AND NOW, this 31 st day of October, 2005, upon consideration of the Motion To
Invade Principal filed by IKOR, Inc., guardian of the estate of William Jumper, and
following a telephone conference with the guardian's counsel, Michael Volk, Esq., and
James D. Flower, Jr., Esq., court-appointed counsel for the incapacitated person, William
Jumper, in which the court indicated its view that responsibility for payment of the
reasonable expenses of the incapacitated person is that of the guardian in the first instance
and that the court was not in a position to hold a hearing on short notice on the
reasonableness of the various expenses enumerated in the motion, but that the legal fees
of Attorney Flower in connection with his court appointment should be submitted in the
form of an invoice to the Court Administrator, and counsel for the moving party having
indicated that he would recommend the guardian's immediate payment of the remaining
expenses from the incapacitated person's estate because of the exigencies of his situation,
the motion is deemed moot.
