WAIVER OF LIENS
WHEREAS, Mumma Construction, 1316 Honeysuckle Hollow Road, Elliotsburg, PA 17024
entered into a contract with Debra K. Smith, 403 Pine Grove Road, Gardners, PA 17324 to provided
materials and perform labor necessary for new construction upon a lot of ground located at 403 Pine Grove
Road, Dickinson Township, Cumberland County, Pennsylvania, at County Parcel Number 08-39-2223-004..
See legal description attached hereto as Exhibit" A"
NOW WHEREAS, it is hereby stipulated and agreed by and between the said parties, as part of the said
contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or
material man, nor any other person furnishing labor or materials to the said contractor under this contract shall
file a lien, commonly called a mechanic's lien, for work done or materials furnished to the said buildings or any
part thereof.
This stipulation is made and intended to be filed with the County Prothonotary, Office of Judicial
Support or County Clerk within ten days after the date in accordance with the requirements of Act of Assembly
of Pennsylvania, in such case provided.
IN WITNESS WHEREOF, the said parties have set their hands and seals this 20th day of October,
2005.

BEING PARCEL NUMBER 08-39-2223-004.
ALL THAT CERTAIN tract of land with improvements thereon erected, situate in Dickinson Township,
Cumberland County, Pennsylvania being known as Lot No. 32 of a Final Subdivision Plan for Dickinson
Township recorded in Cumberland County Plan Book 45, page 32, more particularly bounded and
described as follows:
BEGINNING at a point in the middle of a public right of way known as L.R. 21005 at the corner of Lot
No. 33; thence along Lot No. 33, North 27 degrees 32 minutes 30 seconds West a distance of 445.56 feet to
a point; thence South 71 degrees 19 minutes 47 seconds West, a distance of 185.56 feet to a point; thence
along Lot No. 31 South 25 degrees 30 minutes 50 seconds East, a distance of 467.64 feet to a point in the
middle of the aforesaid public right of way (L.R. 21005); thence along said road (L.R. 21005) North 64
degrees 29 minutes 10 seconds East, a distance of 193.98 feet to a point; thence North 64 degrees 29
minutes 10 seconds East 6.62 feet to the place of BEGINNING.
BEING the same premises which Donald E. Latshaw and Trudy A. Latshaw, husband and wife by Deed
bearing date February 14, 2000 and recorded in the Office of the Recorder of Deeds in and for the
County of Cumberland, State of Pennsylvania in Deed Book 216 page 338 granted and conveyed unto
Debra K. Smith, in fee.
