DECLARATION OF TAKING
The Borough of Shippensburg, Cumberland and Franklin Counties, Pennsylvania, does hereby
respectfully declare that:
1, The Condemnor is the Borough of Shippensburg, with offices located at 111 North Fayette
Street, Shippensburg, Cumberland and Franklin Counties, Pennsylvania.
2, The property described in Exhibit "A" attached hereto and made part hereof are hereby
condemned for temporary and permanent easements, rights-of-way, and for the construction
and/or alteration and maintenance of a pedestrian bridge pursuant to 53 P.S. S 46501 as
amended and as authorized by an ordinance adopted
by said
Condemnor. A copy of said ordinance is attached hereto and made part hereof as Exhibit
"B". The original thereof may be examined at the office of the Borough at 111 North Fayette
Street, Shippensburg, Cumberland and Franklin Counties, Pennsylvania,
3. The purpose of the condemnation is to construct a pedestrian bridge along State Route 3001,
section ENH R1W by owning, altering and/or constructing and maintaining a pedestrian
bridge along said road for the safety and benefit of the residents of the Borough of
Shippensburg, Cumberland and Franklin Counties, Pennsylvania.
4. A description of the property condemned sufficient for its identification is set forth in Exhibit
"A" attached hereto and made a part hereof. Plans showing the property condemned are also
being filed on the same day as this Declaration is filed in the Office of the Recorder of Deeds
of Cumberland County in accordance with Section 1-404 of the Eminent Domain Code, 26
P.S. 1-404 and are available therein for inspection,
5. The nature of the interests in and to said property listed in Exhibit "A" is for temporary or
permanent easements and rights-of-way as shown on the planldrawinglmap/plat attached
hereto in Exhibit "C". The extent and dimensions of the temporary or permanent easement is
as set forth in the line table set forth in each plat The graphic depiction is for illustration
purposes and is not controlling,
6. A plan showing the condemned property may be inspected at the office of the Borough at
111 North Fayette Street, Shippensburg, Cumberland and Franklin Counties, Pennsylvania.
7. The just compensation for the taking, when determined, shall be paid out of the general funds
of the Borough of Shippensburg and secured by its statutory power of taxation and no other
security is required in accordance with Section 403(b) of the Eminent Domain Code, 26 P.S.
1-403(b ).

Cumberland County, Commonwealth of Pennsylvania, and being more particularly
bound and described as follows:
BEGINNING at a point on the northerly legal right-of-way line for S.R. 3001, said point
being 16.50 feet right of and perpendicular to Survey and RlW Baseline Station 435+98;
thence in a northeasterly direction to a point, said point being 23.00 feet right of and
perpendicular to Survey and RlW Baseline Station 435+98; thence in a southeasterly

RATIFYING TIm AUmORIZATION OF A PROJECT TO CONS1RUCT
A PEDESTRIAN BRIDGE THROUGH CONSTRUCTION AND/OR.
ALTERATION ALONG STATE ROUTE 3001, SECTION ENE RJW
AND AUTHORIZING TIm EXERCISE OF EMINE1!T DOMAIN
AS MAY BE NECESSARY TO IMPLEMENT THE PROJECT,
PURSUANTTD THE AUmORITY.PROVIDED IN TIIE

BE IT ENActED AND ORDAINED by the Council of the Borough of Shippensburg
and it is enacted and ordained as follows:
L Borough of Shippensburg (hereinafter "the Borough") authorizes the under.
taking of the project (hereinafter "the Project'') to construct a pedestrian
bridge along State Route 3001, Section ENH R/W.
2. In order to enable the Borough to undertake the Project, COUllSel, Melissa K.
Dively, Esquire, is authorized and directed to :file, as may be necessary, a
Declaration of Taking ofpe:onanent and temporary construction easements
and right-of-way in accordance with certain Plans presented to the Borough
by its Engineer and on:file with the Secretary of the Borough (hereinafter the
"Plans") affecting the properties set forth on Exhibit "A" attached hereto and
incorporated herein by reference, in accordance with the provisions of
applicable laws and to take such additional steps as may be necessary to
enable the Borough to acquire such easements and right-of-way necessary for
the Project in accordance with the Plans,
3. The proper officers of the Borough are authorized and directed to execute, . <.'
attest, acknowledge, and deliver such instruments and documents as may be
necessary to effect the taking of the foregoing easements and rights-of-way
and to determine upon consultation with its Counsel, Melissa K. Dively,
Esquite and 'sllch other advisors as may be deemed necessary, the
consideration to be paid and the time and mauner of such payments to
compensate the owner of said property in accordance with the requirements of
law, including the Pennsylvania Eminent Domain Code, and, if possible, to
enter into one or raore agreements with such owners for delivery of such
easements and rights-of-way.
4. The proper officials of the Borough are a:uthorized and directed to execute and
deliver such other documents and instruments and to take such other actions
as they, in their discretion and upon the advice of their Counsel, Melissa K.

the intent of t1rls ordinance, including but not limited to acceptance of

relating to acquisition and construction of the Project.
5. Title to be acquired for the property listed in Exhibit A shall be as perpetual
right-of-way or permanent easement and/or temporary construction
easements, as provided in the Plans.
6. The'provisions of this ordinance shall be severable, and if any ofits provisions
shall be held to be unconstitutional, illegal, or invalid, such ,
unconstitutionality, illegality. or invalidity shall not affect the validity of any
of the remaining provisiollS of this ordinance.
7. This ordiJ:lance shall be eff",ctive immediately upon adoption.
8. All oth",r ordinanc", or pacts of ordinances inconsistent herewith be and the
same are h"'reby r<'P<'8led.

PETITION TO DEPOSIT ESTIMATED JUST COMPENSATION
TO THE HONORABLE, THE JUDGES OF THE SAID COURT:
I, The Condemnor is the Borough of Shippensburg, with offices located at III
North Fayette Street, Shippensburg, Cumberland and Franklin Counties,
Pennsylvania.
2, On November 4,2005, a Declaration of Taking was filed to the above-captioned
term and number by the Condemnor.
3. After extensive legal and engineering revIew of title records and applicable
recorded plans the Condemnor was unable to definitively identify the owner of
the parcel affected by the within acquisition.
4, The Declaration of Taking effected a condemnation on property with an unknown
owner or owners, "Condemnee" herein, located in the Borough of Shippensburg
along State Route 3001.
5. On November 7, 2005, in lieu of personal servIce or service by mail, and
consistent with the requirements of Section 1-405 of the Eminent Domain Code,
26 P.S Section 1-405, Condemnor posted said property with notice of the filing of
the Declaration of Taking. An affidavit attesting to the posting of said notice is
attached hereto and made part hereof as Exhibit "A"
6. On November 12,2005, consistent with the requirements of Section 1-405 of the
Eminent Domain Code, notice of the filing of the Declaration of Taking was
published in The Sentinel, a newspaper of general circulation in the Borough of
Shippensburg, Cwnberland and Franklin Counties, Pennsylvania. A copy of said
notice is attached hereto and made part hereof as Exhibit "B",
7. On November 18,2005, consistent with the requirements of Section 1-405 of the
Eminent Domain Code, notice of the filing of the Declaration of Taking was
published in the Cumberland Law Journal, the official legal publication for
Cumberland County. A copy of the proof of publication is attached hereto and
made a part hereof as Exhibit "C".
8, Section 1-406 of the Eminent Domain Code 26 P.S Section 1-406 provides a
Condemnee thirty (30) days from date of service for filing preliminary objections,
9. No response has been filed in court in the nature of preliminary objections
pursuant to the Pennsylvania Eminent Domain Code within thirty days of the first
notice. The petitioner avers and believes that further notice to unknown owners is
possibly not necessary or reasonable.
10. Section 1-407 of the Pennsylvania Eminent Domain Code, 26 P.S Section 1-407,
provides that possession of the property acquired through condemnation is
achievcd upon the Condemnor's offer of the estimate of just compensation to the
Condemnee after the time for filing preliminary objections has passed.
II. The Condemnor has been unable to offer and make payment of its estimated just
compensation to Condemnee because the Condemnee is unknown.
12, A schedule of distribution of the the estimate of just compensation due the
Condemnee, as estimated by the Borough of Shippensburg through an
independent experts appraisal on the subject property for the right-of
way/easement taken thereon, in the amount of six hundred and fifty dollars and no
cents ($650.00) is attached hereto as Exhibit "D",
13. Section 1-522 of the Eminent Domain Code, 26 P.s. Section 1-522 provides that
where a party entitled to payment of the estimated just compensation cannot be
found, a condemnor may petition the Court for leave to pay the estimated just
compensation and costs into court.
14. Section 1-522 of the Eminent Domain Code, 26 P.s. Section 1-52, further
provides that twenty days notice of the presentation of this petition is mandatory
only to and when parties in interest are known to the condemnor.
15, Condemnor avers that notice of the presentation of this petition is not possible nor
reasonable or necessary under the terms of the Eminent Domain Code.
WHEREFORE, the Borough of Shippensburg, Condemnor herein, prays this Court to
grant the relief of an Order directing the Condemnor to pay into the Court, at the
above-referenced number and term, a payment of Six Hundred and Fifty Dollars and
no cents ($650,00) and to receive thereby possession of the condemned property in
accordance with the provisions and procedures set forth in Sections 1-407 and 1-522
of the Eminent Domain Code.

authority for action of condemnation is found in 53 P.S ~46501 of the Pennsylvania
Borough Code as amended and was duly authorized by ordinance, duly advertised
a~d.thereafter enacted by the Borough of Shippensburg on October 4,2005, the
ongrrlal th~reof maybe examined at tM office of the Borough, 111 North Fayette
