The Carlisle Area School District is hereby authorized and directed to pay the sum of $1,000.00 to Farmers Trust Company, Trustee of the Lamberton Trust for general school purposes. CIVIL, 1983 ORPHANS' COURT DIVISION PETITION FOR TERMINATION OF TRU$T AND SATISFACTION OF MORTGAGE TO THE HONORABLE, THE JUDGES OF SAID COURT: The Petition of Carlisle Area School District respectfully . represents: 1. That James Hamilton, by his Will dated November 20, 1871 and recorded in the Office of the Register of Wills of Cumberland County in Will Book "P", Page 154, directed, inter alia: "I give $1,000.00 to be invested in the name and with the approbation of the Orphans' Court of Cumberland County, the interest on which shall be annually received by the Board of School Directors of the Borough of Carlisle and expended by them each fall at the commencement of the session of the common Schools in the purchase of school books for such scholars as may need such and which they shall be the judges and such of the books as are not required two weeks after the opening of the session shall be forthwith placed in the several schools for the use of the scholars at the discretion of the teacher." 2. The Orphans' Court records indicate that at some time C. P. Humrich had been appointed as Trustee, for in the Orphans' Court of 1885, Orphans' Court Docket 25, page 358, C. P. At a regular meeting of the Carlisle Area School Board, held August 20, 1981, a Resolution was adopted directing the solicitor to prepare a Petition to the Orphans' Court to terminate the trust, to cause the mortgage to be marked satisfied and to authorize the payment of the principal amount of $1,000.00 to be paid to Farmers Trust Company as Trustee to be placed in the Lamberton Trust for general school purposes. A copy of the Resolution is attached as Exhibi t II A". WHEREFORE, your Petitioner requests your Honorable Court, pursuant to the authority contained in the Will of James Hamilton and pursuant to the general authority contained in 20 P.S. Sec. 6101, but without a hearing, as the parties are limited to the Petitioner and the Orphans' Court, to: (a) Terminate the James Hamilton Book Trust; (b) To direct the Recorder of Deeds to satisfy the mortgage Carlisle School District to the Trustee of the James Hamilton Book Trust recorded in Mortgage Book 201 at Page 172; (c) To authorize and direct the payment by Carlisle Area School District of the sum of $1,000.00 to Farmers Trust Company, Trustee of the Lamberton Trust for general school purposes. Suter that the fOllowing resolution be approved regarding the deed transfer of the Lamberton Junior High School: t~lereas, a mortgage of the School District to the Trustee of the Hamilton Book Fund in the amount of $1,000 dated 1942, and remains unsatisfied on the record, and '.:.- Whereas, the Trustee of the Trust Fund, Archibald Long, appears to have died many years ago, and Nhereas~ the purpose of the Trust Fund created by the will of James Hamilton in 1813 appears no longer to exist, and Whereas, the School District has no records of the payment or non-payment of the mortgage but is willing to set aside the sum of $1:000 to be placed in trust as a part of the Lamberton Trust for general school purposes~ Now, Therefore, the Solicitor is directed to prepare and the President is authorized to execute a Petition to the Orphans' Court to terminate the trust, to cause the mortgage to be satisfied and to authorize payment of the sum of 51,000 to the Farmers Trust Company as Trustee to be placed in the Lamberton Trust for general school purposes. ~.rotion carried.
