COMPLAINT: The grievant states that he was not warned of an alleged Hepatitis C
epidemic and is requesting $25,000.00 for each year he was not informed.
FINDING OF FACT:
1. Hepatitis C is contracted through poor life style choices. There is no epidemic of
Hepatitis C.
2. Your request for monetary awards is denied.
Conclusion: This is a frivolous grievance with no merit.

grievance.
In accordance with the provisions of DC-ADM 804, effective May 1, 2002, 1 have
reviewed the entire record of this grievance; including your initial grievance, the grievance
officer's response, your appeal from initial review and the superintendent's response. I have
also carefully reviewed the issues you raise to final review.
Upon completion of this review, it is the decision of this office to uphold the responses
provided by staff at the institutional level. Contrary to your claim, there isn't a Hepatitis C
epidemic within the DOC, therefore, there is no need to notify you. Your request for $25,000 is
denied.
The responses provided at the institutional level are appropriate and in accordance with
Department of Corrections policies and procedures. Accordingly, your appeal to final review
must be denied.

Dear Mr. Pew:
Your affidavit dated July 1, 2004 states your concerns about your exposure to "an insidious
virus, Hepatitis C and other diseases in the Pennsylvania Department of Corrections." You
state that "nobody at SCI-Pittsburgh notified you or your family of these diseases."
The Bureau of Health Care Services is responding to your concerns on behalf of Governor
Rendell.
While at SCI-Pittsburgh, hepatitis was discussed with you, specifically hepatitis carriage and
transmission. Hepatitis A may be carried in food or contaminated water; hepatitis B and
hepatitis C are carried in blood and spread by direct contact of your blood with the blood of
a person who has hepatitis B or hepatitis C virus in their blood, for example by sharing
needles, razors, or tattoo equipment. In April 2003 you refused both hepatitis A and B
vaccines, after education was done with you by SCI-Pittsburgh's staff. These vaccines
remain available to you. There is no vaccine for hepatitis C.
Currently, you are housed at SCI-Fayette. The medical staff, Infection Control Nurse (ICN)
and the Corrections Health Care Administrator (CHCA) are available to answer any
questions that you may have concerning medical issues or infectious diseases.
