Complaint
1. The plaintiff is Citibank (South Dakota) N,A., with place of business located at 701 East 60th
Street North, Sioux Falls, South Dakota.
2. The defendant is Jay V Stone, who resides at 1526 Newville Road, Carlisle, Cumberland
County, Pennsylvania.
3, Plaintiff, a national banking association, engages in various types of banking business
including consumer lending through the issuance of credit cards,
4, Plaintiff furnished consumer credit to the defendant by means of a credit card with account
number 5424180459327257 hereinafter referred to as the credit card account.
5, Plaintiff maintained an accurate and running record of all debits and credits to the credit card
account in its books of account.
6. Plaintiff mailed defendant a written statement each month which accurately stated the debits
and credits to the credit card account for the prior billing period.
7, Defendant received the monthly statements from plaintifffor the credit card account including
the statement attached hereto as Exhibit A statement without protest, dispute or objection.
8, Defendant in not protesting, disputing or objecting to the statements including the Exhibit A
statement thereby assented and agreed to the correctness of the balance due on the credit card account so
as to constitute an account stated.
9, The amount due plaintiff on the account stated, less credits, if any issued subsequent to the
Exhibit A statement, is $20,047.24,
Wherefore, plaintiff demands judgment against defendant for the sum of $20,047.24, and the
costs of this action,

12, On or about May 1, 1984, at defendant's request, plaintiff opened a credit card
account for defendant with account number 5424180459327257,
]3, Within 30 days of the credit card with account number 5424180459327257 being
opened, the card together with the terms and conditions governing the account were sent to
defendant. Subsequent revisions of the terms and conditions were also sent to defendant.
14, Defendant received the credit card and the terms and conditions,
] 5, The applicable law pertaining to the terms and enforcement of the credit card
agreement is federal law and the law of the State of South Dakota as set forth in a copy of the
terms and conditions attached hereto, made a part hereof and marked Exhibit A,
WHEREFORE, plaintiff prays that judgment be entered on its behalf and against
defendant on the counterclaim.

Plaintiff's Motion For Sanctions Pursuant to Pa R.C.P. 4019(c)(2)
Plaintiff, Citibank (South Dakota) N.A. by and through counsel, Burton Neil, Esquire and
Burton Neil & Associates, P.C., moves the Court pursuant to Pa.R.C.P. 4019(c)(2) for sanctions
against defendant Jay V. Stone due to his failure to comply with the Court's Order of March 8,
2006:
1. Plaintiff filed a motion to compel defendant to answer plaintiff s interrogatories. The
Court by Order dated March 8, 2006 signed by Judge J. Wesley Oler, Jr., granted plaintiff's
motion and ordered defendant to answer the interrogatories within twenty (20) days of the date of
the Order. A copy of the Order is attached as Exhibit A.
2. To the date of this Motion, Defendant has not answered the interrogatories.
3. The interrogatories were addressed to the factual particulars of defendant's answer to
paragraphs 7 and 8 and defendant's counterclaim.
4. In light of defendant's failure to answer plaintiffs interrogatories despite the Court's
March 8, 2006 Order compelling answers, plaintiff believes and therefore avers the proper
sanction against defendant for his conduct is the proposed preclusion Order attached with this
motion.
5. Concurrence of Defendant's counsel was sought. On April 19, 2006, counsel for
Defendant was advised by Plaintiff s counsel that despite preliminary settlement discussions that
his client has made a substantial offer, attorney for the Plaintiff advised counsel that Defendant's
answers to Interrogatories were still required. To date of this Motion, the Interrogatories remain
unanswered.

Wherefore, plaintiff moves the Court to enter an Order imposing preclusion sanctions on
defendant as per the attached proposed Order.
