At the special instance and request of defendant, plaintiff's assignor and defendant entered into one or more revolving credit agreements whereby plaintiff's assignor loaned money to defendant at various times. 4. Plaintiff is the assignee the revolving credit agreement(s) in issue. Copies of the agreement(s), assignment(s), and statement(s) of account are attached hereto as Exhibit "A." 5. The loan(s) were payable in monthly installments. 6. Defendant breached the loan agreements by failing to make the monthly payments when due or at all, despite demand. 7. As a result of defendant's breach, plaintiff, as assignee, has been damaged in the principal amount of $21,860.37 plus interest at the contract rate in the amount of $11,130.25, attorney's fees pursuant to contract in the amount of $5,465.09 or such other amount as the court may set, for a total of $38,455.71, and costs. Defendant's characterization of the screen prints as documents of "uncertain origin or authenticity" is irrelevant to the inquiry, and it does not diminish in any way the fact that they evidence the debts, the identity of the debtor, and the amounts due. 3. To the contrary, paragraph 6 of the Complaint does allege a breach, i.e, that the "[d]efendant breached the loan agreements by failing to make the monthly payments when due or at all, despite demand." By way of further answer, the screen prints show in the right column the dates of first delinquency for each loan - May 23, 2002, on one and November 29, 2002, on the other. 4. The screen prints show the delinquency dates. By way of further answer, there is no requirement that the Complaint state the exact amount defendant failed to pay. Rather, the fact of breach may be pleaded generally. 8. (Incorrectly numbered "7.11) Denied. The Complaint breaks down the amounts claimed by principal, interest, and attorney's fees. By way of further answer, the principal amount claimed is $21,860.37, which is the sum of the principal balances of $11,426.34 and $10,434.03 set forth on each of the three screen prints. The interest amount is also set forth on the screen prints, but the amounts due are brought forward to the date suit was prepared for filing. There is no requirement that the Complaint itemize exactly how interest was calculated. The calculation of interest is a matter of proof, not pleading. Finally, there are attorney's fees provisions in each contract. The amount claimed is equal to 25% of the principal.
