DENISE HOWARD, 1406 State Street Harrisburg, PA 17103 Defendant. TRIAL BY JURY DEMANDED COMPLAINT Plaintiff Farmington Manor, by its attorney the Law Offices of Peter J. Russo, P.c., for Plaintiffs Complaint states: I. Plaintiff Farmington Manor, is a Pennsylvania Limited Liability Partnership doing business in the Commonwealth of Pennsylvania at the above-referenced address. 2. Defendant is an adult individual believed to be residing at the above-captioned address. 3. Defendant, tenant, rented property located at 302 Sheppard Lane, Shippensburg, P A, 17257, from Plaintiff, landlord. 4. The written lease between Plaintiff and Defendant had a start date of March 29, 2003, and an end date of February 29,2004. A true and correct copy of the lease is attached as Exhibit A. 5. Plaintiff verbally agreed to permit Defendant to extend her lease until June 6,2004, in order to allow Defendant's children to complete school. 6. Defendant vacated the apartment on or about June 6, 2004. 7. Defendant scheduled an appointment with Plaintiff for June 6, 2004, at which time a post inspection of the rented premises was to take place. 8. Defendant failed to attend the June 6, 2004, appointment. 9. Defendant scheduled a second appointment with Plaintiff for June 7, 2004, at which time a post inspection of the rented premises was to take place. 10. Defendant failed to attend the June 7. 2004, appointment. II. On June 8, 2004, Plaintiff conducted a post vacancy inspection of the premises leased to Defendant. 12. During the June 8, 2004, inspection, Plaintiff observed that there was a broken cabinet door, trash was left behind along with two cats, the carpets needed to be replaced, the apartment was masked with a strong cat urine odor, and the Defendant failed to leave behind the house and mailbox keys. 13. Plaintiff, in compliance with proper procedure, contacted Housing and Urban Development (HUD) authorities, who on June 15,2004, sent an individual to inspect the premIses. 14. HUD's inspector also noted that the premises reeked of cat urine and that the carpets would need replaced. A true and correct copy of the inspector's report is attached as Exhibit B. 15. At the start date of the lease, the carpets within the premise were new and Defendant was issued two front door keys, three mailbox keys, and one garage key. A true and correct copy of Move-In Inspection Form is attached as Exhibit C. 16. Plaintiffhad the carpets replaced at a cost of$I,043.40. A true and correct copy of the carpet invoice is attached as Exhibit D. 17. Plaintiffhad the trash removed at a cost of$200.00. A true and correct copy of the trash invoice is attached as Exhibit E. 18. In acting as aforesaid, Defendant caused damage to Plaintiffs property in an amount in excess of $ I ,243.40. WHEREFORE, Plaintiff claims damages from Defendant in an amount in excess of $1 ,243 .40, plus interests, costs and any other appropriate damages. D' Alo of MidPenn Legal Services, and responds to the Complaint filed in the above captioned matter as follows: 1. Neither admitted nor denied. Defendant has no knowledge of Plaintiff' s business status in the Commonwealth of Pennsylvania. 2. Denied. Defendant has moved to a new residence in Steeelton, Pennsylvania. 3. Admitted. 4. Admitted. S. Denied. There was no agreement between the parties to extend the lease. The parties agreed to a month to month lease once the terms of the written lease had expired. 6. Admitted in part. Specifically, Defendant had completed moving out all of her furniture and belongings by June S. 7. Admitted. 8. Denied. On June 6, Defendant's car broke down and she called the Plaintiff and left a voice mail message to that effect. 9. Denied. On June 7, Defendant had not heard anything in response to her voice mail message of June 6 and on her own volition, without an appointment, went to meet with Tina Gatlin of Farmington Manner. At this meeting, Defendant was informed that the apartment had been inspected and had passed. Defendant offered to leave the one broken key she had but was told to throw it out. Defendant understood she would have to pay for replacement keys. After June 7, Defendant had no further access to the apartment. Defendant was also informed that she would get her security deposit back within a month less the cost of the keys. 10. Denied. 11. Neither admitted nor denied. What Plaintiff did on June 8 is not within Defendant's ability to know. Defendant was told on June 7, however, that the inspection had been completed. 12. Denied in part. Defendant denies that she left any trash at the apartment, that she left any damaged property, or that she was responsible for any damage done by cats in the apartment. Defendant did not keep any cats in her apartment and cannot be responsible for Plaintiffs lack of security of the building. Defendant admits that she did not return keys to the Plaintiff. 13. Neither admitted nor denied. Defendant has no knowledge of Plaintiffs operating procedures. 14. Neither admitted nor denied. Exhibit B is hearsay evidence and strict proof of its authenticity is demanded. 15. Denied. Exhibit C is hearsay evidence and strict proof of its authenticity is demanded. In addition, on its face Exhibit C does not show that all ofthe carpets in the apartment were new but that only $350.00 of new carpet had been installed. 16. Denied. Exhibit D is hearsay evidence and strict proof of its authenticity is demanded. In addition, Exhibit D does not show where the carpeting was installed only that it was received by Farmington Manner. 17. Denied in part. Exhibit E is hearsay evidence and strict proof of its authenticity is demanded. Plaintiff may have had trash removed on the averred date and cost, but Defendant denies that any of it was her trash. 18. Denied. NEW MATTER IN THE FORM OF PRELlMNARY OBJECTIONS By way of New Matter, Defendant avers the following: I. Defendant filed a complaint in front of District Justice Bender to recover her security deposity on August 5, 2005. 2. A hearing was scheduled on her complaint for September 13, 2005. 3. When Defendant appeared for this hearing, she received notice of a complaint filed by Plaintiff. 4. Through her counsel, Defendant asked for a continuance with respect to Plaintiffs action. 5. Through her counsel, Defendant objected to the Magisterial Judge hearing testimony on Plaintiffs complaint because there had not been adequate notice under Rules 307, 308, and 315 of the Rules of Civil Procedural related to Magisterial District Judges. 6. Defendant was unprepared to proceed on Plaintiffs claims and so informed the Magisterial District Judge. 7. Although the Magisterial Judge did not find any proof of service by registered mail, regular mail, or personal service, he proceeded to hear both complaints without regard to Defendant's objections. For the above reasons, Defendant preliminarily objects to this Court's hearing this matter and preliminarily objects to the Plaintiffs complaint on the basis that this Court lacks jurisdiction over this matter under Plaintiff properly exhausts the statutory remedies provided by law at the Magisterial Judge level.
