MITCHELL, DECEASED ) No. PETITION FOR DISTRIBUTION UNDER SECTION 3102 OF THE PROBATE, ESTATES AND FIDUCIARIES CODE TO THE HONORABLE DALE F. SHUGHART, PRESIDENT JUDGE OF SAID COURT: The Petition of Ronald D. Butler respectfully represents that: 1. James R. Mitchell died on June 3, 1980, a resident of Camp Hill, Cumberland County, Pennsylvania. 2. Petitioner, with offices at 300 North Second Street, Box 430, Harrisburg, Dauphin County, Pennsylvania, is the attorney for Neill Funeral Home, Inc., the most significant creditor of decedent's estate. 3. Decedent died intestate. 4. Decedent was unmarried and had no children. 5. There is no person who is entitled to the family exemption. 6. Robert H. Trimble, Administrator, Commonwealth of Pennsylvania, Bureau of Administrative Services, Escheats Section, has been advised in writing that the estate is solvent and a small sum will escheat to the Commonwealth of Pennsylvania. 7. Mr. Trimble has informed petitioner by telephone that it was no longer the practice of the Commonwealth of Pennsylvania to formally renounce its right to Letters of Administration, but he indicated that the Commonwealth had BOOK 107 f MGt '.1.4 -1- no objection to the appointment of the petitioner being the attorney for the main creditor of the estate for the purposes of proceeding under Section 3102 of the Probate, Estates and Fiduciaries Code. 8. An itemized statement of the property of the decedent is as follows: Account at Guardian Office at Harrisburg State Hospital Social Security death benefit $ 2,937.17 255.00 TOTAL $ 3,192.17 9. No disbursements have been made prior to the filing of this Petition. 10. The names of all unpaid claimants from whom petitioner has notice or knowledge is as follows: Neill Funeral Home, Inc. - funeral bill $ Cheryl L. Smith - Notary fee Register of Wills - Filing fee Butler and Cohen - Legal fee Commonwealth of Pennsylvania - care and maintenance charges 1,784.00 1.00 4.00 300.00 768.56 TOTAL $ 2,857.56 The above claims are admitted. 11. An inheritance tax return is not being filed since the estate is escheatable and no inheritance tax would be due in any event. 12. Proper notice of the presentation of this Petition has been given to each person so entitled including the Attorney General.
