STIPULATION AGAINST MECHANICS' LIENS
THIS AGREEMENT made and concluded on October 14, 2005,
BETWEEN WilIiam.l. Wirl,.Ir. of 855 York Road, Carlisle, Pennsylvania, party of the first part (hereinalter called
Owner),
AND Wid ConslTllction of 855 York Road, Carlisle, Pennsylvania, party of the second part, (hereinal\er called
Contractor),
WHEREAS the said parties have by a duly executed Agreement under seal, bearing even date herewith. entered
into a written contract for the excavation on a portion of'the premises, and the construction and completion of a slogle
family residence to be creeted on the lot of ground situate in North Middleton Township, Cumberland County.
Pennsylvania, known as Lot No, 47, North Ridge, Plasc VI. Terrace View.
WHEREAS, the said parties agree that construction will not commence prior to .ad:t~j~].Q'2:___,
NOW THIS AGREEMENT WITNESS: That the Contractor for and in consideration of the contract aforesaid
and thc consideration mentioned thereunder, as well as the further consideration of One ($1.00) Dollar to him in hand
paid by the Owncr at or before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged,
docs hereby covenant, promise. and agree that no mechanics' lien or claim or other lien or claim of any kind whatsoever
shall be tiled or maintained against the said building or buildings nr the curtilage or curtilages appurtenant thereto, by
Contractor or by any sub-contractor, materialmen, or laborers for work done, or materials furnished under said contract
or by any other party acting througb or under them or any of them lor and about said building or buildings or any part
thereof, or on credit thercof, and that all snb-contractors, materialmen and laborers on said work shall look to and hold
Contractor personally liable ior all sub-contracts, materials furnished and work and labor done, so that there shall not be
any legal or lawlul claim of any kind whatevcr against Owner for any work donc or labor or materials furnishcd undcr said
contract for and about the erection, construction, and completion of said buildings as aforesaid, Of under any contract
lor extra work or lor work supplemental thereto or othelwise,
AND this agTeement waiving the right oflien shall be an independent covenant and shall opcrate and be e!lcctive
as well widl respect to work done and materials lllrnished under any supplemental contract for extra work in (he erection,
construction, and completion of the said building or buildings as any work and labor done and materials furnished
under the contract aforesaid.
AND, in order to givc the Owner full powcr and authority to protect himself and the lot or lots of ground against
any and all claims Iiled by the Contractor or anyone acting under or through him or it in violation of the foregoing
covenant, the said Contractor for himself, themselves, itself, hereby irrevocably authorizes and empowcrs any Attorney
of any Court of Common Pleas of the Commonwealth of Pennsylvania. to appear for him, them, it or any of them, in any
of the said Courts of Common Pleas as Attorney for him, them, or it and in him, their, its, name, mark satislied of
record at the cost and expense of the Contractor or of any Sub-Contractor or Materialman, or Materialmen, any and all
claims or claim, lien or lien, fIled by or for the Contractor, or any Sub-Contractor or Materialman, or in his or their name
against said building or buildings, lor or lots of ground or any part thereof and for such act, or acts this shall be good
and sul1icicnt warrant and authority, and a reference to the Court, Term and Number in which and where this
Agreement shall have been iiled shall be a suflicient exhibit of the Authority hercin contained to warrant such action,
and the Contractor lor himself, themselves, itself, do hereby remise. release and quit-claim all rights and all manner of
errors, defects and imperfcctlons whatsoever in entering such satisfaction or in anywise touching Of concerning the
same.
IN WITNESS WHEREOF, the said parties have hereunto sct their hands and seals dared the day and year lirst
above written.
