A Conciliation Conference was continued from November 29, 2005. Counsel have exchanged correspondence concerning the parents' respective positions with regard to custody arrangements with the Conciliator since November 29, 2005. The Court previously entered an Order on October 27, 2005 providing for shared legal custody, Mother having primary physical custody and Father having alternating weekends from Friday at 7:30 p.m. to Sunday evening. 4. Father's position on custody is as follows: Father seeks shared legal and shared physical custody on a week on/week off basis. Father receives a veteran's disability for Persian Gulf Syndrome but maintains that he is available and able to properly care for the child. Father alleges that Mother suffers from depression and a shared physical custody arrangement would be beneficial to Mother and child. 5. Mother's position on custody is as follows: Mother seeks shared legal custody and primary physical custody with Father having alternating weekends and after school until Mother picks her up after work. Mother maintains that Father's condition prevents him from caring for the child on a shared physical custody basis. 6. The Conciliator recommends an Order in the form as attached scheduling a Hearing and granting the parents shared legal custody, Mother primary physical custody and Father having alternating weekends and two evenings per week. Father shall have custody of Amy for Easter Sunday 2006 and the parties will alternate the named holidays from that point forward, such that Father shall have Easter Sunday, the Fourth of July and Thanksgiving, and Mother shall have Memorial Day and Labor Day in 2006, and all even numbered years. Mother shall have custody on Easter Sunday, the Fourth of July and Thanksgiving and Father shall have Memorial Day and Labor Day in 2007 and all odd numbered years. 5. During the Christmas holiday season, the parties shall alternate physical custody between the following two periods: a.) From 9:00 a.m. on Christmas Eve until 1:00 p.m. on Christmas Day; and b.) From 1:00 p.m. on Christmas Day until 5:00 p.m. on December 26. Mother shall have the first period and Father shall have the second period for Christmas 2006 and all even numbered years thereafter. Father shall have the first period and Mother shall have the second period for Christmas 2007 and all odd numbered years thereafter. In addition, the party who has the second Christmas 2 period set forth above shall also have custody of Amy on New Year's Eve for the period from 9:00 a.m. on December 31, until 12:00 Noon on January 1. 6. The parties shall keep each other advised in the event of serious illness or medical emergency concerning the child and shall further take any necessary steps to ensure that the health and well-being of the child is protected. Zorn, by and through his counsel of record, Bradley L. Griffie, Esquire and Petitions the Court as follows: 1. Petitioner is the above named Plaintiff, Ralph B. Zorn, an adult individual currently residing at 1916 Ester Drive, Carlisle, Pennsylvania, 17013. 2. Respondent is Robin E. Zorn, the above named Defendant and an adult individual currently residing at 1152 North Pheasant Run, Carlisle, Pennsylvania, 17013. 3. The parties are the natural parents of one child namely Amy Zorn, born August 10, 1996. 4. The parties are subject to an Order of Court dated February 6, 2006, which is attached hereto and incorporated herein as hereby reference as Exhibit "A" setting forth their rights with respective custody of the child, Amy. 5. The Respondent has willfully failed to abide by the Order as follows: (A) During the weeklong period beginning August 11, 2006 at 6:00 p.m., when Amy was to have been with Petitioner for the period from Friday, August 11, 2006 at 6:00 p.m. to Friday, August 18, 2006 at 6:00 p.m., Respondent failed and refused to allow Amy to be in Petitioner's custody thereby violating paragraph 3(B) of the Order; (B) Respondent willfully failed to allow Petitioner to have Amy in his custody from Friday, August 25, 2006 from 6:00 p.m. until Sunday evening at 7:30 p.m. therby violating paragraph 3(A)(i) of the Order; (C) During the week of August 28, 2006, which was the first week of school for Amy, Respondent failed and refused to allow Amy to be in the Petitioner's custody for one evening per week, from after school until the following morning thereby violating of paragraph 3(A)(ii); (D) During the week of August 28, 2006, Respondent willfully failed and refused to allow Amy to be in Petitioner's custody for one evening per week, from after school until the end of the mother's work day thereby violating paragraph 3(A)(iii) of the Order. (E) Respondent willfully failed and refused to allow Petitioner to have custody of Amy from the end of Amy's school day on Friday, September 1, 2006 until 7:30 p.m. on Sunday through September 3, 2006, therby violating paragraph 3(A)(i) of the Order; (F) During the week of September 5, 2006, Respondent willfully failed and refused to allow Petitioner to have custody of Amy for one evening per week from after school until the following morning when Amy was to go to school, thereby violating of paragraph 3(A)(ii) of the Order; (G) During the week of September 5, 2006, Respondent willfully failed and refused to allow Petitioner to have custody of Amy for one evening per week, from after school until the end of the mother's work day thereby violating paragraph 3(A)(iii) of the Order; and (H) Respondent willfully failed and refused to allow Petitioner to have custody of Amy from the end of Amy's school day on Friday, September 10, 2206, thereby violating paragraph 3(A)(i) of the Order; 6. Petitioner made repeated requests of Respondent to have custody of Amy pursuant to the Court Order and Respondent has refused to allow those periods of custody. 7. Counsel for Petitioner corresponded with counsel for Respondent specifically requesting and demanding that Respondent comply with the terms of the Court Order, and more specifically that she provide Petitioner with his weekend of custody for the weekend of September 1, 2006 to September 3, 2006 and counsel for Respondent indicated that Respondent would not comply with the Order. 8. Until August 11, 2006, when Respondent began refusing to allow contact between the child and Petitioner, during the school year, Petitioner's weekend period of custody and his week day periods of custody began by Amy going to Respondent's home on the school bus, as this is the same school bus hat is used by Petitioner's son, who is in Petitioner's sole custody. 9. Petitioner has not been advised by Respondent of who is providing care for Amy after school during periods of time that Petitioner is to have custody and, since the parties' separation, Respondent has used at least four different childcare arrangements for Amy after school. 10. Since Petitioner does not know Amy's whereabouts after school and Respondent has failed and refused to communicate this information to him, and has failed and refused to communicate to Petitioner Respondent's work schedule, Petitioner has no means of making arrangements to pick up Amy from whatever childcare arrangements have been established by Respondent. 11. Respondent, without any basis whatsoever, has threatened Petitioner with the filing of a Protection from Abuse action, which causes Petitioner great fear, as Respondent has made false claims of abuse in the past and Petitioner anticipates that if he is in the vicinity of the Respondent or her home, she will make these false claims of abuse again in order to secure a Protection from Abuse Order. 12. While Petitioner understands Respondent continues to work at the same establishment of where she worked on February 6, 2006, when the Order was entered and continues to have the same work hours, Respondent has failed to provide Petitioner with information as to evenings when she is working, which was to be the days when Petitioner had custody of the child for the evening and for an overnight during the week. 13. Petitioner is deserving of make-up time and should be afforded additional time to make-up for the periods of time that he lost with his daughter. 14. Respondent, who is in willful violation of the Court Order, should be obligated to pay counsel fees and expenses associated with the filing and prosecution of the within Petition for Contempt. 15. The parties are the parents of a minor child, Amy'Zorn, (hereinafter, the "Child"), born August 10, 1996. 8. On February 6, 2006, an Order of Court was entered by the Honorable Edward E. Guido, in which Mother was granted primary physical custody of the Child, and Father was granted partial physical custody of the Child. A true and correct copy of the 2/6/2006 Order is attached hereto, marked Exhibit "A" and made a part hereof. 9. For approximately two (2) years, Father did not exercise his partial physical custody rights with the Child, but recently after breaking up with his girlfriend he started seeing the child again. -2- 10. Father requested and mother agreed that Father would have the child over the weekend of December 18-20, 2009. 11. On Sunday, December 20, 2009, Father refused to return the child to the custody of Mother. Instead he called Children and Youth claiming Mother has abused the Child because one of her friends was in a motorcycle gang and this frightened the child and because she did not provide enough food in the house for the child. 12. A representative of Children and Youth, "Shelly", told Father that this was not abuse and that he needed to return the Child to the custody of Mother, which he refused to do. 13. Mother was in contact with the police who refused to become involved because this was a "civil matter" telling mother to deal with this situation through her attorney. 14. Father did not take the child to school on December 21, 2009, reporting that the child was being interviewed by Children and Youth today, which Mother confirmed was untrue. 15. An emergency exists because Father refuses to return the Child to Mother's custody as required by the 2/6/06 Order of Court and because the police will not be involved without direction by the Court. 16. As a result of Father's actions aforesaid, Mother has incurred legal fees and costs in an amount of no less than $600.00 and claim is made therefore. WHEREFORE, based on the foregoing, Wife respectfully requests this Honorable Court to enter an Order containing the following terms: 1.
