COMPLAINT IN REPLEVIN
AND NOW, comes Green Tree Consumer Discount Company, by and through its attorneys,
Edward F. Voelker, Jr., Esq., Chad R. Callahan, Gregory W. Bevington, and Voelker & Associates,
P.c., and avers the following in support of its Complaint in Replevin:
1. Troy A. Eckenrode, hereinafter referred to as "Defendant," is an individual whose last
known address is 313 Walnut Dale Road, Shippensburg, PAl 7257.
2. Green Tree Consumer Discount Company hereinafter referred to as "Plaintiff," is duly
authorized to conduct business in the Commonwealth of Pennsylvania.
3. On or about November 14, 1997, Defendant entered into a "Manufactured Home
Retail Installment Contract and Security Agreement ," hereinafter referred to as the "Security
Agreement," whereby Defendant purchased and financed from Schaffs Home Center, Inc., a 1998
Fleetwood Heritage Pointe manufactured home (serial no. V AFLV19AB00880HP13) with certain
furnishings, equipment, appliances, and accessories included at the time of purchase, hereinafter

collectively referred to as the "Manufactured Home." A true and correct copy of the Security
Agreement is marked as Exhibit "A" and is attached hereto and made a part hereof.
4. It is believed and therefore averred that the Manufactured Home is located at the
residence of Defendant.
5. The Security Agreement was assigned for value to Plaintiffs predecessor-in-interest,
Greenpoint Credit Corp., on or about November 14, 1997, as permitted by the Security Agreement.
6. The Security Agreement was subsequently assigned for value to Plaintiff as permitted
by the Security Agreement.
7. Pursuant to the Security Agreement, Defendant promised to pay the financed amount of
$29,000.00.
8. As security for the loan, Defendant, by the Security Agreement, granted Plaintiffs
predecessor-in-interest a security interest in the Manufactured Home.
9. Plaintiffs predecessor-in-interest perfected its security interest in the Manufactured
Home by having an encumbrance placed on the title thereto. A true and correct copy of the Certificate
of Title for a Vehicle is marked as Exhibit "B" and is attached hereto and made a part hereof.
10. Plaintiff avers that the approximate retail value of the Manufactured Home is
$19,900.00.
11. Defendant has defaulted under the Security Agreement by failing to make payments

when due. As of October 10,2005, the delinquent payment amount due and owing from Defendant to
Plaintiff is $580.10.
12. As of October 10, 2005, the amount owed by Defendant to Plaintiff, not including
costs, attorneys' fees and damages for the unjust retention ofthe Manufactured Home, is $19,995.42.
The interest on said amount is accruing at the daily rate of$3.89.
13. Defendant has failed to surrender the Manufactured Home upon Plaintiffs demand.
14. On June 28, 2005, Plaintiff provided Defendant with a Notice of Default, a true and
correct copy of the same is marked as Exhibit "C" and is attached hereto and made a part hereof.
15. Plaintiff is now entitled to immediate possession of the Manufactured Home.
16. Plaintiffis entitled to attorneys fees under the terms of the Security Agreement.
WHEREFORE, Plaintiff claims judgment for possession of the Manufactured Home or the
value of such in the sum of $19,900.00, plus attorneys fees, costs, interest from October 10, 2005, and
damages for the unjust retention ofthe Manufactured Home.

NEW MATTER
AND NOW, November 25, 2005, Defendant Troy A. Eckenrode, by his attorney,
Douglas C. Lovelace, Jr., files this Answer to Plaintiffs Complaint in Replevin and New Matter
and avers as follows:

5. Denied. After reasonable investigation, Defendant is without knowledge or
information sufficient to form a belief as to the truth of this averment and proof thereof is
demanded, if relevant.
6. Admitted in part and denied in part. Defendant admits the Security Agreement was
assigned to Green Tree Consumer Discount Company. However, after reasonable investigation,
Defendant is without knowledge or information sufficient to form a belief as to the truth of the
remainder of this averment and proof thereof is demanded, if relevant.
7. Admitted.
8. Denied. After reasonable investigation, Defendant is without knowledge or
information sufficient to form a belief as to the truth of this averment and proof thereof is
demanded, if relevant.
9. Denied. After reasonable investigation, Defendant is without knowledge or
information sufficient to form a belief as to the truth of this averment and proof thereof is
demanded, if relevant. By way offurther answer, Defendant denies that the Plaintiffs claimed
predecessor in interest perfected a security interest on the Certificate of Title for Vehicle that
Plaintiff includes as Exhibit "B" of Plaintiffs Complaint.
10. Denied. Defendant avers that the approximate retail value of the Manufactured
Home substantially exceeds $19,000.00.
11. Admitted in part and denied in part. Defendant admits to having received a NOTICE
OF DEF AUL T AND RIGHT TO CURE DEF AUL T from Plaintiff. However, by way of further
answer, Defendant avers that he cured the default, in accordance with the terms of the NOTICE,
and continued with the contract, as though he did not default, in accordance with the terms of the
NOTICE. By way of further answer, Defendant, after reasonable investigation, is without
knowledge or information sufficient to form a belief as to whether he owed Plaintiff the amount
of $580.10 as of October, 10, 2005, and demands strict proof of same, if relevant.

12. Denied. As of October 10,2005, Plaintiff had not requested that Defendant
surrender possession of the Manufactured Home and Defendant justly retained possession.
Furthermore, as of October 10,2005, Plaintiff had not demanded acceleration of payment of the
unpaid balance on the Manufactured Home. To the contrary, on September 28, 2005, Plaintiff
issued Defendant a NOTICE OF DEF AUL T AND RIGHT TO CURE DEF AUL T, allowing
Defendant until October 28, 2005 to cure by paying a specified amount. A copy of said
NOTICE is attached hereto as Exhibit "A." By way of further answer, Defendant cured the
alleged default in accordance with the terms ofthe NOTICE on October 27,2005 and, as
provided for by the terms of the NOTICE, continued with the contract as though he did not
default.
13. Denied. Plaintiff has not demanded that Defendant surrender possession of the
Manufactured Home. By way of further answer, Defendant justly retains possession of the
Manufactured Home.
14. Admitted in part and denied in part. Defendant denies that Plaintiff issued the
Defendant a "Notice of Default;" however, Defendant admits that Plaintiff issued Defendant a
NOTICE OF DEFAULT AND RIGHT TO CURE DEFAULT. By way of further answer,
Defendant avers that he exercised his right to cure in accordance with the terms of said NOTICE
and specifically denies any explicit or implicit claim by Plaintiff that the NOTICE provides any
grounds for Plaintiff's Complaint in Replevin.
15. Denied. Plaintiff's averment is a conclusion oflaw to which no responsive pleading
is required under the Pennsylvania Rules of Civil Procedure, and the same is therefore denied. In
the event and to the extent that the Plaintiff's averment is not considered a conclusion oflaw,
Defendant specifically denies Plaintiff is entitled to possession of the Manufactured Home.

16. Denied. Plaintiffs averment is a conclusion oflaw to which no responsive pleading
is required under the Pennsylvania Rules of Civil Procedure and the same is therefore denied. In
the event and to the extent that the Plaintiffs averment is not considered a conclusion oflaw,
Defendant specifically denies Plaintiff is entitled to attorney fees.
WHEREFORE, Defendant respectfully requests this Honorable Court enter judgment in
Defendant's favor and dismiss Plaintiffs Complaint in Replevin.
NEW MATTER
17. Defendant incorporates herein by reference the averments contained in paragraphs I
tlrrough 16, inclusive, of Defendant's Answer to Plaintiffs Complaint in Replevin and New
Matter, as fully as though the same were set forth herein at length.
18. Defendant cured the NOTICE OF DEF AUL T AND RIGHT TO CURE DEF AUL T
attached as Exhibit "c" to Plaintiffs Complaint in Replevin by paying money owed in
accordance with the terms said NOTICE. Therefore, as of October 10,2005, Defendant was
continuing with the contract as provided for by the express terms of the NOTICE OF DEFAULT
AND RIGHT TO CURE DEF AUL T attached as Exhibit "c" to Plaintiffs Complaint in
Replevin.
19. On or about September 28, 2005, Plaintiff issued Defendant a second NOTICE OF
DEFAULT AND RIGHT TO CURE DEFAULT, a copy of which is attached hereto as Exhibit
'''A.''
20. Defendant exercised his right to cure the second NOTICE OF DEFAULT AND
RIGHT TO CURE DEFAULT, in accordance with the express terms of said NOTICE, on
October 27,2005.

21. Defendant has cured any and all defaults on the Manufactured Home Retail
Installment Contract and Security Agreement which are relevant to any security interest Plaintiff
may have, and Defendant is continuing with the contract as ifhe did not default, as the explicit
terms of the NOTICE OF DEF AUL T AND RIGHT TO CURE DEFAULT issued by the
Plaintiff so provides.
22. Defendant is not in default of the Manufactured Home Retail Installment Contract
and Security Agreement and continues to perform as required under the terms of such agreement.
23. Plaintiff fails to state a cause of action for replevin of the Manufactured home or the
value of such, nor for attorney fees or costs.
WHEREFORE, Defendant respectfully requests this Honorable Court enter judgment in
Defendant's favor and dismiss Plaintiff's Complaint in Replevin.
