LAST WILL AND TESTAMENT I, MARY ELIZABETH HOLMES, of the Borough of Carlisle, Cumberland County, Pennsylvania, being of sound and disposing mind and memory, do hereby make, publish and decl,re this to be my Last Will and Testament, hereby revoking any and all former Wills or Codicils by me made. 1. I direct that all my just debts, funeral and testamentary expenses, and all inheritance taxes shall be paid'from my residuary estate as soon as practicable after my decease and as part of the administration of my estate. 2. I give, devise and bequeath all of my estate~ both real and personal property, unto my husband, MARION D. HOLMES, absolutely. 3. In the event my said husband shall predeceas~ or fail to survive me, then I give, devise and bequeath all of my estate, in the following manner: (a) , . I I give and devise any real estate of which I may die seized to my daughter, MARGARET ANN KERR, absolut~ly. (c) All the rest, residue and remainder of mr estate, I give, devise and bequeath as follows: One-half thereof unto my daughter, MARGARET ANN KERR, absolutely and the remaining I one-half unto my grandchildren, DAVID ALAN KERR and ELIZABETH ANN KERR, or the survivor, in accordance with the terms hereof. In the event neither my husband nor my daughter shall survive me, then I give, devise and bequeath all of my estate, both real and personal property, after payment of the legacies to my nieces set forth in a preceding paragraph, ~to DAVID ALAN KERR and ELIZABETH ANN KERR, in accordance with the terms hereof, unless there should be other grandchildren born to my daughter in which event I direct that one-fourth of the residue , of my estate shall be held and given among such g~andchildren , and the remaining three-fourths of said estate shall be divided I equally between DAVID ALAN KERR and ELIZABETH ANN iKERR and held in accordance with the terms hereof. 5. LAW OFFICES MARTSON AND SNELBAKER I ~ec~ that my Trustee shall hold, invest and reinvest the same, collect the income arising therefrom,and after paying all expenses incident to the management of the trust, to use and apply as much of the income and principal as may be necessary, arising from the share or shares of any of my granidchildren, for the support, well-being and education of said gran~children. I direct that the income arising from said trust shall be payable in equal shares and directly to said grandchildren as they attain the age of eighteen (18) years. I direct that the' trust for my grandchildren shall be subject to the following provisions: (a) I direct that each of my said grandchildren shall have the right of withdrawal of the principal then remaining as each i i atUdns the age of twenty-five (25) years, with the!_xception of any grandchildren born to MARGARET ANN after the date of this Will, in which event they shall have the right of o/ithdrawal of principal of their share when each shall attain th~ age of twenty-one (21) years. ~~ ~<u-/ Mar E ~a et Ho mes PAGE TWO ~12;3 , .. ~ ., (b) Prior to the distribution of the principal as set forth herein, my said Trustee shall have the sole discretion I to invade the principal and may so invade the principal for the support, maintenance and education of any of my said children or issue of a deceased child, regardless ,of age. (c) To the extent that the same is permitted: by law, none of the beneficiaries hereunder shall have any power to dispose of or to charge by way of anticipation any interest given to such beneficiary; and all sums payable to such beneficiaries hereunder shall be free and clear of the debts, contracts, alienations and anticipations of the beneficiaries, and all liabilities for levies and attachments and proceedings of whatsoever kind, at law or in equity, and, in the case of a married woman, free from the control of her husband. 6. I hereby nominate, constitute and appoint MARION D. HOLMES as Executor of my estate. In the event he shall be unable or unwilling to serve in such capacity, then I appoint MARGARET ANN KERR to act in such capacity and in the event she sha 11 be unable or unwilling to act in such capacity, then I appoint William F. Martson, Carlisle, Pa. , to act in such capacity. 7. I hereby appoint MARGARET ANN KERR as Trustee under the terms of this Last Will and Testament and in the event she is unable or unwilling to serve in such capacity, then I appoint William F. Martson, Carlisle, Pa., to act in such capacity, giving him the power to renounce such right in favor of any bank with which I am doing any business at the time of my death to act in such capacity as successor trustee. 8.
