STIPULATION WAIVER OF RIGHT TO FILE LIEN
WHEREAS, G. R. Sponaugle & Sons, Inc., (hereinafter "CONTRACTOR"), having an
office at 4391 Chambers Hill Road, Harrisburg, P A 17111, has entered into a contract dated
August 30, 2005 with Pennsylvania-American Water Company (hereinafter "OWNER"),
having an office at 800 West Hershey Park Drive, Hershey, PA 17033, to provide materials and
equipment and to perform labor necessary for the construction of the Project entitled "Camp Hill
Booster Station (situated in Lemoyne Borough, Cumberland County), and Slate Hill
Booster Station (situated Lower Allen Twp, Cumberland County, PAl and Silver Springs
Antenna"
NOW, THEREFORE it is hereby stipulated and agreed by and between the said parties,
as part of the said contract and for the consideration therein set forth, that neither the undersigned
CONTRACTOR, any subcontractor or material-man, nor any other person furnishing labor or
materials to the said CONTRACTOR under this contract shall file a lien, commonly called a
mechanic's lien, for work done or materials and equipment furnished to the said Project or any
part thereof.
This stipulation is made and intended to be filed with the Cumberland County
Prothonotary within ten days after the date hereof, in accordance with the requirements of Act of
Assembly of Pennsylvania, in such case provided.
