STIPULATION AGAINST LIENS
WHEREAS, David 1. Hummel and Mary C. Ballantine, of Pennsylvania, is about
to execute contemporaneously herewith, a contract with Michael Manning & Associates, a
Pennsylvania General Partnership of Cumberland County, Pennsylvania, for the erection of a
dwelling upon a lot ofland situate as follows:
ALL THAT CERTAIN piece or parcel ofland situate in the Township of East
Pennsboro, Cumberland County, Commonwealth of Pennsylvania, being more fully described as
follows:
BEGINNING at a point, said point being located on the legal right-of-way line of
Acri Road at the dividing line of Lot No. 90 and Lot No. 91; thence by the same North 05 degrees
07 minutes 41 seconds West, a distance of 101.73 feet to a point on the legal right-of-way line of
Acri Road at the dividing line of Lot No. 92 and Lot No. 91; thence by the same North 84 degrees
52 minutes 19 seconds East, a distance of 128.02 feet to a point on the dividing line of lands now
or formerly of William E. Evans, Sr. and Beatrice J. Evans and Lot No. 91; thence by the same the
following two (2) courses and distances: I) South 12 degrees 42 minutes 18 seconds East, a distance
of 42.67 feet to a point; 2) North 71 degrees 28 minutes 42 seconds East, a distance of 45.69 feet
to a point on the dividing line of lands now or formerly of Joseph Lewis and Lot No. 91; thence by
the same South 12 degrees 42 minutes 18 seconds East, a distance of 70.64 feet to a point on the
dividing line of Lot No. 90 and Lot No. 91; thence by the same South 84 degrees 52 minutes 19
seconds West, a distance of 187.41 feet to a point on the legal right-of-way line of Acri Road, the
Place of BEGINNING.
BEING Lot No. 91 on a Final Subdivision Plan of Hickory Ridge, Phase III _
Revised, recorded in Plan Book 88, Page 88 and being subject to all easements of record.
CONTAINING 16,680.7 square feet.
NOW, the ,l :1:ay of October, 2005, atthe time of and immediately before the
execution of the principal contract, and before any authority has been given by the said David L.
Hummel and Mary C. Ballantine to the said Michael Manning & Associates, a Pennsylvania General
Partnership to commence work on the said building, or purchase materials for the same in
consideration of the making of the said contract with Michael Manning & Associates, a Pennsy lvania
General Partnership and the further consideration of One Dollar, to Michael Manning & Associates,
a Pennsylvania General Partnership paid by David L. Hummel and Mary C. Ballantine it is agreed
that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of
the material men or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection of said building, the right to file such liens being
expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
