THIS AGREEMENT, made the /t day of ;t0i/~.L, 2005, by and between
PERRY COUNTY CONSTRUCTION,
New Bloomfield, PA
hereinafter referred to as Contractor,
AND
JOHN L. MYERS, SR. and JENNIFER C. MYERS, husband and wife
131 Green Briar Road, ElIiottsburg, P A
hereinafter referred to as Owner,
Whereby the fonner undertook and agreed to erect and construct a single family dwelling on that certain lot
of ground situate in Silver Spring Township, Cumberland County, Pennsylvania, containing 13,775 acres, as
more particularly set forth in Deed Book 253, Page 3652.
Being further identified as Tax Parcel No. 38-04-0365-012
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in
consideration of the sum of ONE DOLLAR ($1.00) to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's
liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about the erection and construction of the said
buildings on the lot above-described, and the said Contractor, for themselves, their subcontractors and others
under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens
or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien,
shall be an independent covenant.

John L. Myers, Sr. and Jennifer C. Myers, his wife, as tenants by
the entireties, parties of the second part.
WXTHESSETH, that said party of the first part, for and in
consideration of the sum of Sixty-six Thousand Six Hundred dollars
($66,600.00), lawful money of the United States of America, well and
truly paid by the said parties of the second part to the said party
of the first part, at and before the sealing and delivery of these
presents, the receipt whereof is hereby acknowledged, has granted,
bargained, sold, aliened, enfeoffed, released, conveyed and
confirmed, and by these presents does grant, bargain, sell, alien,
enfeoff, release, convey and confirm unto the said parties of the
second part, their heirs and assigns.
ALL THAT CERTAIN tract of mountain land situate in Silver Spring
Township, Cumberland County, Pennsylvania, bounded and described as
follows, to wit:
BEGXNNXNG on the North on line of lands formerly of Hiram Otstot at
stones; thence No.cth 85% deg.cees East, cwenty (20) perChes to
stones; thence South on line of lands of B. F. Wertz 2'h degrees
West, one hundred twelve and two-tenths (112.2) perches to a stake
at side of road; thence on line of lands of H.C. Spangler, South 85'h
degrees West, nineteen and four-tenths (19.4) perches to stones;
thence North on line of lands of Joseph Erb 2'h degrees East, one
hundred twelve and three-tenths (112.3) perches to stones, the place
of BEGINNING.
CONTAINXNG thirteen (13) acres and one hundred twenty-four (124)
perches, net measure.
TOGETHER with and subject to the right-of-wayarD. easement as set
forth in Cumberland County Miscellaneous Book 305, at page 685.
