HomeMy WebLinkAbout01-4931STIPULATION AGAINST LIENS THIS AGREEMENT made the 16TH by and between hereinafter referred to as Contractor, day of AUGUST, 2001 hereinafter referred to as Owner, whereby the former undertook and agreed to construct a NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of Dollar to it in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument waiving the right of lien, shall be an independent covenant. Hockenberry prepared by Larry V. Neidlinger, P.E. R.S. dated September 23, 2000, as follows: BEGINNING at a point at the intersection of the center lines of North Middlesex Road (L.R. 21011) and Beagle Club Road (Township Road T-503) marked by a bolt set; thence by the center line of said North Middlesex Road, South 21 degrees 52 minutes 00 seconds East, 211.70 feet to a bolt set; thence by lands now or formerly of George L. Newberry, South 68 degrees 08 minutes 00 seconds West, 192.97 feet to a point; thence by lands now or formerly of Michael P. McAdaragh, North 35 degrees 05 minutes 00 seconds West, 161.97 feet to a bolt set; thence by the center line of said Beagle Club Road, North 54 degrees 55 minutes 00 seconds East, 236.26 feet to a bolt set, the place of BEGINNING. CONTAINING 0.9082 acre. SUBJECT, NEVERTHELESS, to Middlesex Road and Beagle lines of record. the dedicated rights-of-way for North Club Road and to the building setback UNDER AND SUBJECT, FURTHER, to building and use conditions and restrictions of record. ALSO DESCRIBED AS FOLLOWS: ALL THAT CERTAIN tract of land situate in Middlesex Township, Cumberland County, Pennsylvania, and more particularly bounded and described in accordance with a resubdivision plan prepared by Joseph R. Corby, Professional Engineer, which said resubdivision plan is dated July 24 1985, and recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, in Plan Book 48, Page 39, as follows: BEGINI~ING at a point at the intersection of the center lines of North Middlesex Road (L.R. 21011) and Beagle Club Road (Township Road T-503); thence by the center line of said North Middlesex Road, South 21 degrees 52 minutes East, 217.84 feet to a point; thence by lands now or formerly of George L. Newberry, et ux, South 68 degrees 00 minutes West, 200.00 feet to a point; thence by Lot No. 2 of Tract No. 1 on the hereinabove mentioned resubdivision plan, North 35 degrees 05 minutes West, 166.34 feet to a point; thence by the center line of said Beagle Club Road, North 54 degrees 55 minutes East, 236.26 feet to a point, the place of BEGINNING.
