THIS AGREDENT :::U7:i:ON jf:rl;:I;N:overrUJer , 2005, by and
between Neidlinger Construction, a sole proprietor, hereinafter
referred to as Contractor,
AND
Larry V. Neidlinger and Mary Jo Neidlinger, husband and wife,
hereinafter referred to as Owners, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in West pennsboro Township, Cumberland County,
Commonwealth of pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as Lot
#13 Stonecrest Acres, Newville, PA 17241.
NOW THEREFORE, THIS AGREDENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL THAT CERTAIN lot of land situate in West Pennsboro Township, Cumberland
County, Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a P. K. Nail set on the centerline of T-435 (also known os Wagner
Rood) at the dividing iine of Lot No, 13 herein conveyed and Lot No. 14 os shown
on the hereinafter mentioned Subdivision Plan; thence along said centerline
South 53 degrees 34 minutes 37 seconds West, 0 distance of 200,00 feet to a p.k
nail set at the dividing line of Lot 12; thence North 36 degrees 25 minutes 23
seconds West passing through an iron pin 23.31 feet from beginning point, a
distance of 463,00 feet to an iron pin on the dividing line of Lot 20; thence along
Lot 20 North 53 degrees 34 minutes 37 seconds East passing through a drainage
easement 32,42 feet wide, a distance of 200.00 feet to an iron pin at the dividing
line of aforementioned Lot 14, thence along Lot 14 South 36 degrees 25 minutes
23 seconds East passing through said drainage easement 46,47 feet wide and
passing through an iron pin 22,63 feet from end point a distance of 463,00 feet to
a P,K nail set the Place of BEGINNING
CONTAINING a total area of 2,02078 acres and being Lot 13 on 0 Land
Subdivision for Stonecrest Acres recorded in Cumberland County Plan Book 81,
Page 124.
Lot 13 herein conveyed is subject to a drainage easement area of 0.29223 acres,
