AND NOW, this day of " 2005, upon consideration
of the Petition of Pennsylvania Guardianship Association, Inc., the court appointed
plenary guardian of the estate of Mary C. Dugan, the proposed sale of real property to
Charles Fields for $122,000.00 according to the October 8, 2005 Agreement for Sale of
Real Estate is hereby authorized and upon receipt of the full purchase price, the court
appointed plenary guardian of the Estate is authorized to make, execute and deliver a
Deed conveying all interest of Mary C. Dugan to Charles Fields for the premises at 308
Mount Allen Drive, Mechanicsburg, Upper Allen Township, Cumberland County,
Pennsylvania.
The purchase money shall be accounted for by the plenary guardian of the
Estate in the annual accounting filed with this Court.

TO THE HONORABLE, THE JUDGES OF SAID COURT:
AND NOW, comes the Petitioner, Pennsylvania Guardianship Association, Ihc.

by and through its attorneys, Johnson, Duffie, Stewart & Weidner and petitions t~is
Court and in support of this Petition avers as follows:
1. Petitioner, Pennsylvania Guardianship Association, Inc. located at P.O.
,
Box 7295, Lancaster, Pennsylvania 17604 is the court appointed guardian of the est~te
of Mary C. Dugan by Order of Judge Hess entered on June 1, 2005. Attached her~~o
as Exhibit "A" is a true and correct copy of said Order.

2. Mary C. Dugan is an incapacitated person who resides at the Bridges of
Bent Creek Personal Care Home, 2100 Bent Creek Boulevard, Mechanicsburg, PA.
3. Mary C. Dugan suffers from a mild form of a mental impairment that
prevents her from receiving and evaluating information effectively and prevents her frpm
formulating and communicating decisions to such a significant extent that she is unalble
to manage her financial affairs or meet essential requirements for her physical he~lth
and safety on a daily basis. She is not able to live independently and cannot return to
her home.
4. The incapacitated person and her late husband, Kenneth R. Dugan, are
the title owners to real property located at 308 Mount Allen Drive, Mechanicsburg,

Upper Allen Township, Cumberland County, Pennsylvania having acquired the prop$rty
by Deed dated June 3, 1965 and recorded in the Cumberland County Recordelt of
Deeds office in Record Book P21, Page 771. Attached hereto as Exhibit "B" is a true
and correct copy of said Deed.
5. Kenneth R. Dugan, the incapacitated person's spouse, died on Janu~ry

28, 2002 thus vesting sole ownership of the aforesaid real property in the name of ~he
incapacitated person. Attached hereto as Exhibit "C" is a copy of Kenneth R. Dug~n's

Death Certificate.
6. The total value of the incapacitated person's assets held by iPA
Guardianship Association, not including the real estate, is approximately $2,326.67. In
addition, she has monthly income of approximately $1,895.00. Attached hereto as
Exhibit "0" is a true and correct copy of the Inventory of Assets of Mary Dugan.
7. The approximate monthly costs for the incapacitated person to be
maintained in The Bridges of Bent Creek Personal Care Home, is $4,200.00.

8. The sale of all of the incapacitated person's real estate, including that
located at 308 Mount Allen Drive, Mechanicsburg, Upper Allen Township, Cumberland
County, Pennsylvania, was specifically authorized by the court order of Judge Hess
dated June 1,2005. See Exhibit MA."
9. Since the incapacitated person will not be able to return to the real estate
to reside, no one else resides in the home, and the incapacitated person has mounting
care costs, your Petitioner authorized a public auction of the real estate which occurred
on October 8, 2005.
10. The aforesaid real estate (tax parcel 42-28-2423-020) has a current
assessed value of $133,410.00, and after applying the Cumberland County common
level ratio of 1.0, this real property has an approximate market value of $133,410.00.
11. Your Petitioner also had the property appraised by L. G. Connor Real
Estate Appraisers on September 12, 2005, and the appraisal report indicated the fair
market value was $125,000.00. Attached hereto as Exhibit ME" is a copy of a summary
of that appraisal.
12. An auction was conducted by an Auctioneer, Cindy Fenton, on October 8,
2005 which generated a sale price of $122,000.00.
13. Your Petitioner believes that a fair and equitable price of $122,000.00 has
been obtained for the real estate and respectfully requests this Court to approve the
sale.
14. Subsequent to the public auction, and consistent with the bid awarded by
the Auctioneer, your Petitioner and the successful bidder, Charles Fields entered into a
written Agreement for Sale of Real Estate in the amount of $122,000.00 with settlement
to occur on or within forty-five (45) days of the date of auction. Attached as Exhibit uF"
is a .true copy of said Agreement.

WHEREFORE, your Petitioner requests this Court to enter an Order authorizing
the sale of the real estate at 308 Mount Allen Drive, Mechanicsburg, Lower Allen
Township, Cumberland County, Pennsylvania to Charles Fields for $122,000.00
pursuant to the terms and conditions of the October 8, 2005 Agreement for Sale of f1eal
Estate.

The Court directs that the existing Power of Attorney appointing Lee Stetler as
Mary Dugan's attorney-in. fact is hereby revoked, effective immediately.
The Court appoints the Area Agency on Aging. in and for Cumberland County,
Pennsylvania. as Permanent Plenary Guardian of the Person of Mary Dugan and
Pennsylvania Guardianship Association as Permanent Plenary Guardian of the Estate of
Mary Dugan.
Under the terms of this Order, Jeanne Townsend (sister), Sharon DeBuck
(daughter), and Terri Simeon (daughter) shall be given access to medical information an

daily trips and excursions. The aforesaid family members shall thereafter return her to
said facility at the end of the daily trip or excursion,
The Guardian of the Estate, among other powers, shall have the authority to sell
any and all real estate owned by Mary Dugan and shall be authorized to execute any and
an documents relating to the sale of said real estate.
In the event that the Guardian of the Estate shall be required, at some future date~
to submit an application for medical assistance on behalf of Mary Dugan, the Court
directs that the Guardian of the Estate be permitted payment of the maximum allowable:
fee allowed under the then existing rules and regulations promulgated by medical
assistance.

AGREEMENT FOR SALE OF REAL ESTATE
THIS AGREEMENT made this g,lt day of October, 2005, by and between the PEN SYLVANIA
GUARDIANSHIP ASSOCIATION, INC., P.O. Box 7295, Lancaster, Pennsylvania 17604, Plena Guardian
of the Estate of Mary C. Dugan by Order of Court dated June 1, 2005 (hereafter "l eller") and

(hereafter "Buyer");
WITNESSETH
1. Sale and Purchase. Seller agrees to sell and convey and Buyer agrees to pure ase all that
certain tract of real estate municipally known as 308 Mt Allen Drive, Mechanicsburg (Upper Allerll Township),
Cumberland County, Pennsylvania, upon the terms and conditions hereafter set forth.
2. Real Estate. The Real Estate is more particularly described on Exhibit "A" ("R al Estate")
attached hereto.
3.
Purchase Price.
The purchase price

A. Down Payment. The sum of Ten Thousand ($10,000.00) Dollars shall be ~ id

5. Court AIJIJroval. The sale of the aforesaid real estate by the Seller, a court-appoi ted Plenary
Guardian of the Estate of Mary C. Dugan, is contingent upon the approval of the Orpha s' Court of
Cumberland County. Seller shall petition the Orphans' Court of Cumberland County for app oval of this
Agreement, and obtain authorization to execute a Deed and other documents necessary to CQ vey title to
Buyer at settlement.
6. Settlement. Settlement shall be held on or before forty five (45) days from the, date of this
Agreement, at such time and place as the parties shall mutually agree. Said date of settlerm nt may be
extended an additional thirty (30) days unilaterally by Seller in the event more time is needed to': btain court
approval of the sale by the Guardian as referenced in Paragraph 5 above.
7. Possession. Possession shall be given at settlement.
8. Real Estate Transfer Taxes. Real estate transfer taxes will be shared equally b the Buyer
and Seller at settlement.
9. Prorations. All real estate taxes levied on the Real Estate shall be prorated as of the date of
settlement, the County and Borough taxes being prorated on a calendar year basis and the sq 001 district
taxes being prorated on a July 1 fiscal year basis.
10. MuniciIJal Charges. Municipal charges for sewer rental, trash service and/or watE! service by
the municipality shall be prorated as of the date of settlement.
11. Title. At settlement, the Real Estate shall be conveyed by special warranty deed fr$ and clear
of all liens and encumbrances, subject to all easements and conditions of record, any de facto eas~ ents, and
any other existing conditions apparent from physical inspection of the premises, such title to be good and
marketable or such as will be insured by any responsible title insurance company at its regular rat$ in the full
amount of the purchase price.
12. Risk of Loss. Risk of loss by fire or other casualty shall remain in the Selle until final
settlement. In case of fire or other casualty prior to settlement, Buyer shall have the option of res inding the
Agreement or of settling and obtaining an assignment of the insurance proceeds.
13. Notices. All notices required by this Agreement shall be sufficient if delivered by c~rtified mail,
postage prepaid, return receipt requested, or personally delivered to one of the parties to this A~reement as

14. Conditions. Buyer agrees to purchase the Real Estate and improvements in t eir present
condition "as is" and Seller makes no warranty, representation or inducement to the Buyer with ra pect to the
condition of the improvements.
15. Lead Paint.
A. Lead Paint Warninq Statement. Every purchaser of any interest in residel tial
real property on which a residential dwelling was built prior to 1978 is notified that $ ch
property may present exposure to lead from lead-based paint that may place young childr~ at
risk of developing lead poisoning. Lead poisoning in young children may produce perman nt
neurological damage, including learning disabilities, reduced intelligence quotient, behavl ral
problems, and impaired memory. Lead poisoning also poses a particular risk to preg~ nt

women. The Seller of any interest in residential real property is required to provide the Blflyer
with any information on lead-based paint hazards from risk assessments or inspections in: the
Seller's possession and notify the Buyer of any known lead-based paint hazards. A :1isk

purchase.

Nittany Road; thence along lands of Thomas J. Simpson, South eighty-on~ (81) degrees forty-five 5) minutes
West one hundred fifty (150) feet to lands now or late of Clyde E. Kimmel; thence along the same North eight
(8) degrees fifteen (15) minutes West one hundred twenty (120) feet to lands of Robert D. Willi ms; thence
along the same North eighty-one (81) degrees forty-five (45) minutes East one hundred fifty (15~ feet to the
