Dear Ms. Strasbaugh:
As you will recall, at the hearing yesterday, Paul Haut, proponent of the document claimed to be
a Will of his mother, offered testimony that the decedent was registered to vote in Cumberland
County. Your Honor granted leave for documentation relating to this alleged registration to be
submitted through today.
Immediately following the hearing, my client Henry Henson and I went to the Offices of the
Board of Elections of Cumberland County. While there, we spoke with various staff members,
including Lorie L. Wagner. Ms. Wagner and other staff members produced for us a copy of a
voter registration for Agatha R. Haut, which occurred in the year 1991. The document indicates
that Ms. Haut voted in primary and November elections in 1992 and 1993 and the primary
election in 1994. It indicates further that she was removed in the "federal purge" (she was
deleted in the "federal purge") on February 26,2001. The notation relating to the same is on the
first page of the documentation as "DUFP." As Your Honor may recall and as was noted by the
personnel of the Board of Elections with whom we spoke, the election law holds that if one does
not vote through the time of two federal elections, they are subject to the "two federal election
cycle removal." Since the records indicated that Ms. Haut voted in neither the federal election of
1996 nor the federal election of 2000 nor at anytime in between, she was removed February 26,
2001.
Ms. Wagner also indicated to Mr. Henson and me that the Cumberland County Board of
Elections is now participating in the statewide computer based election registration network. She
also indicated that she called up the name of Agatha R. Haut while we were present and saw that
she had been registered in Franklin County with a residence at 1601 Lindsey Lot Road and that
this registration was cancelled September 26,2005, because of death notification.

Because of other commitments, I am unable to travel to the Board of Elections of Franklin
County today, but I spoke with a staff member of their Elections Board this morning and made
arrangements for Mr. Henson to visit there today and obtain a copy of the Franklin County
records for us. These records (two pages with hand printed information) are included herewith
as well. They indicate, as I was told by the Franklin County staff on the telephone, that Ms. Haut
was registered in Franklin County on October 18, 2000, and was removed because of notification
of death on September 26,2005.
As Your Honor will recall, I objected to evidence of past registration in Cumberland County,
because such registration from the early 1990's is not probative of residence in 2005. With the
availability ofthe Franklin County records, the matter does become relevant. It shows that
Ms. Haut considered herself a resident in Franklin County as of 2000 and that she remained on
their records through September 2005.
If Your Honor deems it necessary, my client will subpoena the election officials from Franklin
and Cumberland Counties to appear at a continued hearing. As a member of the Bar of the
Supreme Court of the Commonwealth of Pennsylvania and, accordingly, as an officer of the
court, I hereby attest, however, the above information is a true and accurate summary of that
which was communicated to Mr. Henson and me following the hearing yesterday and to me by
the Franklin County official this morning.
