WHEREAS, Anna May J. Bellanca of 1000 Brookwood Drive, Mechanicsburg,
Pennsylvania, is about to execute contemporaneously herewith, a contract, with J,
W. Mumper Construction, Inc. of 6 Lynchburg Court, Mechanicsburg,
Pennsylvania, for the erection of a building upon premises commonly known as lot
# 4 of Lindenwood Phase III, a planned community, located in the Township of
Upper Allen, within the County of Cumberland, Commonwealth of Pennsylvania as
set forth in the deed dated June 30, 2005, recorded in Deed Book 269, Page
4324,4325, and 4326, in the Recorder's Office for Cumberland County,
Pennsylvania, as more specifically described in Exhibit "A" which is incorporated
herein and attached hereto.
Now, October 12, 2005, at the time of and immediately before the execution of
the principal contract, and before any authority has been given by the said Owner
to the said Contractor to commence work on the said building, or purchase
materials for the same in consideration of the making of the said contract with
Contractor and the further consideration of One Dollar ($1.00), to Contractor paid
by Owner, it is agreed that no lien shall be filed against the building by the
Contractor, or any subcontractor, nor by any of the material men or workmen or
any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being
expressly waived.

ALL THAT CERTAIN parcel of ground known as Lot No.4 of Linden wood
Phase ill, a planned community, located in the Township of Upper Allen, within the
County of Cumberland, Cqmmonwealth of Pennsylvania, being more fully bounded and
described as follows to WIT:
BEGINNING at an iron pin to be set along the Southern right-of-way ofLeyton
Way at the westernmost corner of Lot No, 3 of Linden wood Phase Ill;
Thence along said Lot No.3 South Forty-six degrees Twenty-four :Minutes Forty-one
Seconds East (S 46024'41" E) a distance of Thirty-seven and Fifty-seven Hundredths feet
(37.57') to an iron pin to be set along said Lot No.3;
Thence along said Lot NO.3 and continuing along Lot No.2 of Linden wood Phase ill
South Five Degrees Eighteen :Minutes Forty Seconds East (S 05018'40" E) a distance of
