STIPULATION AGAIJ~S
THIS AGREEMENT made thiS''3j c;!f;day of October, 2004, by and
between Neidlinger Construction, a sole proprietor, hereinafter
referred to as Contractor,
AND
Michael T. Neidlinger, hereinafter referred to as Owner, whereby
the contractor undertook and agreed to erected and construct a
dwelling on the certain lot of ground situate in Upper Frankford
Township, Cumberland County, Commonwealth of Pennsylvania, and more
fully described in Exhibit "A" which is attached hereto and made a
part hereof known as Lot 16 Grahams Woods Road, Carlisle, PA
17013.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic'S liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic'S liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL THAT CERTAIN lot of ground situate in Upper Frankford Township, bounded and
described in accordance with the Final Subdivision Plan for Russell R. Wilson, II dated
January 20, 1997, prepared by Eric L. Diffenbaugh, Professional Land Surveyor, and
recorded in the hereinafter mentioned Recorder's Office in Plan Book 71, Page 111 as
follows:
BEGINNING at a point on the eastern right of way line of Township Road T-448, known as
Grahams Woods Road, said right of way line being 25 feet from the centerline ofthe road at
the corner of lands now or formerly of Kipp E. Zahlere; thence along the eastern right of
way line of Township Road T-448 known as Grahams Woods Road, North 03 degrees 26
minutes 46 seconds West a distance of 60.04 feet to a point in the line of lands now or
formerly of Sharrell M. Coalson; thence along said lands now or formerly of Sharrell M.
Coalson, and continuing along the dividing line between Lots Nos. 1 and 16, North 88
degrees 37 minutes 45 seconds East a distance of 653.72 feet to an iron pin set in the
dividing line between Lots Nos. 1 and 16; thence continning along the dividing line between
Lots Nos. 1 and 16, North 83 degrees 40 minutes 02 seconds East a distance of 187.23 feet to
an iron pin set in the dividing line between Lots Nos. 14 and 16; thence along the dividing
line between Lots Nos. 14 and 16 and continuing along the dividing line between Lots Nos.
15 and 16, South 08 degrees 51 minutes 14 seconds West a distance of 735.93 feet to an iron
pin set in the dividing line between Lots Nos. 16 and 17; thence along the dividing line
between Lots Nos. 16 and 17, North 62 degrees 58 minutes 05 seconds West a distance of
318.33 feet to an existing iron pin in line of lands now or formerly of Russell R. Wilson, II;
thence along said lands now or formerly of Russell R. Wilson, II, North 17 degrees 16
minutes 50 seconds East a distance of 230 feet to an existing iron pin in line of lands now or
formerly of Kipp E. Zahler; thence along said lands now or formerly of Kipp E. Zahler,
North 01 degrees 22 minutes 15 seconds West a distance of 320.00 feet to an existing iron
pin; thence by same, South 88 degrees 37 minutes 45 seconds West a distance of 500.00 feet
to an iron pin set in the eastern right of way line of Township Road T -448, known as
Grahams Woods Road, the place of BEGINNING.
BEING all of Lot No. 16 as shown on the Final Subdivision Plan for Russell R. Wilson, II
recorded in the hereinafter mentioned Recorder's Office in Plan Book 71, Page 111.
