Plaintiff IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA v. NO. 05-5322 CIVIL JAY V. STONE Defendant : CIVIL ACTION - LAW Plaintiff's Motion For Sanctions Pursuant to Pa R.C.P. 4019(c)(2) Plaintiff, Citibank (South Dakota) N.A. by and through counsel, Burton Neil, Esquire and Burton Neil & Associates, P.C., moves the Court pursuant to Pa.R.C.P. 4019(c)(2) for sanctions against defendant Jay V. Stone due to his failure to comply with the Court's Order of March 8, 2006: 1. Plaintiff filed a motion to compel defendant to answer plaintiff s interrogatories. The Court by Order dated March 8, 2006 signed by Judge J. Wesley Oler, Jr., granted plaintiff's motion and ordered defendant to answer the interrogatories within twenty (20) days of the date of the Order. A copy of the Order is attached as Exhibit A. 2. To the date of this Motion, Defendant has not answered the interrogatories. 3. The interrogatories were addressed to the factual particulars of defendant's answer to paragraphs 7 and 8 and defendant's counterclaim. 4. In light of defendant's failure to answer plaintiffs interrogatories despite the Court's March 8, 2006 Order compelling answers, plaintiff believes and therefore avers the proper sanction against defendant for his conduct is the proposed preclusion Order attached with this motion. 5. Concurrence of Defendant's counsel was sought. On April 19, 2006, counsel for Defendant was advised by Plaintiff s counsel that despite preliminary settlement discussions that his client has made a substantial offer, attorney for the Plaintiff advised counsel that Defendant's answers to Interrogatories were still required. To date of this Motion, the Interrogatories remain unanswered. ~ Wherefore, plaintiff moves the Court to enter an Order imposing preclusion sanctions on defendant as per the attached proposed Order.
