BRANDT, LATE OF NORTH NEWTON TOWNSHIP, CUMBERLAND COUNTY, PENNA., DECEASED IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA ORPHANS' COURT DIVISION ESTATE NO. 21-78-686 PETITION FOR ORDER OF COURT EXCUSING THE ENTRY OF ADDITIONAL SECURITY PURSUANT TO 20 PA. C.S.A. 3351 TO THE HONORABLE, THE JUDGES OF SAID COURT: The Petition of Jay H. Brandt and Lee E. Brandt, co- administrators of the Estate of Ethel W. Brandt, respectfully represent as follows: 1. That your Petitioners are Jay H. Brandt and Lee E. Brandt who were appointed administrators of the Estate of Ethel W. Brandt on February 25, 1980. 2. That your Petitioners have entered into an agreement of sale to convey the real property owned by the decedent at her death to William C. Kollas, William C. Costopoulos and James C. Costopoulos for the total sale price of $100,000.00, pursuant to agreement of sale dated March 14, 1980. 3. That the remaining real estate of Ethel W. Brandt, deceased, consists of three tracts of land situate in the Borough and of Newville/in North Newton Township, Cumberland County, Pennsylvania containing45.098 acres, more or less, being the remaining portion of the premises which Howard O. Brandt and Ethel W. Brandt, his wife, purchased from Jennie B. Landis, widow, by deed dated October 29, 1942 and recorded in the office of the Recorder of Deeds in and for Cumberland County in Deed Book "P", Volume 12, Page 222. ll....f\ 10"': u~ .,\ I ;',. ~"":- 676 4. That your Petitioners have posted a surety bond through Insurance Company of North America in the total sum of $160,000.00 for administration of the estate, which bond represents double the estimated gross value of personal property in the estate. 5. That the agreement of sale to William C. Kollas, et aI, was entered after consultation with all of the heirs of Ethel W. Brandt, deceased. 6. That all of the heirs of Ethel W. Abram 1 Buchannen Street Newville, PA 17241 were consulted prior to the entry of the agreement of sale aforesaid and each of said heirs of Ethel W. That each of the heirs of Ethel W. Brandt whose signatures are attached hereto are anxious to avoid additional unnecessary expenditures of the funds of the estate and are confident that the said Jay H. Brandt and Lee E. Brandt will properly perform their duties as administrators without the requirement of the filing of additional security. WHEREFORE, Your Petitioners respectfully pray Your Honorable Court to enter an Order of Court excusing them from entering any additional security in order to receive the proceeds of the sale of the real property of Ethel W.
