AWARDING REAL ESTATE

no objections having been presented to the First and Final Account and State-
ment of Proposed Distribution of Earl E. Durham, Sr., Administrator of the
Estate of Linus C. Durham, Deceased, within the time fixed by the Rules of
Court, said account is hereby confirmed absolutely and the Schedule of Proposed
Distribution is awarded in accordance therewith.
IT IS FURTHER ADJUDGED AND DECREED that, in accordance with the said
First and Final Account and Statement of Proposed Distribution, as confirmed by
the Court, that the distribution of all the right, title and interest of Linus
C. Durham, Deceased, in the fallowing real estate is hereby confirmed, and the
same is awarded as hereinafter set forth, to wit:
(a) To Linus C. Durham, Jr., his heirs and assigns, all those certain
two tracts of unimproved land situate in Middlesex Township, Cumberland County,
Pennsylvania, and being Lot No.7 and Lot No.9 on a certain Subdivision Plan
for the Linus C. Durham Estate, dated July 17, 1979, and recorded in Cumberland

County Plan Book 36, at page 90 and 91.
(b) To Earl E. Durham, Sr., his heirs and assigns, all those certain
two tracts of unimproved land situate in Middlesex Township, Cumberland County,
Pennsylvania, and being Lot No. 2 and Lot No. 6 on a certain Subdivision Plan
for the Linus C. Durham Estate, dated July 17, 1979, and recorded in Cumberland

County Plan Book 36, at pages 90 and 91.

(c) To John E. Durham~ his heirs and assigns~ all those certain two
tracts of unimproved land situate in Middlesex Township~ Cumberland County,
Pennsylvania~ and being Lot No.4 and Lot No.8 on a certain Subdivision Plan
for the Linus C. Durham Estate~ dated July 17~ 1979~ and recorded in Cumberland
County Plan Book 36~ at pages 90 and 91. Lot No.8 is awarded under and sub-
ject to a 25-foot right-of-way, as set forth on said Plan.
(d) To Ruth E. Mullen~ her heirs and assigns, all those certain two
tracts of unimproved land situate in Middlesex Township~ Cumberland County~
Pennsylvania~ and being Lot No. 1 and Lot No. 5 on a certain Subdivision Plan
for the Linus C. Durham Estate~ dated July l7~ 1979~ and recorded in Cumberland
County Plan Book 36, at pages 90 and 91.
(e) To Lee L. Durham~ his heirs and assigns, all that certain
tract of unimproved land situate in Middlesex Township~ Cumberland County~
Pennsylvania, and being Lot No.3 on a certain Subdivision Plan for the Linus
C. Durham Estate~ dated July 17, 1979, and recorded in Cumberland County Plan
Book 36, at pages 90 and 91.

BEING the balance of the same property which Rebecca S. N. Wert, Widow,
by Deed dated September 9~ 1948, and recorded in Cumberland County Record Book
\IX~" Volume 13~ page 328~ granted and conveyed to L. C. Durham, also known as
Linus C. Durham~ and Grace G. Durham, his wife. The said Grace G. Durham died
June 9, 1970, thereby vesting fee simple title in L. C. Durham, also known as
Linus C. Durham~ deceased.
