PETITION FOR SETTLEMENT OF A SMALL ESTATE
TO THE HONORABLE THE JUDGES OF SAID COURT:
This petition is filed by Mark Laurence Winters pursuant to
The Decedents Estate and Fiduciaries Code of 1972, P.L. 508 Act No. 164
(20 P.S. 03102) and Rule 71.2 of the local rules of Cumberland County,
which provide for the settlement of a small estate by petition.
1. Inez Annie Winters, a widow, late of 5100 East Trindle
Road, Mechanicsburg, Pennsylvania, died on the 20th day of August, 1978.
2. Whereby, Mark Laurence Winters, 5100 East Trindle Road,
Mechanicsburg, Pennsylvania, son of the decedent, who was living
with her at the time of her death, petitions this court to settle her
estate.
3. Decedent died testate. Letters testamentary were issued
by the Register of Wills of Cumberland County, Commonwealth of Pennsylvania
on September 13, 1978 to Mark Laurence Winters at No. 21-78-487. No
bond was required.
4. The following persons are entitled under the will to share
in the decedent's estate in the following manner:
Joan F. Winters Aunchman, daughter--set of china and china
cupboard, camera equipment, jewelry, sewing machine, clothing.
Mark Laurence Winters, son--automobile, beneficial use of
mobile home and furniture, 50% of any remainder of the estate.

David Charles Winters, son--a few items (unspecified) of the
personal effects of the deceased, not otherwise distributed, plus 25%
of any remainder.
James Clarence Winters, son--a few items (unspecified) of the
personal effects of the deceased not otherwise distributed plus 25% of
any remainder of the estate.
Grandchildren--each to receive one small item (unspecified) of
decedent's personal effects, to be chosen by them.
5. Mark Laurence Winters is entitled to the family exemption
of $2,000 as allowable under the Decedents Estates and Fiduciaries Code
of 1972 as amended Act No. 130 of 1974 (20 P.s. ~3121) because he was
living with the deceased at the time of her death and is her son. He
desires to take the exemption in kind, namely in the form of the mobile
home.
6. The assets of the deceased and their appraised value at
the time of death were as follows:

PRAYER FOR DISTRIBUTION
Whereby, Mark Laurence Winters petitions this court to distribute the
estate of Inez Annie Winters as follows:
1. The family exemption of two thousand dollars ($2,000.00),
administrative expense of three hundred thirty four dollars ($334.00) and
executor's fee of one hundred sixty five dollars and thirty eight cents
($165.38) (5% of the assets of the estate), totaling two thousand four
hundred ninety nine dollars and thirty eight cents ($2,499.38), shall be
awarded in kind, to Mark Laurence Winters, son of the deceased, in the form
of the mobile home valued at two thousand five hundred dollars ($2,500.00).
2. Mark Laurence Winters is to purchase out of the estate items of
personal property totaling six hundred ninety four dollars and Zero cents
($694.00) and an automobile valued at one hundred dollars ($100.00).
3. As a result of Mark Laurence Winters purchasing the aforesaid
property out of the estate, the estate will be left with assets as follows:

resided at 5100 E. Trindle Road, Mechanicsburg, Cumberland County,
Pennsylvania 17055, died on August 20, 1978. Letters testamentary
were issued by the Cumberland County Register of Wills on September 13,
1978, Will Admn. No. 21-78-487 to Mark La~r.ence Winters.
The attached petition will be presented before the Orphans'
Court, Ninth Judicial District, at the Cumberland County Courthouse,
Carlisle, Pennsylvania, on April 17, 1979, 9:30 a.m. in Courtroom 1,
