LAST WILL AND TESTAMENT
OF
RUTH A. WALSH
I, RUTH A. WALSH, of the Borough of New Cumberland, County of
Cumberland and State of Pennsylvania, being of sound mind, memory and under-
standing, do hereby make, publish and declare this as and for my Last Will
and Testament hereby revoking and making void any and all other wills by me
at any time heretofore made.
I.
I direct that my Executor hereinafter named shall pay all my just
debts and funeral expenses as soon as conveniently may be done after my
decease.
II.
All the rest, residue and remainder of my estate, whether real,
personal or mixed, and wheresoever situate, I hereby give, devise and bequeath
unto my husband, CHARLES L. WALSH, if he survives me by a period of thirty
days. If my said husband does not survive me by a period of thirty days,
then this gift to him shall be divested, and I then give, devise and bequeath
my entire estate as follows:
A. One-sixth (1/6) unto my grandson, DAVID W. BRUBAKER.
B. One-sixth (1/6) unto my grandson, JULIAN C. BRUBAKER.
C. One-sixth (1/6) unto my grandson, WILLIAM H. BRUBAKER.
D. One-half (1/2) unto my hereinafter named Trustee in Trust,
nevertheless, for my daughter, AGNES M. BRUBAKER, to be held by my Trustee
as hereinafter provided.
III.
My Trustee shall hold the portion hereinbefore bequeathed to him
in Trust for my daughter, Agnes M. Brubaker, and pay to her such amounts
from principal and income as my Trustee, in his sole discretion, shall deter-
mine necessary and proper. I direct that my Trustee make payments to the
beneficiary in amounts of no less than fifty ($50.00) dollars per month. MY

Trustee may invade the principal to any extent at any time as he, in his sole
discretion, believes it would be necessary and appropriate. If any remainder
exists upon the death of Agnes M. Brubaker, then at her death it shall be
distributed unto my grandsons, DAVID W. BRUBAKER, JULIAN C. BRUBAKER, and
WILLIAM H. BRUBAKER, in equal shares.
IV.
TRUSTEE'S POWERS: My Trustee shall have the following powers in
addition to those given by law to be executed in his own sole discretion:
A. To retain any real or personal property which may at any time
form part of the Trust, as long as he may deem advisable.
B. To invest in any real or personal property without restriction
to legal investments.
C. To purchase investments at premiums; to charge premiums to in-
come or principal, or partly to each.
D. To subscribe for stocks, bonds or other investments; to join in
any plan of lease, mortgage, merger, consolidation, exchange, reorganization,
foreclosure or voting trust, and to deposit securities thereunder; and
generally to exercise all the rights of security holders of any corporation.
E. To repair, alter, improve or lease, for any period of time,
any real or personal property and to give options for leases.
F. To sell at public or private sale, for cash or credit, with
orwithout security, to exchange or to partition any real or personal
property and to give options for sales or exchanges.
G. To borrow money from any person, including Trustee, and to
mortgage or pledge any real or personal property.
H. To compromise claims.
I. To make distribution in kind.
J. To exercise all power, authority and discretion given by this
Instrument of Trust after the termination of any trust created herein until
the same is fully distributed.
K. To purchase and hold investments in the name of a nominee.

V.
DISABILITY PROVISION: If any beneficiary shall, in the opinion
of Trustee, become mentally or physically incapacitated, Trustee may apply
such beneficiary's share, either principal or income, for the support and wel-
fare of such beneficiary directly without the intervention of a Guardian.
VI.
PROTECTIVE PROVISION: All principal and income shall, until
actual distribution to the beneficiary, be free and clear of the debts, con-
tracts, alienations and anticipations of any beneficiary and the same shall
not be liable to any levy, attachment, execution or sequestration while in
the possession of Trustee.
VII.
TAX CLAUSE: If any estate, inheritance, succession or other death
taxes are assessed against or measured by the assets of this Trust upon the
death of myself, this Trust shall bear its proportionate part thereof.
Trustee shall pay the same out of principal and may pay the same at such time
or times as Trustee deems advisable.
VIII.
I hereby nominate, constitute and appoint my grandson, DAVID W.
BRUBAKER, as Trustee under this, my Last Will and Testament.
IX.
I hereby nominate, constitute and appoint my husband, CHARLES L._
WALSH, as Executor of this, my Last Will and Testament. If the said Charles
L. Walsh should predecease me, or otherwise fails to qualify, or ceases to
act as such, then I nominate, constitute and appoint my grandson, DAVID W.
BRUBAKER, as Executor.
X.
No fiduciary acting under this Will shall be required to post
bond in this jurisdiction or in any jurisdiction in which he may act.
