Plaintiff is MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., PO Box 9481, Mail Code: 22-528-1011 Gaithersburg, MD 20898-9481. 2. The names and addresses of the Defendants are JULIA A. FETTERMAN, 2831 Ritner Highway, Carlisle, PA 17013 and WILLIAM I. FETTERMAN, 2831 Ritner Highway, Carlisle, PA 17013, who are the mortgagors and real owners of the mortgaged premises hereinafter described. 3. On May 30, 2002 mortgagors made, executed and delivered a mortgage upon the Property hereinafter described to AMERICAN HOME BANK, N.A., which mortgage is recorded in the Office ofthe Recorder of Deeds of Cumberland County as Book 1761, Page 2711. The mortgage has been assigned to: MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. by assignment of Mortgage which assignment is lodged for recording. The Mortgage and assignment(s) are matters of public record and are incorporated by this reference in accordance with Pennsylvania Rule of Civil Procedure 10 19(9); which Rule relieves the Plaintiff from its obligation to attach documents to pleadings ifthose documents are matters of public record. 4. Mortgage Electronic Registration Systems Inc. is or will be, the owner oflegal title to the mortgage that is the subject of this action, and nominee for Citimortgage, Inc., which is the owner ofthe entire beneficial interest in the mortgage. 5. The Property subject to the Mortgage is more fully described in the legal description set forth as Exhibit "A" ("Property"). 6. The mortgage is in default because the monthly payments of principal and interest are due and unpaid for July 01,2005 and each month thereafter and by the terms the Mortgage, upon default in such payments for a period of one month or more, the entire principal balance and all interest due and other charges are due and collectible. 7. If the Mortgage is reinstated prior to a Sheriffs Sale, the Attorney's Fees set forth above may be less than the amount demanded based on work actually performed. The Attorney's Fees requested are in conformity with the Mortgage and Pennsylvania law. Plaintiff is entitled to collect Attorney's fees of up to 5% of the remaining principal balance in the event the Property is sold to a third party purchaser at Sheriffs Sale or ifthe complexity of the action requires additional fees in excess ofthe amount demanded in the Action. 9. Plaintiff is not seeking a judgment of personal liability (or an "in personam" judgment) against the Defendants in this Action but reserves its right to bring a separate Action to establish that right, if such right exists. If Defendants have received a discharge of their personal liability in a Bankruptcy proceeding, this Action of Mortgage Foreclosure is, in no way, an attempt to re-establish the personal liability that was discharged in Bankruptcy, but only to foreclose the Mortgage and sell the Property pursuant to Pennsylvania law. 10. The Mortgage is insured by the Federal Housing Administration under Title II ofthe National Housing Act and, as such, is not subject to the provisions of Pennsylvania Act No. 91 of 1983 or Act 160 of 1998. WHEREFORE, Plaintiff demands a de terris judgment in mortgage foreclosure in the sum of$153,339.26, together with interest at the rate of$27.88, per day and other expenses, costs and charges incurred by the Plaintiff which are properly chargeable in accordance with the terms of the Mortgage and Pennsylvania law until the Mortgage is paid in full, and for the foreclosure ofthe Mortgage and Sheriff's Sale ofthe Property. Payments were made according to this schedule through July 31, 2005, and were recorded by the defendants by hand (see Exhibit "B", attached hereto), which payments were confirmed in a payment history provided by CitiMortgage, Inc. through June 7, 2005. (See Exhibit "C" attached hereto). When the defendants called on August 31, 2005 to make the next scheduled payment, the next to last on the repayment schedule, CitiMortgage, Inc. refused to accept the payment by phone, the means by which most previous payments had been made. II 7. Denied. Defendants dispute the amount owed to Plaintiff. This amount is inflated by plaintiff's failure to apply all funds remitted by defendant, thereby incurring additional interest and late charges. Proof of all amounts due is demanded at trial. 8.
