plaintiff is temporarily residing with the following persons: Name Relationship Friends Komba M. Kpakiwa and Carol Lee 18.Plaintiffbelieves and avers that there is no biological relationship of the Defendants to the child and that the Defendants may be or may have acted as temporary or interim custodians of the child following the mother's hospitalization and/or subsequent death and prior to Plaintiffs arrival in u.s. 19. Plaintiff believes and avers that the Defendants currently reside together as husband and wife. 20. Plaintiff has not participated as a party or witness, or in another capacity, in other litigation concerning the custody of the child in this or another court. 21. Plaintiff has no information of a custody proceeding concerning the child pending in a court of this Commonwealth or any other state or country. .... 22. Plaintiff does not know of a person not a party to the proceedings who has physical custody of the child or claims to have custody or visitation rights with respect to the child. 23. Simultaneously with the filing of this Complaint, the Plaintiff has filed a Petition for Special Relief/Emergency Custody for the child. A copy of the Petition is attached hereto as Exhibit "A". 24. The best interest and permanent welfare of the child will be served by granting the relief requested therein and herein 25. Plaintiff believes that the child is in need of a safe, stable and consistent home which the Plaintiff is able to provide. 26. Each parent whose parental right to the child have not been terminated and the persons who are believed to have physical custody of the child have been named as parties to this action. The Petitioner is Emiliano Kipkorir Tonui, an adult individual temporarily residing at 670 Crawford Road, Humme1stown, Dauphin County, P A 17036. -' 2. Petitioner is presently in the U.S. on authorized military leave in connection with his estranged wife's, Ida Nobantu Tonui, recent death which occurred on or about August 12,2005 in Harrisburg, Pennsylvania. Attached hereto as Exhibit "A" and "B" respectively are a copy of the Petitioner's marriage certificate and his wife's death certificate. 4. The Respondents are Philip and Mary New, adult individuals currently residing at 936 WillcliffDrive, Mechanicsburg, Cumberland County, PA 17055. 5. Petitioner and his deceased wife are the biological parents of a nine year old minor child, Joseph Kipchumba Korir, whose date of birth is September 13, 1996. A copy of the child's birth certificate is attached hereto as Exhibit "C". 6. Petitioner's wife and.chi1d are also Kenyan nationals. A copy of the Petitioner's wife's birth certificate is attached hereto and Exhibit "D". 7. Petitioner avers that his wife and chi.ld came to the U.S. from their family residence in Nairobi, Kenya sometime in late January or early February 2003 on a 90 day visitor visa via his wife's Kenyan passport. 2 8. Petitioner avers that his wife's travel plans were unknown to him as he was on military assignment in Sierra Leon, West Africa through late January 2003 and was scheduled to return to Nairobi at the end of that month. 9. Upon Petitioner's return to Nairobi, Petitioner found that the marital residence had been stripped of valuables and other goods and that substantial sums of money had been taken from ajoint bank account. 10. Petitioner was later informed by the American Embassy in Nairobi that his wife and child had been granted the aforesaid visas during his absence. ~~. 11. Petitioner avers that his wife and child never returned to Kenya and that until recently Petitioner, despite attempts to locate them via the Kenyan Embassy and U.S. Immigration Service, was unaware of their whereabouts. 12. Petitioner through a military colleague in or about April 2005 was informed that his wife and child maybe living in the Carlisle Pennsylvania area. 13. In or about July 2005 Petitioner was able to secure the individuals' street address at 303B North Pitt Street, Carlisle, Pennsylvania and he also received word around that time that his wife was ill. 3 14. Petitioner was scheduled to travel to the U.S. on or about August 16,2005 in an attempt to reunite with his family, however, his wife died on August 12,2005. 15. Upon receiving news of the death, Petitioner postponed his trip in order to make arrangements to bring his son back to Kenya upon his return. 16. Such arrangements included Petitioner's obtaining of a Kenyan passport for his son for the return trip. A copy of the child's passport is attached hereto as Exhibit "E". 17. Petitioner arrived in Central Pennsylvania on or about September 29,2005 with the intent of reuniting with his son and subsequently returning to Kenya as a family unit. 18. To date, however, Petitioner despite numerous attempts has been unable to locat& his son. 19. Petitioner pursuant to information on his wife's death certificate believes and avers that his wife was hospitalized in connection with her illness in or about late July or early August 2005 at the Hospice of Central Pennsylvania. 20. Petitioner further believes and avers that sometime during or after the hospitalization of his wife or after her death that the child was placed in the custody of the Defendants, Philip and Mary New, and/or either or both of the Defendants have relevant knowledge regarding the current location of the child. 4 21. Petitioner pursuant to information on his wife's death certificate believes and avers that Defendant Mary New was the informant of his wife's death. 22. Petitioner further believes and avers that Defendant Mary New exercised power of attorney for his wife during her lifetime. 23. Petitioner believes and avers that the Defendants have indicated to state and local law enforcement officials and the Kenyan Embassy that they know the present location of his son but are unwilling to divulge the information. 24. Petitioner believes and avers that his son is in the U.S. as an illegal immigrant and also respectfully believes and avers that the child may have or is presently being diverted,." through an "underground" network to care for and/or place illegal orphans. See paragraph 7 above. 25. Petitioner's attempts to locate his son through various federal, state and local government entities including the Pennsylvania State Police and Cumberland and Dauphin Counties Children and Youth Services have been unsuccessful to date. 26. Petitioner is currently scheduled to leave to travel back to Kenya per his military orders by the evening of Wednesday, October 12,2005. 27. Petitioner may with permission from his commanding officer be able to extend his stay until Saturday, October 15, 2005. 5 . 28. As stated above, Petitioner wishes to return to Kenya with the child when he leaves the U.S. next week. 29. Due to Petitioner's work schedule and travel costs it would create a great hardship for the Petitioner to come back to the U.S. at a later date for proceedings on this matter. 30. Petitioner is also genuinely concerned for the health and safety of his son and wishes to know of his location and take sole legal and physical custody as soon as possible. 31. For all of the foregoing reasons, Petitioner respectfully requests that this Honorable Court grant him immediate sole legal and physical custody of the child and also schedule an emergency hearing on this matter and compel the Defendants' and the child's attendance there at. .1>. 32. Petitioner also respectfully requests that this Honorable Court issue an order directing anyone having custody of the child not to leave the jurisdiction or remove the child from the jurisdiction as well as any other relief the Court deems appropriate. 6 . Walmer, Esquire, and files this Petition for Special Relief/Emergency Physical Custody pursuant to Pa.R. C.P. 1915.13 and respectfully avers in support thereof the following: 1. The Petitioner is Emiliano Kipkorir Tonui, an adult individual temporarily residing at 670 Crawford Road, Hummelstown, Dauphin County, P A 17036. 2. The Petitioner is a citizen of Kenya and currently holds a post as Brigadier General of the Kenya Army with his permanent residence at 71702-00622 Juja Road, Nairobi, Kenya. 3. Petitioner is presently in the U.S. on authorized military leave in connection with his estranged wife's, Ida Nobantu Tonui, recent death which occurred on or about August 12,2005 in Harrisburg, Pennsylvania. Attached hereto as Exhibit "A" and "B" respectively are a copy of the Petitioner's marriage certificate and his wife's death certificate. 4. The Respondents are Philip and Mary New, adult individuals currently residing at 936 WillcliffDrive, Mechanicsburg, Cumberland County, PA 17055. 5. Petitioner and his deceased wife are the biological parents of a nine year old minor child, Joseph Kipchumba Korir, whose date of birth is September 13, 1996. A copy of the child's birth certificate is attached hereto as Exhibit "C". 6. Petitioner's wife and child are also Kenyan nationals. A copy of the Petitioner's wife's birth certificate is attached hereto and Exhibit "D". 7. Petitioner avers that his wife and child came to the U.S. from their family residence in Nairobi, Kenya sometime in late January or early February 2003 on a 90 day visitor visa via his wife's Kenyan passport. 2 8. Petitioner avers that his wife's travel plans were unknown to him as he was on military assignment in Sierra Leon, West Africa through late January 2003 and was scheduled to return to Nairobi at the end of that month. 9. Upon Petitioner's return to Nairobi, Petitioner found that the marital residence had been stripped of valuables and other goods and that substantial sums of money had been taken from ajoint bank account. 10. Petitioner was later informed by the American Embassy in Nairobi that his wife and child had been granted the aforesaid visas during his absence. 11. Petitioner avers that his wife and child never returned to Kenya and that until recently Petitioner, despite attempts to locate them via the Kenyan Embassy and U.S. Immigration Service, was unaware of their whereabouts. 12. Petitioner through a military colleague in or about April 2005 was informed that his wife and child maybe living in the Carlisle Pennsylvania area. 13. In or about July 2005 Petitioner was able to secure the individuals' street address at 303B North Pitt Street, Carlisle, Pennsylvania and he also received word around that time that his wife was ill. 3 14. Petitioner was scheduled to travel to the U.S. on or about August 16,2005 in an attempt to reunite with his family, however, his wife died on August 12, 2005. 15. Upon receiving news of the death, Petitioner postponed his trip in order to make arrangements to bring his son back to Kenya upon his return. 16. Such arrangements included Petitioner's obtaining of a Kenyan passport for his son for the return trip. A copy of the child's passport is attached hereto as Exhibit "E". 17. Petitioner arrived in Central Pennsylvania on or about September 29,2005 with the intent of reuniting with his son and subsequently returning to Kenya as a family unit. 18. To date, however, Petitioner despite numerous attempts has been unable to locate his son. 19. Petitioner pursuant to information on his wife's death certificate believes and avers that his wife was hospitalized in connection with her illness in or about late July or early August 2005 at the Hospice of Central Pennsylvania. 20. Petitioner further believes and avers that sometime during or after the hospitalization of his wife or after her death that the child was placed in the custody of the Defendants, Philip and Mary New, and/or either or both of the Defendants have relevant knowledge regarding the current location of the child. 4 21. Petitioner pursuant to information on his wife's death certificate believes and avers that Defendant Mary New was the informant of his wife's death. 22. Petitioner further believes and avers that Defendant Mary New exercised power of attorney for his wife during her lifetime. 23. Petitioner believes and avers that the Defendants have indicated to state and local law enforcement officials and the Kenyan Embassy that they know the present location of his son but are unwilling to divulge the information. 24. Petitioner believes and avers that his son is in the U.S. as an illegal immigrant and also respectfully believes and avers that the child may have or is presently being diverted through an "underground" network to care for and/or place illegal orphans. See paragraph 7 above. 25. Petitioner's attempts to locate his son through various federal, state and local government entities including the Pennsylvania State Police and Cumberland and Dauphin Counties Children and Youth Services have been unsuccessful to date. 26. Petitioner is currently scheduled to leave to travel back to Kenya per his military orders by the evening of Wednesday, October 12,2005. 27. Petitioner may with permission from his commanding officer be able to extend his stay until Saturday, October 15,2005. 5 28. As stated above, Petitioner wishes to return to Kenya with the child when he leaves the U.S. next week. 29. Due to Petitioner's work schedule and travel costs it would create a great hardship for the Petitioner to come back to the U.S. at a later date for proceedings on this matter. 30. Petitioner is also genuinely concerned for the health and safety of his son and wishes to know of his location and take sole legal and physical custody as soon as possible. 31. For all of the foregoing reasons, Petitioner respectfully requests that this Honorable Court grant him immediate sole legal and physical custody of the child and also schedule an emergency hearing on this matter and compel the Defendants' and the child's attendance there at. 32.
