COMPLAINT
Plaintiff, Timothy A. Clark, M,D" by and through his undersigned attorneys,
hereby files this Complaint against the defendants, Palisades Collection, LLC and TrueLogic
Financial Corporation. Plaintiff avers the following in support of his Complaint:
A. Parties
1. PlaintiffTimothy A. Clark, M,D, ("Dr. Clark" or "Plaintiff') is a citizen
and resident of Pennsylvania who resides in Cumberland County at 9 Sand Pine Court,
Mechanicsburg, Pennsylvania 17050,
2, Defendant Palisades Collection, LLC ("Palisades") is a Delaware limited
liability corporation engaged in business for the principal purpose of collecting debts from
consumers, including Pennsylvania residents, Palisades' corporate headquarters is located at 210
Sylvan Avenue, Englewood Cliffs, New Jersey 07632, and it operates a call center located at 87
South Commerce Way, Suite 70, Bethlehem, Pennsylvania 18017.
3, Defendant TrueLogic Financial Corporation ("TrueLogic") is a Delaware
corporation engaged in business for the principal purpose of collecting debts from consumers,
including Pennsylvania residents. TrueLogic's corporate headquarters is located at 10000 East
Geddes Avenue, Suite 100, Englewood, Colorado 80112,
B. Jurisdiction and Venue
4, The Court has subject matter jurisdiction over this action pursuant to
section 813 of the federal Fair Debt Collection Practices Act, 15 U.S,c. S 1692k(d), and section
5 ofthe Pennsylvania Fair Credit Extension Uniformity Act, 73 P ,S, S 2270,5(b).
5, Venue is proper in Cumberland County pursuant to Pa,R.C,P, No, 2179(a),
because Defendants regularly conduct business in Cumberland County and because transactions
and occurrences out of which Plaintiffs claims arose took place in Cumberland County,
C. Facts
6, On or about August 26, 2005, Dr. Clark received an e-mail notification
from his credit monitoring service, alerting him to a change to his credit report, The credit report
showed that Palisades, through its Bethlehem, Pennsylvania call center, had reported negative
credit information indicating that Dr. Clark owes an unidentified outstanding debt of $1,007,00,
7, Knowing that he did not owe the alleged debt, and assuming that Palisades
had made a mistake, Dr. Clark promptly attempted to discuss the alleged debt with Palisades and
have the negative information removed from his credit report,
8, Dr, Clark initially contacted Palisades on August 29, 2005; to date,
however, Palisades has refused to discuss or provide written validation of the alleged debt,
advising Dr. Clark that it assigned the alleged debt to Defendant True Logic, and therefore only
TrueLogic could discuss it with him or provide written validation,
9, Dr. Clark contacted TrueLogic on August 29, 2005; to date, TrueLogic has
similarly refused to provide written validation of the alleged debt, despite several requests,

including two made in writing, copies of which are attached hereto as Exhibit A and incorporated
herein, TrueLogic has merely stated over the telephone that the alleged debt relates to a 1998
ATT Wireless account.
10, Prior to August 29, 2005, no creditor or debt collector has ever
communicated with Dr. Clark regarding the alleged debt, and prior to August 26, 2005, he had
never even heard of either Defendant; nevertheless, Palisades placed false negative credit
information regarding Dr. Clark on Dr, Clark's credit report.
11. On September 21, 2005, Dr. Clark sent Defendants a letter formally
notifying them that he disputes the alleged debt. A copy of the September 21,2005 letter is
attached hereto as Exhibit B and incorporated herein,
12, Defendants have refused to provide corrected information to credit
reporting agencies, and the false debt continues to appear on Dr. Clark's credit report.
13, Dr. Clark is in the process of purchasing an office building, and he applied
for a loan in connection with the purchase,
14, The false negative credit information reported by Palisades has interfered
with Dr. Clark's ability to obtain the loan and complete the purchase, delaying the transaction
and causing him to incur additional costs,
15, Upon information and belief, at all relevant times, Defendants knew that
Dr. Clark has applied for a loan, and they placed the false negative credit information on his
credit report and have refused to correct or even validate it in order to pressure Dr. Clark into
paying a debt he does not owe so that he can complete the real estate purchase.

D. Causes of Action
COUNT I - VIOLATIONS OF THE FEDERAL
FAIR DEBT COLLECTION PRACTICES ACT
16, Plaintiff incorporates by reference paragraphs 1 through 15 of this
Complaint as if fully set forth herein,
17, The federal Pair Debt Collection Practices Act ("FDCPA"), 15 U.S,C. SS
1692a-16920, prohibits a debt collector from harassing, oppressing, or abusing any person in
connection with the collection of a debt.
18, Defendants violated the PDCP A by, among other things, communicating
credit information regarding Dr. Clark which Defendants knew or should have known to be false,
See. e.g., 15 U,S,C, SS 1692d; 1692e(2)(A), (8),
19. Defendants also violated the PDCPA by refusing to provide Dr. Clark with
written validation ofthe alleged debt wiiliin five days after their initial communication with Dr.
Clark or his attorneys. See 15 U.S,C, S 1692g,
WHEREFORE, Plaintiff respectfully requests that this Court enter a judgment in
his favor and against Defendants Palisades and TrueLogic, which will fully compensate, punish
and deter Defendants' violations of the FDCPA, including the award of:
(i) Plaintiffs actual damages, in an amount exceeding $25,000;
(ii) the costs of this lawsuit, together with reasonable attorneys' fees as
determined by the Court; and
(iii) additional damages, to be assessed as the Court deems appropriate,

COUNT II - VIOLATIONS OF THE PENNSYL VANIA
FAIR CREDIT EXTENSION UNIFORMITY ACT
AND THE PENNSYLVANIA UNFAIR TRADE
PRACTICES AND CONSUMER PROTECTION LAW
20, Plaintiff incorporates by reference paragraphs 1 through 19 of this
Complaint as if fully set forth herein,
21, The Pennsylvania Fair Credit Extension Uniformity Act ("FCEUA"), 73
P,S, SS 2270,1-2270,6, provides that if a debt collector violates any of the provisions ofthe
federal FDCP A, the violation shall constitute an unfair or deceptive debt collection act or
practice under the FCEUA. 73 P,S, S 2270.4(a),
22, The FCEUA further provides that if a debt collector engages in an unfair
or deceptive debt collection act or practice under the FCEUA, it shall also constitute a violation
ofthe Pennsylvania Unfair Trade Practices and Consumer Protection Law ("UTPCPL"), 73 P,S,
SS 201-1 to 201-9.3,
23, Defendants, by violating the federal FDCPA, have also violated the
Pennsylvania FCEUA and the Pennsylvania UTPCPL.
WHEREFORE, Plaintiff respectfully requests that this Court enter a judgment in
his favor and against Defendants Palisades and TrueLogic, which will fully compensate, punish
and deter the Defendants' violations of the FCEUA and the UTPCPL, including the award of:
(i) Plaintiffs actual damages, in an amount exceeding $25,000;
(ii) treble damages;
(iii) the costs of this lawsuit, together with reasonable attorneys' fees as
determined by the Court; and
(iv) additional damages, to be assessed as the Court deems appropriate,

Gentlemen:
This firm represents Dr, Timothy A, Clark in connection with an alleged debt
which Palisades and TrueLogic have attempted to collect. I have enclosed a copy of Dr, Clark's
signed Power of Attorney authorizing me to address this matter with you,
Dr. Clark first learned of Palisades' and TrueLogic's efforts to collect an
unidentified debt from him on August 26, 2005, while reviewing his credit report, He has never
received any communication from Palisades or TrueLogic. On August 30,2005, I called
Palisades and TrueLogic on Dr. Clark's behalf. Palisades refused to provide any information
regarding the alleged debt and instead referred me to TrueLogic. TrueLogic advised me that the
alleged debt arises from a 1998 ATT Wireless bill in the anlount of$1,007, Despite my several
requests for written vaJidation of the alleged debt (authorized by the signed Power of Attorney
which I furnished to TrueLogic twice), TrueLogic has refused to provide any written record,
This is to notify Palisades and TrueLogic that Dr. Clark disputes the alleged A IT
Wireless debt. You are to stop all debt collection action immediately and notify all credit
reporting agencies of this dispute, In addition, we are commencing a legal action against both

3, This cause is removable based on federal question jurisdiction, PlaintitT alleges that
Defendants violated a federal statute, the Fair Debt Collection Practices Act, 15 u.s. C. c\\C1681
("FDCPA"), See Plaintiffs Complaint, paragraphs four (4), seventeen (17) through nineteen (19), and
twenty-one (21) through twenty-three (23), Therefore, this Court has jurisdiction pursuant to 28 u,s,c.
9144 I (b), because Plaintiff has asserted claims arising under the laws of the Unitcd States,
4, Venue is proper in this District and Division of the United States District Court for the
Middle District of Pennsylvania, under 28 U,S,c. 91441(a), because this Court and Division embrace the
place where the removed action has been pending,
5, Defendant TrueLogic will file promptly a copy of this Notice of Removal with the Office
