AUDITOR'S FINAL REPORT
TO THE HONORABLE, THE JUDGES OF SAID COURT:
The undersigned Auditor, appointed by your Honorable
Court to take testimony in the above-captioned case, and re-
port an opinion thereon, respectfully reports as follows:
HISTORY OF THE CASE
The First and Final Account and Statement of Pro-
posed Distribution for the present estate were filed April 6,
1979, by attorney Richard McCoy on behalf of the estate's ad-
ministrator, William L. Kennedy, Jr. Written objections to the
final account, attached hereto as Exhibit "A", were filed by
Shirley Kennedy Gochenour on June 4, 1979. Under order of
Court dated October 23, 1979, and attached hereto as Exhibit
"B", Joseph P. Alexa, Esquire, was appointed Master. The
Master's acceptance of his appointment is attached hereto as
Exhibit "C".

During the proceedings in this case the exceptant,
Shirley Kennedy Gochenour, was not represented by private
counsel. The Auditor had several telephone discussions with
both parties during the period October through December, 1979,
to determine whether there could be an amicable settlement
between the parties. A hearing on the exceptions was then
scheduled for January 23, 1980. A copy of the notice for this
hearing is attached hereto as Exhibit "D". The hearing could
not be held as scheduled due to the illness of the Court Re-
porter and the hearing was rescheduled for January 30, 1980.
A copy of the notice for the rescheduled hearing is attached
hereto as Exhibit "E".
At the request of the exceptant, the estate's
checking account records and bank statements were delivered
to the Auditor prior to the hearing. These documents were
examined by the exceptant at the office of the Auditor on
January 29, 1980. The exceptant, Shirley Kennedy Gochenour,
determined to withdraw her exceptions to the estate's account
and her written statement to this effect is attached hereto as
Exhibit "F". The withdrawal of the exceptions was based on
the following three conditions: 1. that $400.00 be deposited
to the estate's account to reflect the $400.00 in cash
allegedly received by the administrator from the sale of the
decedent's automobile; 2. that the Social Security death benefit

for $255.00 be applied for and deposited in the estate's
account; and 3. that canceled checks be produced establishing
that the estate's bills with Baughman Memorial Works (for
$220.00) and South Side Hospital of Pittsburgh (for $144.00)
were actually paid.
At the hearing on January 30, 1980, the estate's
administrator, William L. Kennedy, Jr., agreed to the fore-
going conditions. The exceptant, Shirley Gochenour, did not
attend the hearing. Subsequently, the Auditor received a
copy of a deposit slip from Richard McCoy, Esquire, indicating
that $400.00 had been deposited with the estate's account at
Southern Pennsylvania Bank on February 2, 1980. A copy of the
deposit slip is attached hereto as Exhibit "G". Copies of can-
celed estate checks to Baughman Memorial Works and South Side
Hospital were also submitted and are attached hereto as Exhibit
"H". Finally, the estate's Second and Final Account, attached
hereto as Exhibit "I", indicates, on page 2, that the Social
Security Death Benefit for $255.00 was deposited to the estate's
account.
Since all conditions of the amicable settlement have
been complied with, the undersigned Auditor respectfully requests
the Court to enter an order vacating his commission and approving
an attorney's fee of $75.00 to be paid by the estate.

As an heir to the Estate of my father William L. Kennedy, I Shirley
Kennedy Gochenour here by object to the First And Final account of his
Estate that has been compiled by my brother William L. Kennedy Jr.,
Administrator.
Listed below are my objections:
1. My brother William L. Kennedy Jr. sold my fathers 1958 Ford Fairlane
for $800.00 the purchaser gave my brother Dean P. Kennedy a check for
$400.00, then gave him $400.00 in cash. The money transaction was
handled by my brother Dean, the title transaction by my brother William
Jr., Administrator, the $400.00 in cash was split by my brothers William
Jr. and Dean.
To the best of my knowledge the check for $400.00 was handed over
to the Estate.
As of this writing the $400.00 in cash has not been paid to the
Estate.
2. In all my research I can in no way find out if the $255.00 Allotment
allowed by Social Security has been applied for. If the Social
Security Allotment has been applied for and paid it is not shown in
the First And Final Account. Since you have two years to apply for
Social Security Allotment. I believe there may have been a plan to
apply for it as soon as the Estate is settled.
3. As you will notice in the First And Final Account there is a Disbursement
for $88.36 to Dellingers Auto-Body. Enclosed is a copy of the original
bill. You will notice a difference of $12.04. If my brother Dean P.

Kennedy is owed $12.04 for Parts he purchased for the 1958 Ford, he
should have submitted a bill to the estate when the executors notice
was published in the newspaper. Since he did not in any way purchase
the parts for Dellinger's auto Body, he should not have made an addition
to Nr. De Hinger bill.
4. Why was my brother allowed to take it upon himself to spend $220.00
for cemetary marker without consulting the other four of us? Since, my
father was a Veteran, a cemetary marker could have been obtained from
the Veterans Administration and the only charge to the estate would have
been for shipping.
Since, forty dollars was taken out of the estate to bond my brother
and then one-hundred and seventy five dollars paid to him for settling
the estate. I feel this is quite unjust to not only me, but all the other
heirs.
