management and time standards adopted for expedited
track cases shall be applicable to this case and are
hereby incorporated into this Order. 2. All discovery
on the above matter shall be completed not later than
06-MAR-2006. 3. Plaintiff shall identify and submit
curriculum vitae and expert reports of all expert
witnesses intended to testify at trial to all other
parties not later than 06-MAR-2006. 4. Defendant
and any additional defendants shall identify and
submit curriculum vitae and expert reports of all
expert witnesses intended to testify at trial not
later than 03-APR-2006. 5. All pre-trial motions
shall be filed not later than 03-APR-2006. 6. A
settlement conference may be scheduled at any time
after 03-APR-2006. Prior to the settlement conference
all counsel shall serve all opposing counsel and file
a settlement memorandum containing the following: (a)
A concise summary of the nature of the case if
plaintlff or of the defense if defendant or additional
defendant; (bl A statement by the plaintiff or all
damages accumulated, including an itemization of
injuries and all special damages claimed by categories
and amount; (cl Defendant shall ldentify all
applicable insurance carriers, together with
applicable limits of liability. 7. A pre-trial
conference will be scheduled any time after
OS~JUN-2006. Fifteen days prior to pre-trial
conference, all counsel shall serve all opposing
counsel and file a pre-trial memorandum containing the
following: (a) A concise summary of the nature of the
case if plaintiff or the defense if defendant or
additional defendant; (b) A list of all witnesses who
may be called to testify at trial by name and address.
Counsel should expect witnesses not listed to be
precluded from testifying at trial; (c) A list of all
exhibits the party intends to offer into evidence.
All exhibits shall be pre-numbered and shall be
exchanged among counsel prior to the conference,

FACTS APPLICABLE TO ALL COUNTS
1. Plaintiff, Mark Oesterich, is an adult individual who currently resides at 199
West Vine Street, Selinsgrove, Snyder County, Pennsylvania 17870.
2. Defendant, Valenti Mid-Atlantic Realty, LLC, (hereinafter "Valenti Realty"),
is a Florida corporation with its principal place of business at 3450 Buschwood Park
Drive, Unit 195, Tampa, Florida 33618, and it owns the real property located at 331
South Hanover Street, Carlisle, Pennsylvania 17103.
3. Defendant, Wendy's International, Inc. Ud/b/a Wendy's Old Fashioned
Hamburgers, (hereinafter "Wendy's"), is an Ohio corporation with its principal place of
business 4288 W. Dublin-Granville Road, Dublin, Ohio 43017.
4. Defendant, Wendy's, advertises, sells products and does business in
Philadelphia County.
5. Defendant, Wendy's, has 14 restaurants listed in the Philadelphia
Pennsylvania Yellow Pages, all of which are located in Philadelphia County.
6. Defendant, Valenti Mid-Atlantic Management, Inc. Ud/b/a Wendy's Old
Fashioned Hamburgers, (hereinafter "Valenti Management"), is a Florida corporation
with its principal place of business at 3450 Buschwood Park Drive, Unit 195, Tampa,
Florida 33618, and it owns and operates a local business at 331 South Hanover Street,
Carlisle, Pennsylvania 17103.
7. The facts and circumstances hereinafter set forth took place on November

5,2003 at the Wendy's Old Fashioned Hamburgers located at 331 South Hanover
Street, Carlisle, Pennsylvania 17103.
8. At the aforesaid time and place, Plaintiff, while working in the course and
scope of his employment for Filter Tech, Inc., was at the Wendy's Old Fashioned
Hamburgers located at 331 South Hanover Street, Carlisle, Pennsylvania 17103 to
replace the filters on the heating and air conditioning unit which was located on the
building's rooftop.
9. At the aforesaid time and place, Plaintiff ascended a metal ladder which
was affixed to the building.
10. At the aforesaid time and place, the metal ladder broke loose from the
building, causing Plaintiff to fall.
11. As a result of the aforesaid fall, Plaintiff, Mark Oestereich, has suffered
serious and permanent injuries, including but not limited to the following:
a. Closed head injury;
b. Bilateral distal tibia fractures;
c. Cartilage damage to the left ankle; and
d. Mental and physical anguish.
12. As a direct and proximate result of the aforesaid injuries, Plaintiff, Mark
Oestereich, has undergone and in the future will undergo great pain and suffering for
which damages are claimed.
13. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
suffered and may continue to suffer a loss of earnings for which damages are claimed.

14. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
and/or may in the future incur expenses for medical treatment and rehabilitation for
which damages are claimed.
15. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
and/or may in the future incur a loss of earning capacity for which damages are claimed.
16. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
sustained scarring and disfigurement for which damages are claimed.
17. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
sustained a permanent diminution in his ability to enjoy life and life's pleasures for which
damages are claimed.
18. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
incurred or may hereinafter incur financial expenses and losses for which damages are
claimed.
19. Plaintiff believes and therefore avers that 42 Pa. C.SA Section 7102 (b.1)
subtitled "Recovery against joint defendant; contribution" is unconstitutional and
therefore unenforceable in this action because it was passed in violation of Article III,
Sections 1, 2, 3, and 4 of the Pennsylvania Constitution and in violation of the "single
subject rule" and is a law that was passed as part of another bill in a manner consistent
with the prohibited concept of "legislative logrolling". See also DeWeese v. Weaver,
824 A.2d 364 (Pa Cmwlth 2003)

20. Paragraphs 1 through 19 of Plaintiff's Complaint are incorporated herein
by reference and made a part hereof as if set forth in full.
21. The aforesaid incident and resulting injuries were a direct and proximate
result of the negligence, carelessness and recklessness of the Defendant, Valenti
Realty, which consisted of:
a. Permitting a dangerous condition to exist in the nature of a ladder
that was not adequately affixed to the building;
b. Failing to properly install the ladder to ensure the safety of those
persons utilizing it in a reasonable, adequate and prudent manner;
c. Failing to properly inspect the ladder to ensure the safety of those
persons utilizing it in a reasonable, adequate and prudent manner;
d. Failing to issue adequate warnings, verbal, written, actual and/or
constructive, to persons who would likely encounter the dangerous
condition;
e. Allowing the Plaintiff and others to utilize the ladder in question
when the Defendant knew or should have known of the dangerous
condition of the ladder;
f. Failing to utilize reasonable care in the inspection, maintenance
and/or repair of the ladder in question;
g. Failing to request, institute and/or supervise periodic inspection of
the ladder in question; and
h. Violating various ordinances, regulations, codes, rules, statutes

22. The aforesaid incident was caused by the wrongful and liability producing
conduct of the Defendant, Valenti Realty, as set forth above and is due in no matter
whatsoever by any act or failure to act on part of the Plaintiff, Mark Oestereich.
WHEREFORE, Plaintiff Mark Oestereich demands judgment against Valenti Mid-
Atlantic Realty, LLC, Valenti Mid-Atlantic Management, Inc. tld/b/a Wendy's Old
Fashioned Hamburgers, and Wendy's International, Inc. tld/b/a Wendy's Old Fashioned
Hamburgers, jointly and severally, for compensatory damages in an amount in excess
of the amount requiring compulsory arbitration.
COUNT III

23. Paragraphs 1 through 22 of Plaintiff's Complaint are incorporated herein

24. The aforesaid incident and resulting injuries were a direct and proximate
result of the negligence, carelessness and recklessness of the Defendant, Wendy's,
which consisted of:

25. The aforesaid incident was caused by the wrongful and liability producing
conduct of the Defendant, Wendy's, as set forth above and is due in no matter
whatsoever by any act or failure to act on part of the Plaintiff, Mark Oestereich.
WHEREFORE, Plaintiff Mark Oestereich demands judgment against Wendy's
International, Inc. Ud/b/a Wendy's Old Fashioned Hamburgers, Valenti Mid-Atlantic
Realty, LLC, and Valenti Mid-Atlantic Management, Inc. Ud/b/a Wendy's Old Fashioned

Atlantic Management, Inc. t/d/b/a Wendy's Old Fashioned Hamburgers, Wendy's

TO TRANSFER VENUE PURSUANT TO Pa, RC.P. 1006(d)(1)
AND NOW, come the defendants, Valenti Mid-Atlantic Realty. LLC. and Valenti Mid-Atlantic
Management, Inc., tldlbla Wendy's Old Fashioned Hamburgers, by and through their counsel. NA ULTY,
SCARICAMAZZA & McDEVITT, LLC, before this Honorable Court to present their Motion to Transfer
Venue based on Forum Non Conveniens and, in support thereof, aver as follows:
I. Plaintiff, Mark Oestereich, has filed the instant lawsuit on June 6, 2005, alleging that he sustained
personal injuries due to the negligence of the defendants on or about November 5, 2003.
2. Plaintiff, Mark Oestereich, filed his Complaint on or about August 15,2005. A true and correct
copy of Plaintiff's Complaint is attached hereto. made a part hereof, and marked as Exhibit "A. "

3. Plaintiff, Mark Oestereich, alleges in his Complaint that he resides at 199 West Vine Street,
Selinsgrove, Snyder County, Pennsylvania.
4. Defendants, Valenti Mid-Atlantic Realty, LLC, and Valenti Mid-Atlantic Management, Inc., are
a Florida corporation with business addresses at 3450 Buschwood Park Drive, Unit 195, Tampa,
Florida and 1770 Moriah Woods Boulevard, #10, Memphis, Tennessee.
5. Defendant, Wendy's International, Inc., is a franchiser, which is a foreign corporation with a
principal place of business at 4288 West Dublin-Granville Road, Dublin, Ohio.
6. Defendants, Valenti Mid-Atlantic Realty, LLC, and Valenti Mid-Atlantic Management, Inc., own
and operate a restaurant at 331 South Hanover Street, Carlisle, Cumberland County, Pennsylvania,
17103.
7. Plaintiff alleges in his Complaint that on November 5, 2003, he sustained injuries while working
at moving defendants' restaurant at 331 South Hanover Street, Carlisle, Cumberland County,
Pennsylvania, 17103.
8. On the aforesaid date, plaintiff was employed by Filter Tech, Inc.
9. As part of his assignment with Filter Tech, Inc., plaintiff was directed to replace filters that were
located on the roof of the premises at 331 South Hanover Street, Carlisle, Cumberland County,
Pennsylvania.
10. Defendant, Valenti Mid-Atlantic Management, Inc., is a franchisee of Wendy's International, Inc.
II. As plaintiff alleges in his Complaint, the incident occurred in Carlisle, Cumberland County,
Pennsylvania.
12. Defendants anticipate calling at least two (2) witnesses, Mr. Duane McNeal and Ms. Peggy Shew.
Both individuals are residents of Cumberland County, Pennsylvania.
13. Mr. McNeal resides at 137 North West Street, Apt. 2, Carlisle, Cumberland County, Pennsylvania.
14. Ms. Peggy Shew resides at P.O. Box 3933, Gettysburg, Pennsylvania, 17325.
15. It is believed that plaintiff's medical treatment was administered in Cumberland County and
Dauphin County, Pennsylvania.
16. It is believed that plaintiff's medical providers are principally located in Cumberland County,
Dauphin County and Snyder County, Pennsylvania.
17. Examinations which will be planned for plaintiff and conducted on behalf of defendants are

anticipated to be conducted in either Cumberland County, Dauphin County, or Snyder County,
Pennsylvania. No examinations will be conducted in Philadelphia County, Pennsylvania.
18. While plaintiff has filed this Civil Action in Philadelphia County, Pennsylvania, the proper county
for this suit should have been Cumberland County, Pennsylvania. In addition to being the situs of
the alleged accident in the suit, it is the county in which moving defendants conduct business and
in which defendants' witnesses reside.
19. The instant matter does not have any contact or ties to Philadelphia County and should be removed
to Cumberland County, Pennsylvania, for all purposes.
20. Plaintiffs alleged sole contact with Philadelphia County is that the franchisor, Wendy's
International, Inc., lists fourteen (14) addresses in Philadelphia County, none of which have any
relationship to the defendants, Valenti Mid-Atlantic Realty, LLC, and Valenti Mid-Atlantic
Management, Inc. and, upon further investigation, may very well be franchisees and not owned by
the parent, Wendy's International, Inc.
21. Defendants, Valenti Mid-Atlantic Realty, LLC and Valenti Mid-Atlantic Management, Inc., do not
own any property nor do they lease any property or operate any businesses in Philadelphia County,
Pennsylvania.
22. Defendants, Valenti Mid-Atlantic Realty, LLC and Valenti Mid-Atlantic Management, Inc.,
petition this Honorable Court to use its discretion to grant a change of venue based upon forum non
conveniens.
23. A Trial Court has considerable discretion in granting a change of venue based upon forum non
conveniens. See Johns v. First Union Com, 777 A.2d 489 (200 I); Keutherv. Snvder 444 Pa. Super.
468,664 A.2d 168, 169 (1995).
24. A Trial Court may grant a Petition for Forum Non Conveniens when a defendant, "meets its burden
of demonstrating, with detailed information on the record, that the plaintiffs chosen forum is
oppressive or vexatious to the defendant" See Cheeseman v. Lethal Exterminator, 549 Pa. 200,
70 I A.2d 156, 162 (1997).
25. In the Cheeseman case, the Courfexplained that a petitioner seeking a change of venue can meet
its burden of proof by, "establishing with facts on the record that plaintiffs choice of forum was
designed to harass a defendant, even at some inconvenience to the plaintiff himself. Alternatively,

the defendant may meet his burden by establishing on the record that trial in the chosen forum is
oppressive to him...". !d.
26. Moving defendants support their position that Philadelphia County is the inappropriate county for
this Civil Action in that this forum choice is "oppressive and vexatious."
27. Specifically, plaintiff's residence is approximately 153 miles away from City Hall in the City of
Philadelphia. Plaintiff's residence in Selinsgrove, Pennsylvania, is only 60 miles from Cumberland
County, Pennsylvania. See Google Maps, copies of which are attached hereto, made a part hereof.
and marked as Exhibit "B. "
28. In further support, moving defendants' Manager, Peggy Shew, works in the store on Hanover Street
in Carlisle, Cumberland County, Pennsylvania, which is approximately 126 miles from
Philadelphia and only minutes from the Cumberland County Courthouse.
29. Moving defendants' employee, Duane McNeal, resides at 137 North West Street in Carlisle,
Pennsylvania, which is approximately 126.9 miles from Philadelphia and is only minutes from the
Cumberland County Courthouse. See Exhibit "B."
30. Moving defendants' employee, Peggy Shew, resides at P.O. Box 3933, Gettysburg, Pennsylvania,
17325, which is approximately 141 miles from Philadelphia and is only minutes from the
Cumberland County Courthouse. See Exhibit "B."
31. Plaintiff also alleges that a metal ladder that was affixed to the building broke loose and caused him
to fall.
32. Forcing the defendants, Valenti Mid-Atlantic Realty, LLC and Valenti Mid-Atlantic Management,
Inc., to defend this suit in the Court of Common Pleas of Philadelphia County is oppressive and
vexatious in that it is significantly further and more expensive and excessively burdensome for the
parties to travel over two and one-half hours to Philadelphia as opposed to traveling only minutes
to the County in which the incident occurred.
33. Additionally, it is believed that other witnesses who may be called to trial may also reside in or near
Carlisle, Cumberland County, Pennsylvania.
34. Plaintiff has no proper reason for choosing Philadelphia County for the Civil Action and it is
apparent that the only reason for plaintiff's choice is to harass and burden the defendants.
35. Plaintiff's attempt to rest his venue choice on Valenti Mid-Atlantic Realty, LLC and Valenti Mid-

Atlantic Management, Inc., in Philadelphia, based merely upon a listing for a Wendy's
International, is without merit and is oppressive, vexatious and burdensome.
36. Neither the plaintiff nor moving defendants have availed themselves of Philadelphia County,
Pennsylvania, so therefore, this action is not proper in Philadelphia County, Pennsylvania.
37. Plaintiffs choice of forum is not reasonable nor is it practical.
38. Defendants, Valenti Mid-Atlantic Realty, LLC and Valenti Mid-Atlantic Management, Inc., move
this Honorable Court to find that plaintiffs choice of forum should be disturbed.
39. Moving defendants hereby offer to appear and produce witness for Oral Argument on this matter
should the Court deem this necessary.
WHEREFORE, defendants, Valenti Mid-Atlantic Realty, LLC, and Valenti Mid-Atlantic Management,
Inc., t/dIb/a Wendy's Old Fashioned Hamburgers, request that this Honorable Court transfer the instant
action from the Court of Common Pleas of Philadelphia County to the Court of Common Pleas of
Cumberland County, Pennsylvania, pursuant to Pa. R.C.P. 1006(d)(l).

FACTS APPLICABLE TO ALL COUNTS
1. Plaintiff, Mark Oesterich, is an adult individual who currently resides at 199
West Vine Street, Selinsgrove, Snyder County, Pennsylvania 17870.
2. Defendant, Valenti Mid-Atlantic Realty, LLC, (hereinafter "Valenti Realty"),
is a Florida corporation with its principal place of business at 3450 Buschwood Park
Drive, Unit 195, Tampa, Florida 33618, and it owns the real property located at 331
South Hanover Street, Carlisle, Pennsylvania 17103.
3. Defendant, Wendy's International, Inc. t/d/b/a Wendy's Old Fashioned
Hamburgers. (hereinafter "Wendy's"). is an Ohio corporation with its principal place of
business 4288 W. Dublin-Granville Road, Dublin, Ohio 43017.
4. Defendant. Wendy's, advertises, sells products and does business in
Philadelphia County.
5. Defendant, Wendy's, has 14 restaurants listed in the Philadelphia
Pennsylvania Yellow Pages, all of which are located in Philadelphia County.
6. Defendant, Valenti Mid-Atlantic Management, Inc. t/d/b/a Wendy's Old
Fashioned Hamburgers, (hereinafter "Valenti Management"), is a Florida corporation
with its principal place of business at 3450 Buschwood Park Drive, Unit 195. Tampa,
Florida 33618, and it owns and operates a local business at 331 South Hanover Street,
Carlisle, Pennsylvania 17103.
7. The facts and circumstances hereinafter set forth took place on November

5,2003 at the Wendy's Old Fashioned Hamburgers located at 331 South Hanover
Street, Carlisle, Pennsylvania 17103.
8. At the aforesaid time and place. Plaintiff, while working in the course and
scope of his employment for Filter Tech, Inc., was at the Wendy's Old Fashioned
Hamburgers located at 331 South Hanover Street, Carlisle, Pennsylvania 17103 to
replace the filters on the heating and air conditioning unit which was located on the
building's rooftop.
9. At the aforesaid time and place, Plaintiff ascended a metal ladder which
was affixed to the building.
10. At the aforesaid time and place, the metal ladder broke loose from the
building, causing Plaintiff to fall.
11. As a result of the aforesaid fall, Plaintiff, Mark Oeste reich, has suffered
serious and permanent injuries. including but not limited to the following:
a, Closed head injury;
b. Bilateral distal tibia fractures;
c. Cartilage damage to the left ankle; and
d. Mental and physical anguish.
12, As a direct and proximate result of the aforesaid injuries, Plaintiff. Mark
Oestereich, has undergone and in the future will undergo great pain and suffering for
which damages are claimed.
13. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
suffered and may continue to suffer a loss of earnings for which damages are claimed.

14. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich. has
and/or may in the future incur expenses for medical treatment and rehabilitation for
which damages are claimed.
15. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich. has
and/or may in the future incur a loss of earning capacity for which damages are claimed.
16. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
sustained scarring and disfigurement for which damages are claimed,
17. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
sustained a permanent diminution in his ability to enjoy life and life's pleasures for which
damages are claimed.
18. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
incurred or may hereinafter incur financial expenses and losses for which damages are
claimed.
19. Plaintiff believes and therefore avers that 42 Pa. C.SA Section 7102 (b.1)
subtitled "Recovery against joint defendant; contribution" is unconstitutional and
therefore unenforceable in this action because it was passed in violation of Article III,
Sections 1, 2, 3. and 4 of the Pennsylvania Constitution and in violation of the "single
subject rule" and is a law that was passed as part of another bill in a manner consistent
with the prohibited concept of "legislative logrolling". See also DeWeese v. Weaver,
824 A,2d 364 (Pa Cmwlth 2003)

20. Paragraphs 1 through 19 of Plaintiffs Complaint are incorporated herein

21. The aforesaid incident and resulting injuries were a direct and proximate
result of the negligence, carelessness and recklessness of the Defendant, Valenti
Realty, which consisted of:
a. Permitting a dangerous condition to exist in the nature of a ladder
that was not adequately affixed to the building;
b. Failing to properly install the ladder to ensure the safety ofthose
persons utilizing it in a reasonable, adequate and prudent manner;
c. Failing to properly inspect the ladder to ensure the safety of those
persons utilizing it in a reasonable. adequate and prudent manner;
d. Failing to issue adequate warnings. verbal. written, actual and/or
constructive. to persons who would likely encounter the dangerous
condition;
e. Allowing the Plaintiff and others to utilize the ladder in question
when the Defendant knew or should have known of the dangerous
condition of the ladder;
f. Failing to utilize reasonable care in the inspection, maintenance
and/or repair of the ladder in question;
g. Failing to request, institute and/or supervise periodic inspection of
the ladder in question: and
h. Violating various ordinances, regulations. codes, rules. statutes

22. The aforesaid incident was caused by the wrongful and liability producing
conduct of the Defendant. Valenti Realty, as set forth above and is due in no matter
whatsoever by any act or failure to act on part of the Plaintiff, Mark Oestereich.
WHEREFORE, Plaintiff Mark Oestereich demands judgment against Valenti Mid-
Atlantic Realty, LLC, Valenti Mid-Atlantic Management, Inc. t/d/b/a Wendy's Old
Fashioned Hamburgers, and Wendy's International, Inc. t/d/b/a Wendy's Old Fashioned
Hamburgers, jointly and severally, for compensatory damages in an amount in excess

Atlantic Management, Inc. Vd/b/a Wendy's Old Fashioned Hamburgers, Wendy's

ATLANTIC MANAGEMENT, INC., Ud/b/a WENDY'S OLD
FASHIONED HAMBURGERS, TO TRANSFER
VENUE PURSUANT TO Pa. R.C.P.1006(d)(1)
I. INTRODUCTION:
Plaintiff, Mark Oestereich, filed the instant lawsuit on June 5, 2005, and filed the Complaint on
August 15, 2005, alleging that he sustained various personal injuries due to the alleged negligence of
defendants, Valenti Mid-Atlantic Realty, LLC and Valenti Mid-Atlantic Management, Inc., t/d/b/a
Wendy's Old Fashioned Hamburgers. Plaintiff alleges that he sustained injuries on or about November
5,2003, while doing repair work in the course of his employment at defendants' place of business located
at 331 South Hanover Street, Carlisle, Cumberland County, Pennsylvania.

At all times material hereto, Mr. Oestereich has alleged that he resides in Selinsgrove, Snyder
County, Pennsylvania. Co-defendant, Wendy's International, Inc., t/d/b/a Wendy's Old Fashioned
Hamburgers, the franchisor, is a corporation with its principal place of business located in Dublin, Ohio.
None ofthe parties have any offices in Philadelphia County, Pennsylvania.
Plaintiff has not received any medical treatment in Philadelphia County, Pennsylvania. The
accident giving rise to this lawsuit occurred in Cumberland County, Pennsylvania.
n. ARGUMENT:
At the time ofthis accident, defendants' business was located at 331 South Hanover Street, Carlisle,
Cumberland County, Pennsylvania. All of defendants' anticipated witnesses work or reside in or near
Cumberland County, Pennsylvania. It has been reported that plaintiff has been treated in Cumberland
County and Dauphin County, Pennsylvania. Any investigations and/or examinations which are planned
for defendants' to be retained experts will be conducted in Dauphin County, Cumberland County, or
Snyder County, Pennsylvania. No investigations or examinations will be conducted in Philadelphia
County, Pennsylvania.
While plaintiff has filed this civil action in Philadelphia County, Pennsylvania, the proper county
for this suit should have been Cumberland County, Pennsylvania. In addition to being the situs of the
alleged accident in suit, Cumberland County is the county in which there are more contacts to which
defendants also conduct business. The instant matter does not have any contact or ties to Philadelphia,
Pennsylvania and should be removed to Cumberland County, Pennsylvania for all purposes.
Plaintiffs sole alleged contact with Philadelphia County is that a telephone book has fourteen (14)
listings for Wendy's in it. Plaintiff has not demonstrated that any of the fourteen (14) Wendy's listed in
the phone book have any connection to Valenti Mid-Atlantic Realty, LLC and Valenti Mid-Atlantic
Management, Inc. Valenti Mid-Atlantic Realty, Inc., and Valenti Mid-Atlantic Management, Inc., do not
do business in Philadelphia County, Pennsylvania.
Moving defendants petition this Honorable Court to use its discretion to grant a change of venue
based upon forum non conveniens.
III. SUPPORT FOR FINDING OF FORUM NON CONVENIENS:
A Trial Court has considerable discretion in granting a change of venue based upon forum non
conveniens. See Johns v. First Union Corvoration, 777 A.2d 489 (200 I), Keuther v. Snvder, 444 Pa. Super.

468, 664 A.2d 168, 169 (1995).
A Trial Court may grant a Petition to Transfer Venue when a defendant "meets its burden of
demonstrating, with detailed information on the record, that the plaintiff's chosen forum is oppressive or
vexatious to the defendant." See Cheeseman v. Lethal Exterminator, 549 Pa. 200, 701 A.2d 156, 162
(1997).
In the Cheeseman case, suvra., the Supreme Court explained that a petitioner seeking a change of
venue can meet its burden of proof by "establishing with facts on the record that plaintiffs choice offorum
was designed to harass a defendant, even at some inconvenience to the plaintiff himself. Alternatively,
the defendant may meet his burden by establishing on the record that trial in the chosen forum is
oppressive to him.,," Id
Defendants, Valenti Mid-Atlantic Realty, LLC and Valenti Mid-Atlantic Management, Inc., support
their position that Philadelphia County is the inappropriate county for this civil action in that, this forum
choice is "oppressive and vexatious." Specifically, plaintiffs residence is 153 miles away from
Philadelphia County. Plaintiffs residence is only 60 miles away from Cumberland County, Pennsylvania.
In further support, defendant's Manager and store are located at 331 South Hanover Street in Carlisle,
Cumberland County, Pennsylvania, which is approximately 126 miles away from Philadelphia County,
yet only minutes from the Cumberland County Courthouse. In addition, one of defendants' employees,
Duane McNeal, who was present with the plaintiff at the time of the incident, resides at 137 North West
Street, Carlisle, Cumberland County, Pennsylvania, which is approximately 127 miles from Philadelphia
County and only minutes from the Cumberland County Courthouse.
Forcing moving defendants to defend this suit in Philadelphia County, Pennsylvania, is oppressive
and vexatious in that, it is considerably far more expensive and excessively burdensome for the witnesses
to appear in Philadelphia County, Pennsylvania as opposed to Cumberland County, Pennsylvania. In
addition, as stated, plaintiff did not receive any medical treatment in Philadelphia County and no witness
has been identified as living in or around the Philadelphia County area.
IV. CONCLUSION:
Plaintiff has no proper reason for choosing Philadelphia County, Pennsylvania, for the civil action;
the only reason for plaintiffs choice is to harass, oppress and burden moving defendants. Plaintiff
attempts to rest his venue choice on Wendy's International by alleging that the phone book lists fourteen

(14) locations for Wendy's in Philadelphia. However, Wendy's International is a franchisor and
defendants, Valenti Mid-Atlantic Realty, LLC and Valenti Mid-Atlantic Management, Inc., are franchisees.
Clearly, none ofthe Philadelphia franchisees have any relationship to Valenti Mid-Atlantic and therefore,
would have no connection to the lawsuit in Cumberland County, Pennsylvania.
Furthermore, moving defendants own the property in Carlisle, Cumberland County, Pennsylvania,
and it is alleged that the incident occurred due to a ladder that was affixed to the wall and broke. Any
liability and/or damage expert to be retained by moving defendants would be from either Cumberland
County or Dauphin County, Pennsylvania. Neither plaintiff nor moving defendants have availed
themselves of Philadelphia County, Pennsylvania, so that this action is proper in Philadelphia County,
Pennsylvania. In addition, plaintiff's choice of forum is not practical, not reasonable, and his choice is
made with an excessive burden and oppressiveness upon the moving defendants.
Therefore, moving defendants respectfully request that this Honorable Court find that plaintiff's
choice of forum should be disturbed and that this matter should be transferred to the Court of Common
Pleas of Cumberland County, Pennsylvania.

AND NOW, 22-SEP-2005, it is Ordered that:
I. The case management and time standards adopted for expedited track cases shall be applicable to
this case and are hereby incorporated into this Order.
2. All discovery on the above matter shall be completed not later than 06-MAR-2006.

1. INTRODUCTION
Defendant's Motion for Transfer of Venue based on Forum Non Conveniens
should denied for two reasons. The first reason is that the Defendants' current motion
lacks the necessary specificity to evidence any type of "oppression or vexation." The
second reason is that the moving Defendants will, at no time, be able to meet the heavy
burden required to disrupt the Plaintiffs chosen venue.
III. ARGUMENT
Generally, the Plaintiffs choice of venue is given substantial deference. However,
under Pennsylvania Rule of Civil Procedure I 006( d)(l), a court may transfer an action
"[f]or the convenience of parties and witnesses." Pa. RC. P. 1006(d)(1). Despite the
seemingly liberal language of Rule 1006(d)(1), in determining if transfer is proper, a
heavy burden rests with the moving party. In fact, "unless the balance is strongly in favor
of the defendant, the plaintiff's choice of forum should rarely be disturbed." Cheesman v.
Lethal Exterminator. Inc., 701 A.2d 156 (Pa.1997) (citing Revno v. Piper Aircraft Co..
630 F.2d 149, 159 (3d Cir.1980)). In Cheesman, the court indicated that "the defendant
must show more than that the chosen forum is merely inconvenient.. ..a petition to
transfer venue should not be granted unless the defendant meets its burden of
demonstrating, with detailed information on the record, that the Plaintiffs chosen forum
is oppressive or vexatious to the defendant." Cheesman, 701 A.2d at 162. The
interpretation of oppression or vexation has arisen time and time again, including in
2000, when the court in Hoose v. Jefferson Home Health Care. Inc., 754 A.2d I, 5 (Pa.
Super. 2000), stressed that a vast difference exists between what is oppressive and what is
merely inconvenient. Hoose, 754 A.2d at 5.
The courts have provided further guidance in determining whether the chosen
forum is "oppressive or vexatious." The Cheeseman court indicated that no weight is to
be given to the fact that "no significant aspect of the case involves the chosen forum, and
that litigating in another forum is more convenient." Cheesman, 701 A.2d at 162. In
fact, the Cheeseman standard presupposes that the Plaintiff s chosen forum is more
convenient See Cheesman, 701 A.2d at 160-62 . In addition, a case cited by the Defense
indicates that access to the site of the incident is unimportant because "viewing is seldom
necessary." Johns v. First Union Com., 777 A.2d 489,492 (Pa. Super. 2001). Likewise,
any inconvenience to the plaintiff or the plaintiffs witnesses, occurring as a product of
the chosen venue, should not be taken into account See Catagnus v. Allstate Ins. Co.,
864 A.2d 1259, 1264 (Pa. Super. 2004). What is significant for the court to consider is
the access to sources of proof and the availability of defense witnesses. Johns, 777 A.2d
at 491.
It is crucial to note that the moving party must establish the effect resulting from
the Plaintiffs chosen forum. In Keuther v. Snvder, 664 A.2d 168 (Pa. Super. 1995), the
court held that a "party seeking a change of venue must demonstrate, on the record, any
hardships that will result from the Plaintiffs choice of venue." Keuther, 664 A.2d at170.
It has also been suggested that some proof of hardship to defense witnesses must be
included in the plaintiffs petition. See Johnson v. Henkels & McCoy. Inc., 707 A.2d 237
(Pa. Super. 1997) (In holding that the moving party did not meet its burden, the court
stated that the "[a ]ppellees did not provide the trial court with the names of any witnesses
who would suffer hardships should suffer hardship should trial continue in Philadelphia,
nor any affidavits from these alleged witnesses attesting to that fact"); see also Hoose,
754 A.2d I at 4.
In the case at bar, the Defense, although identifying two possible witnesses and
indicating the distance from their residence to the courthouses in Philadelphia and
Cumberland Counties, have provided no evidence of the existence of any hardship. The
fact that two defense witnesses would have to travel two and one-half hours to
Philadelphia is clearly not the "detailed information" that was envisioned by the court in
Cheeseman. It is not enough to name a few possible witnesses and indicate that they live
some distance from the courthouse. This is especially true in this case, since the only
identified witnesses are employees of the Defendant and can be readily compelled to
attend proceedings in Philadelphia. This fact, coupled with the convenient access to
Philadelphia provided by the turnpike and daily train departures, should alleviates any
real difficulty in accessing the witnesses. At best only a "mere inconvenience" will result.
The other facts cited by the defense simply cannot be taken into account in
determining oppression or vexation. The distance the Plaintiff must travel to the
courthouse is a non-factor. See Catagnus, 864 A.2d at 1264. Furthermore, as the
Cheeseman court held, it is unimportant that none of the incidents surrounding the action
took place in the Plaintiffs chosen forum. See Cheesman, 701 A.2d at 162. Likewise,
Defendant's contention that they will obtain experts in Dauphin, Cumberland or Snyder
Counties is insufficient, as experts can be readily obtained in Philadelphia.
In addition to the Defendants' failure to meet their burden in the present motion,
the Defense will be unable to establish oppression or vexation at oral argument or any
other time during the course ofthis action. The Defense petition states that the "only
reason for the Plaintiffs choice [of Philadelphia County] is to harass, oppress and burden
the defendants." (Def.'s Brief Supp. Transfer at 4.) This is without merit. In fact, the
Plaintiff firmly believes that Philadelphia County is a convenient forum for the Defense.
The Defendants, Valenti Mid-Atlantic Management, Inc. and Valenti Mid-Atlantic
Realty, LLC, operate places of business in counties within a close proximity to
Philadelphia, at least twenty-five (25) within 100 miles of Philadelphia City Hall. See
Valenti Mid-Atlantic Management, Inc. Website, Store Location Page at 3-9 (Exhibit
"A"). Furthermore, the Plaintiff avers that the moving Defendants regularly conduct
business in Philadelphia County. The Plaintiffs averment is based on the fact that
Philadelphia is a major distribution outlet for the eastern seaboard. Coupled with the fact
that Mid-Atlantic Management, Inc. has a franchise contract with Wendy's, and Wendy's
has fourteen addresses in Philadelphia, it is likely that that the moving Defendants
conduct regular and continuous business in Philadelphia County.
Other evidence strongly indicates that Philadelphia County is anything but
oppressive or vexatious to the Defense. As noted in the Defendant's motion, the moving
Defendants are incorporated in Florida, while Defendant Wendy's is an Ohio
Corporation. This action will likely require travel by moving Defendants' and Wendy's
Corporate Management and may even require their participation as witnesses.
Philadelphia International Airport would provide Defendants with convenient access to
Philadelphia City Hall. In addition, Philadelphia International Airport, in comparison to
Harrisburg International Airport (closest to Dauphin County and Cumberland County
Courthouses), typically offers lower fares and a greater number of arrival and departure
times.
Another important factor is that the moving defendants have retained counsel in
Philadelphia County. In fact, the office of defense counsel is located only .2 miles from
City Hall. See Expedia Maps (Exhibit "B"). If the action was transferred to Cumberland
County, Defense Counsel would have to travel to attend the pre-trial conference, which
cannot be accomplished by telephone. Likewise, counsel would be forced to attend the
Call of Civil Trial List, which could require counsel to spend the entire day in
Cumberland County. See Cumberland County R.C.P. 213-1. In addition, if the Defense
obtains experts in Philadelphia, as suggested above, Defense counsel will be provided
with convenient access to said experts. In accord with this, the Plaintiff will remain
flexible in regards to the location of depositions. The depositions of the defendants'
witnesses, Mr. McNeal and Ms. Shew, can be held at a place chosen by the Defense. The
Plaintiffs counsel will travel to Carlisle or Philadelphia to take these depositions.
III. CONCLUSION
It is clear that the moving Defendants have not proven that they will be oppressed
or vexed in any way by the chosen of venue. Furthermore, it is unlikely that they will be
able, in the future, to meet the burden necessary to disrupt the Plaintiffs chosen venue.
At very best, the Defense has evidenced only a "mere inconvenience." For this reason,
the Plaintiffrequests that this Honorable Court deny the moving Defendants' Motion to
Transfer Venue from Philadelphia County to Cumberland County.

FACTS APPLICABLE TO ALL COUNTS
1. Plaintiff, Mark Oesterich, is an adult individual who currently resides at 199
West Vine Street, Selinsgrove, Snyder County, Pennsylvania 17870.

is a Florida corporation with its principal place of business at 3450 Buschwood Park
Drive, Unit 195, Tampa, Florida 33618, and it owns the real property located at 331
South Hanover Street, Carlisle, Pennsylvania 17103.
3. Defendant, Wendy's International, Inc. Ud/b/a Wendy's Old Fashioned
Hamburgers, (hereinafter "Wendy's"), is an Ohio corporation with its principal place of
business 4288 W. Dublin-Granville Road, Dublin, Ohio 43017.
4. Defendant, Valenti Mid-Atlantic Management, line. Ud/b/a Wendy's Old
Fashioned Hamburgers, (hereinafter "Valenti Management"), is a Florida corporation
with its principal place of business at 3450 Buschwood Park Drive, Unit 195, Tampa,
Florida 33618, and it owns and operates a local business at 331 South Hanover Street,
Carlisle, Pennsylvania 17103.
5. The facts and circumstances hereinafter set forth took place on November
5,2003 at the Wendy's Old Fashioned Hamburgers located at 331 South Hanover
Street, Carlisle, Pennsylvania 17103.
6. At the aforesaid time and place, Plaintiff, while working in the course and
scope of his employment for Filter Tech, Inc., was at the Wendy's Old Fashioned
Hamburgers located at 331 South Hanover Street, Carlisle, Pennsylvania 17103 to
replace the filters on the heating and air conditioning unit which was located on the
building's rooftop.
7. At the aforesaid time and place, Plaintiff ascended a metal ladder which
was affixed to the building.
8. At the aforesaid time and place, the metal ladder broke loose from the

building, causing Plaintiff to fall.
9. As a result of the aforesaid fall, Plaintiff, Mark Oestereich, has suffered
serious and permanent injuries, including but not limited to the following:
a. Bilateral pilon/plafond fractures of the distal tibia;
b. Severe soft tissue injury to the right and left lower extremities,
including the ankles bilaterally;
c. Closed head injury;
d. Laceration to the back of the head;
e. Multiple contusions and abrasions;
f. Post traumatic arthritis; and
g. Mental and physical anguish.
10. As a direct and proximate result of the aforesaid injuries, Plaintiff, Mark
Oestereich, has undergone and in the future will undergo great pain and suffering for
which damages are claimed.
11. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
suffered and may continue to suffer a loss of earnings for which damages are claimed.
12. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
and/or may in the future incur expenses for medical treatment and rehabilitation for
which damages are claimed.
13. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
and/or may in the future incur a loss of earning capacity for which damages are claimed.
14. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has

sustained scarring and disfigurement for which damages are claimed.
15. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
sustained a permanent diminution in his ability to enjoy life and life's pleasures for which
damages are claimed.
16. As a further result of the aforesaid injuries, Plai,ntiff, Mark Oestereich, has
incurred or may hereinafter incur financial expenses and losses for which damages are
claimed.
17. Plaintiff believes and therefore avers that 42 Pa. C.SA Section 7102 (b.1)
subtitled "Recovery against joint defendant; contribution" is unconstitutional and
therefore unenforceable in this action because it was passed in violation of Article III,
Sections 1, 2, 3, and 4 of the Pennsylvania Constitution and in violation of the "single
subject rule" and is a law that was passed as part of another bill in a manner consistent
with the prohibited concept of "legislative logrolling". See also DeWeese v. Weaver,
824 A.2d 364 (Pa Cmwlth 2003)
COUNT II
MARK OESTEREICH v. VALENTI MID-ATLANTIC REAL TV, LLC
18. Paragraphs 1 through 19 of Plaintiffs Complaint are incorporated herein
by reference and made a part hereof as if set forth in full.
19. The aforesaid incident and resulting injuries were a direct and proximate
result of the negligence, carelessness and recklessness of the Defendant, Valenti
Realty, which consisted of:
a. Permitting a dangerous condition to exist in the nature of a ladder

that was not adequately affixed to the building;
b. Failing to properly install the ladder to ensure the safety of those
persons utilizing it in a reasonable, adequate and prudent manner;
c. Failing to properly inspect the ladder to ensure the safety of those
persons utilizing it in a reasonable, adequate and prudent manner;
d. Failing to issue adequate warnings, verbal, written, actual and/or
constructive, to persons who would likely encounter the dangerous
condition;
e. Allowing the Plaintiff and others to utilize the ladder in question
when the Defendant knew or should have known of the dangerous
condition of the ladder;
f. Failing to utilize reasonable care in the inspection, maintenance
and/or repair of the ladder in question;
g. Failing to request, institute and/or supervise periodic inspection of
the ladder in question; and
h. Violating various ordinances, regulations, codes, rules, statutes
and/or local, state and/or federal laws.
20. The aforesaid incident was caused by the wrongful and liability producing
conduct of the Defendant, Valenti Realty, as set forth above and is due in no matter
whatsoever by any act or failure to act on part of the Plaintiff, Mark Oestereich.
WHEREFORE, Plaintiff Mark Oestereich demands judgment against Valenti Mid-
Atlantic Realty, LLC, Valenti Mid-Atlantic Management, Inc. tld/b/a Wendy's Old

COUNT \II
MARK OESTE REICH v. WENDY'S INTERNATIONAL. INC t1d/b/a WENDY'S
OLD FASHIONED HAMBURGERS
21. Paragraphs 1 through 22 of Plaintiff's Complaint are incorporated herein
by reference and made a part hereof as if set forth in full.
22. The aforesaid incident and resulting injuries were a direct and proximate
result of the negligence, carelessness and recklessness of the Defendant, Wendy's,
which consisted of:
a. Permitting a dangerous condition to exist in the nature of a ladder
that was not adequately affixed to the building;
b. Failing to properly install the ladder to eJllsure the safety of those
persons utilizing it in a reasonable, adequate and prudent manner;
c. Failing to properly inspect the ladder to ensure the safety of those
persons utilizing it in a reasonable, adequate and prudent manner;
d. Failing to issue adequate warnings, verbal, written, actual and/or
constructive, to persons who would likely encounter the dangerous
condition;
e. Allowing the Plaintiff and others to utilize the ladder in question
when the Defendant knew or should have known of the dangerous

f. Failing to utilize reasonable care in the inspection, maintenance
and/or repair of the ladder in question;
g. Failing to request, institute and/or supervise periodic inspection of
the ladder in question; and
h. Violating various ordinances, regulations, codes, rules, statutes
and/or local, state and/or federal laws.
23. The aforesaid incident was caused by the wrongful and liability producing
conduct of the Defendant, Wendy's, as set forth above and is due in no matter
whatsoever by any act or failure to act on part of the Plaintiff, Mark Oestereich.
WHEREFORE, Plaintiff Mark Oestereich demands judgment against Wendy's
International, Inc. Ud/b/a Wendy's Old Fashioned Hamburgers, Valenti Mid-Atlantic
Realty, LLC, and Valenti Mid-Atlantic Management, Inc. Ud/b/a Wendy's Old Fashioned
Hamburgers, jointly and severally, for compensatory damages in an amount in excess
of the amount requiring compulsory arbitration.
COUNT IV
MARK OESTE REICH v. VALENTI MID-ATLANTIC MANAGEMENT. INC.

24. Paragraphs 1 through 25 of Plaintiff's Complaint are incorporated herein

25. The aforesaid incident and resulting injuries were a direct and proximate
result of the negligence, carelessness and recklessness of the Defendant, Valenti

DEFENDANT'S PRELIMINARY OBJECTIONS
TO THE PLAINTIFF'S COMPLAINT
AND NOW, come the Defendants, Valenti Mid-Atlantic Realty, LLC, Valenti Mid-Atlantic
Management, Inc. and Wendy's International tld/b/a Wendy's Old Fashioned Hamburgers (hereinafter
collectively referred to as "Defendants"), by and through their attorneys, Johnson, Duffie, Stewart & Weidner,
P.C., and file the following Preliminary Objections to the Plaintiff's Complaint, and in support thereof aver as
follows:
1. This matter was commenced in the Court of Common Pleas of Philadelphia County and
subsequently transferred to this court by an October 3, 2005 Order of the Court of Common Pleas of
Philadelphia County.
2. Upon transfer of the action to this court, the Plaintiff filed an amended Complaint upon
Stipulation of the parties. A copy of the Plaintiff's Amended Complaint is attached hereto as "Exhibit A."
3. Paragraphs 19(h), 22(h) and 25(h) of the Plaintiffs' Amended Complaint contain the following
averments of negligence on the part of Ihe Defendants:
h) Violating various ordinances, regulations, codes, rules, statutes and/or
local, state and/or federal laws.
See, Exhibit A, 1111 19(h), 22(h) & 25(h).
4. Pennsylvania Rule of Civil Procedure 1028(a)(2) states, "Preliminary objections may be filed
by any party to any pleading and are limited to the following grounds: failure of a pleading to conform to law
or rule of court or inclusion of scandalous or impertinent matter." Pa.R.C.P. 1028(a)(2).
5. Pa.R.C.P. 1019(a) requires the malerial facts in which a cause of action or defense is based
to be stated in concise and summary form.
6. Subparagraphs (h) of paragraphs 19, 22 and 25 of the Plaintiff's Amended Complaint fail to
comply with Pa.R.C.P. 1019(a). Connor v. Alleqhenv General Hospital, 501 Pa. 306,461 A.2d 600 (1993).
7 The cited subparagraphs of Ihe Plaintiff's Amended Complaint are nothing more than boiler
plate allegations which make il impossible for the Defendants to have enough factual information to prepare
a defense in lhis case.
8. Moreover, the above cited allegations in the Plaintiff's Amended Complaint provide the
Plaintiff a blank slate to add theories of negligence al any future point in the litigation which thereby
prejudices the Defendants' ability to prepare a defense.
9. The cited allegations of Ihe Plaintiff's Amended Complaint lack sufficient specificity as
required by the Pennsylvania Rules of Civil Procedure.
WHEREFORE, the Defendants respectfully request that this Honorable Court enter an Order striking
paragraphs 19(h), 22(h) and 25(h) of Ihe Plaintiffs' Amended Complaint, or, in the alternative, require the
Plaintiff to file a more specific pleading.

FACTS APPLICABLE TO ALL COUNTS
1. Plaintiff, Mark Oesterich, is an adult individual who currently resides at 199
West Vine Street, Selinsgrove, Snyder County, Pennsylvania 17870.

is a Florida corporation with its principal place of business at 3450 Buschwood Park
Drive, Unit 195, Tampa, Florida 33618, and it owns the real property located at 331
South Hanover Street, Carlisle, Pennsylvania 17103.
3. Defendant, Wendy's International, Inc. tJd/b/a Wendy's Old Fashioned
Hamburgers, (hereinafter "Wendy's"), is an Ohio corporation with its principal place of
business 4288 W. Dublin-Granville Road, Dublin, Ohio 43017.
4. Defendant, Valenti Mid-Atlantic Management, Inc. tJd/b/a Wendy's Old
Fashioned Hamburgers, (hereinafter "Valenti Management"), is a Florida corporation
with its principal place of business at 3450 Buschwood Park Drive, Unit 195, Tampa,
Florida 33618, and it owns and operates a local business at 331 South Hanover Street,
Carlisle, Pennsylvania 17103.
5. The facts and circumstances hereinafter set forth took place on November
5,2003 at the Wendy's Old Fashioned Hamburgers located at 331 South Hanover
Street, Carlisle, Pennsylvania 17103.
6. At the aforesaid time and place, Plaintiff, while working in the course and
scope of his employment for Filter Tech, Inc., was at the Wendy's Old Fashioned
Hamburgers located at 331 South Hanover Street, Carlisle, Pennsylvania 17103 to
replace the filters on the heating and air conditioning unit which was located on the
building's rooftop.
7. At the aforesaid time and place, Plaintiff ascended a metal ladder which
was affixed to the building.
8. At the aforesaid time and place, the metal ladder broke loose from the

building, causing Plaintiff to fall.
9. As a result of the aforesaid fall, Plaintiff, Mark Oestereich, has suffered
serious and permanent injuries, including but not limited to the following:
a. Bilateral pilon/plafond fractures of the distal tibia;
b. Severe soft tissue injury to the right and left lower extremities,
including the ankles bilaterally;
c. Closed head injury;
d. Laceration to the back of the head;
e. Multiple contusions and abrasions;
f. Post traumatic arthritis; and
g. Mental and physical anguish.
10. As a direct and proximate result of the aforesaid injuries, Plaintiff, Mark
Oestereich, has undergone and in the future will undergo great pain and suffering for
which damages are claimed.
11. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
suffered and may continue to suffer a loss of earnings for which damages are claimed.
12. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
and/or may in the future incur expenses for medical treatment and rehabilitation for
which damages are claimed.
13. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
and/or may in the future incur a loss of earning capacity for which damages are claimed.
14. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has

sustained scarring and disfigurement for which damages are claimed.
15. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
sustained a permanent diminution in his ability to enjoy life and life's pleasures for which
damages are claimed.
16. As a further result of the aforesaid injuries, Plaintiff, Mark Oestereich, has
incurred or may hereinafter incur financial expenses and losses for which damages are
claimed.
17. Plaintiff believes and therefore avers that 42 Pa. C.S.A. Section 7102 (b.1)
subtitled "Recovery against joint defendant; contribution" is unconstitutional and
therefore unenforceable in this action because it was passed in violation of Article III,
Sections 1, 2, 3, and 4 of the Pennsylvania Constitution and in violation of the "single
subject rule" and is a law that was passed as part of another bill in a manner consistent
with the prohibited concept of "legislative logrolling". See also DeWeese v. Weaver,
824 A.2d 364 (Pa Cmwlth 2003)
COUNT II
MARK OESTEREICH v. VALENTI MID-ATLANTIC REALTY, LLC
18. Paragraphs 1 through 19 of Plaintiffs Complaint are incorporated herein
by reference and made a part hereof as if set forth in full.
19. The aforesaid incident and resulting injuries were a direct and proximate
result of the negligence, carelessness and recklessness of the Defendant, Valenti
Realty, which consisted of:
a. Permitting a dangerous condition to exist in the nature of a ladder

that was not adequately affixed to the building;
b. Failing to properly install the ladder to ensure the safety of those
persons utilizing it in a reasonable, adequate and prudent manner;
c. Failing to properly inspect the ladder to ensure the safety of those
persons utilizing it in a reasonable, adequate and prudent manner;
d. Failing to issue adequate warnings, verbal, written, actual and/or
constructive, to persons who would likely encounter the dangerous
condition;
e. Allowing the Plaintiff and others to utilize the ladder in question
when the Defendant knew or should have known of the dangerous
condition of the ladder;
f. Failing to utilize reasonable care in the inspection, maintenance
and/or repair of the ladder in question;
g. Failing to request, institute and/or supervise periodic inspection of
the ladder in question; and
h. Violating various ordinances, regulations, codes, rules, statutes
and/or local, state and/or federal laws.
20. The aforesaid incident was caused by the wrongful and liability producing
conduct of the Defendant, Valenti Realty, as set forth above and is due in no matter
whatsoever by any act or failure to act on part of the Plaintiff, Mark Oestereich.
WHEREFORE, Plaintiff Mark Oestereich demands judgment against Valenti Mid-
Atlantic Realty, LLC, Valenti Mid-Atlantic Management, Inc. tld/b/a Wendy's Old

COUNT III
MARK OESTEREICH v. WENDY'S INTERNATIONAL, INC tld/b/a WENDY'S
OLD FASHIONED HAMBURGERS
21. Paragraphs 1 through 22 of Plaintiff's Complaint are incorporated herein
by reference and made a part hereof as if set forth in full.
22. The aforesaid incident and resulting injuries were a direct and proximate
result of the negligence, carelessness and recklessness of the Defendant, Wendy's,
which consisted of:
a. Permitting a dangerous condition to exist in the nature of a ladder
that was not adequately affixed to the building;
b. Failing to properly install the ladder to ensure the safety of those
persons utilizing it in a reasonable, adequate and prudent manner;
c. Failing to properly inspect the ladder to ensure the safety of those
persons utilizing it in a reasonable, adequate and prudent manner;
d. Failing to issue adequate warnings, verbal, written, actual and/or
constructive, to persons who would likely encounter the dangerous
condition;
e. Allowing the Plaintiff and others to utilize the ladder in question
when the Defendant knew or should have known of the dangerous

condition of the ladder;
f. Failing to utilize reasonable care in the inspection, maintenance
and/or repair of the ladder in question;
g. Failing to request, institute and/or supervise periodic inspection of
the ladder in question; and
h. Violating various ordinances, regulations, codes, rules, statutes
and/or local, state and/or federal laws.
23. The aforesaid incident was caused by the wrongful and liability producing
conduct of the Defendant, Wendy's, as set forth above and is due in no matter
whatsoever by any act or failure to act on part of the Plaintiff, Mark Oestereich.
WHEREFORE, Plaintiff Mark Oestereich demands judgment against Wendy's
International, Inc. tld/b/a Wendy's Old Fashioned Hamburgers, Valenti Mid-Atlantic
Realty, LLC, and Valenti Mid-Atlantic Management, Inc. t/d/b/a Wendy's Old Fashioned
Hamburgers, jointly and severally, for compensatory damages in an amount in excess
of the amount requiring compulsory arbitration.

Management, which consisted of:
a. Permitting a dangerous condition to exist in the nature of a ladder
that was not adequately affixed to the building;
b. Failing to properly install the ladder to ensure the safety of those
persons utilizing it in a reasonable, adequate and prudent manner;
c. Failing to properly inspect the ladder to ensure the safety of those
persons utilizing it in a reasonable, adequate and prudent manner;
d. Failing to issue adequate warnings, verbal, written, actual and/or
constructive, to persons who would likely encounter the dangerous
condition;
e. Allowing the Plaintiff and others to utilize the ladder in question
when the Defendant knew or should have known of the dangerous
condition of the ladder;
f. Failing to utilize reasonable care in the inspection, maintenance
and/or repair of the ladder in question;
g. Failing to request, institute and/or supervise periodic inspection of
the ladder in question; and
h. Violating various ordinances, regulations, codes, rules, statutes
and/or local, state and/or federal laws.
26. The aforesaid incident was caused by the wrongful and liability producing
conduct of the Defendant, Valenti Management, as set forth above and is due in no
matter whatsoever by any act or failure to act on part of the Plaintiff, Mark Oestereich.

WHEREFORE, Plaintiff Mark Oestereich demands judgment against Valenti Mid-
Atlantic Management, Inc. t/d/b/a Wendy's Old Fashioned Hamburgers, Wendy's
International, Inc. t/d/b/a Wendy's Old Fashioned Hamburgers, and Valenti Mid-Atlantic

1. The Defendants filed Preliminary Objections to the Plaintiff's Amended
Complaint. A copy of those Preliminary Objections are attached hereto and
incorporated herein by reference as Exhibit A.
2. When the Plaintiff filed and served the Complaint, it also served the
following Discovery Requests upon the Defendants:

3. Defendants have yet to respond to those Discovery Requests which are
now long overdue.
4. Until the Defendants comply with the Plaintiffs Discovery Requests and
Plaintiffs conduct reasonable follow up Discovery, it will be impossible for the
Plaintiff to more specifically plead to Paragraphs 19 (h), 22 (h) and 25 (h) of the
Complaint.
5. Plaintiff concedes that the Defendants have timely filed their Preliminary
Objections and have preserved the issue should the Plaintiff not adequately
replead upon the completion of its discovery relative to those averments.
6. Defendants would not be prejudiced if they are allowed to reassert their
Preliminary Objections after the Plaintiff pleads over.
7. Plaintiffs counsel has contacted counsel for the Defendant who does not
concur in the within Motion.
WHEREFORE, the Plaintiff respectfully request this Honorable Court
issue an Order as follows:
a. The Court will defer a ruling on the Defendants' Preliminary Objections;
b. Defendants shall respond to the paper discovery served upon it by the
Plaintiff within 30 days;
c. Plaintiff shall have 90 days from that date to complete its discovery and
file a more specific pleading with respect to averments 19 (h), 22 (h) and 25 (h)
of his Amended Complaint;
