STIPULATION AGAINST LIENS
WHEREAS, Joshua D. Westhafer and Abby 1. Westhafer, of Pennsylvania, is about
to execute contemporaneously herewith, a contract with Michael Manning & Associates, a
Pennsylvania General Partnership of Cumberland County, Pennsylvania, for the erection of a
dwelling upon a lot ofland situate as follows:
ALL THAT CERTAIN piece or parcel ofland situate in the Township of East
Pennsboro, Cumberland County, Commonwealth of Pennsylvania, being more fully described as
follows:
BEGINNING at a point, said point being located on the dedicated right-of-way line
of Golfview Drive at the dividing line of Lot No. 76 and Lot No. 77; thence by the same, North II
degrees 05 minutes 58 seconds West, a distance of 180.97 feet to a point on the dividing line of Lot
No. 75 and Lot No. 77; thence by the same North 79 degrees 03 minutes 07 seconds East, a distance
of156.00 feet to a point on the dividing line of Lot No. 95 and Lot No. 77; thence by the same South
10 degrees 56 minutes 53 seconds East, a distance of70.34 feet to a comer common to Lot No. 95,
Lot No. 78 and Lot No. 77; thence by the same South 17 degrees 32 minutes 55 seconds West, a
distance of 150.00 feet to a point on the dedicated right-of-way line of Golfview Drive; thence by
the same by a curve to the left having a radius ofl75.00 feet, an arc distance of87.50 feet to a point,
the Place of BEGINNING.
BEING Lot No. 77 as shown on the Final Subdivision Plan of Hickory Ridge, Phase
III - Revised, said plan recorded in Plan Book 88, Page 88.
CONTAINING 16,392.00 square feet.
UNDER AND SUBJECT to all easements of record.
NOW, the \'; 0> day of November, 2005, at the time of and immediately before
the execution of the principal contract, and before any authority has been given by the said Joshua
D. Westhafer and Abby L. Westhafer to the said Michael Manning & Associates, a Pennsylvania
General Partnership to commence work on the said building, or purchase materials for the same in
consideration of the making of the said contract with Michael Manning & Associates, aPennsylvania
General Partnership and the further consideration of One Dollar, to Michael Manning & Associates,
a Pennsylvania General Partnership paid by Joshua D. Westhafer and Abby L. Westhafer it is agreed
that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of
the material men or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection of said building, the right to file such liens being
expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
