STIPULATION AGAINST LIENS
THIS AGREEMENT made the 29'" day of September, 2005
by and between
HOME DESIGNS UNLIMITED, LLC
hereinafter referred to as Contractorr
AND
HOME DESIGNS UNLIMITED, LLC
hereinafter referred to as Ownerr whereby the former undertook and agreed to construct a
single family dwelling, at LOT #59 CROSS CREEK, PHASE D NORTH MIDDLETON TOWNSHIP,
CUMBERLAND COUNTY, PA MORE PARTICULARLY DESCRIBED IN ATTACHED EXHIBIT "A",
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of One Dollar to Contractor it in hand paid by Owner, the
receipt whereof is hereby acknowledgedr and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontractorsr and all parties acting
through or under themr covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or materials furnished by
them or any of them under said contract or otherwiser forr towardsr inr or about the
erection and construction of the said buildings on the lot above describedr and the said
Contractor, for themselves, their subcontractors and others under them hereby expressly
waive and relinquish the right to haver filer and maintain any mechanic's liens or claims
against the said buildings or any of them, and agree that this instrument, waiving the
right of lien, shall be an independent covenant.

ALL THAT CERTAIN tract ofland situate in North Middleton Township, Cumberland
County, Pennsylvania, designated as Lot No, 59 on the Final Subdivision Plan for Phase
D of the Village of Cross Creek dated 4/15/05 and recorded 6/24/05 in the Office of the
Recorder of Deeds in and for Cumberland Countyin Plan Book 90, Page 149, more
particularly bounded and described, as follows:
BEGINNING at a point on the southern right~pf-way of Fine Creek Drive, said point
being the nortliwestern corner of Lot #60; thence, along Lot #60 S 05001 '31" W a
distance of 120.00' to a point; thence, along Lot #53 N 80004'50" W a distance of
110,08' to a point; thence, along Lot #58 N 14040'34" E a distance of 120.Q1' to a point
on the southern right-of-way of Pine Creek Drive; thence, along the right-of-way S
75019'26" E a distance of 1.57' to a point; thence, along the same by a curve to the left
having a radius of525.00', an arc length of88.43' and a chord bearing ofS 80008'58" E
a distance of88.33' to a point, the place of BEGINNING,

Cross Creek dated April 25, 2001 aJ1,d recorded April 26, 2001 in the Office of the
Recorder of Deeds in and for Cumberland County in Mise, Book 673, Page 57 as
extended to Phases B & C by the Second Amendment to the Declaration of The Village
of Cross Creek dated May 25,2004 and recorded in Misc. Book 710, Page 421 as
extended to Phase D by the Third Amendment to"the Declaration of The Village of Cross
Creek dated June 23, 2005 and recorded in Misc. Book 718, Page 3396.

dated September 20, 2005 and about to be recorded~~ La ,2005 in the Office of
the Recorder of Deeds in and for Cumberland County, Pennsylvania, granted and conveyed unto
Home Designs Unlimited, LLC, Mortgagors herein.
