9. Noticc ofIntention to Foreclosc and a Notice of Homeowners' Emergency M0l1gage Assistance has
bcen sent to Defendant by certitled and regular mail, as rcquired by Act 160 of 1998 of the
Commonwealth of Pennsylvania, on the date(s) set forth in the true and correct copy of such notice(s)
attached hereto as Exhibit "B". The Defendant has not had the required face-to-face meeting within the
required timc and Plaintiffhas ilO knowledge of any such mceting being requcsted by the Defendant
through the Plaintin~ the Pennsylvania Housing Finance Agency, or any appropriate Consumcr Credit
Counseling Agency.
WHEREFORE, Plaintiff demands a de terris judgmcnt in mortgage foreclosurc in the sum of $137,168.99,
together with interest at the rate of $31.43. per day and other expenses costs and charges incurred by the
Plaintiff which are propcrly chargeable in accordance with the terms of the Mortgagc and Pennsylvania law

Shippensburg, PA [7257-9425, who is the mortgagor and real owner of the mortgaged prcmises
hereinafter described.
3. On April [4,2000 mortgagor made, cxecuted and delivered a mortgage upon the premises hercinafter
described to AMERICA'S WHOLESALE LENDER, which mortgage is rccorded in the Office of the
Recorder oC Deeds of Cumberland County as Book: 1607, Page: 14. The Mortgagc and assignment(s)
are matters ofpub[ie rccord and arc incorporated by this reference in accordance with Pennsylvania Rule
of Civil Procedure 1 019(g); which Ru[e rclieves the Plaintiff from its obligation to attach documents to
pleadings if those documents arc matters of public record.
4. The Property subject to the Mortgage is more fully described in the legal description set forth as Exhibit
"A" ("Property").
5. The mortgage is in default becausc the monthly payments of principal and interest are due and unpaid
tor July 01,2005, and each month thereafter and by the terms of the Mortgage, upon dcfault in such
payments for a period of one month, the entire principal balance and all interest due and other charges
are due and collectible.
6. The following amounts are due to PlaintiCfon the Mortgage:

than the amount demanded based on work actually performed. The Attorney's Fces request cd are in
conformity with the Mortgage and Pennsylvania law, Plaintiff reserves its right to collect Attorney's
fees of up to 5% of the remaining principal balanec in the evcnt the Property is sold to a third party
purchaser at Shcrifrs Sale or if the complexity of the action requires additional fees in excess oCthe
amount demanded in the Action.
8. Plaintiff is not seeking a judgment of personal liability (or and "in personam" judgmcnt) against the
Defendant in this Action but reserves it's right to bring a scparate Action to establish that right, ifsuch
right exists. If Defendant has receivcd a discharge of their personal liability in a Bankmptcy proceeding,
this Action of Mortgagc Foreclosure is, in no way, an attempt to re-establish the pcrsonalliability that
was discharged in Bankruptcy, but only to Coreclose the MOltgage and sell thc Property pursnant to
Pennsylvania law.

The parties to this Stipulation, Plaintiff; Country'\\'ide Home Loans, inc. ilkla America's
Wholesale Lender ("Plaintiff"), and defendant, Christopher G. Delcampo ("Defendant"), do hereby
state:
'WHEREAS, Plaintiff commenced this mortgage: foreclosure action by filing a complaint
against Defendant on November 28, 2005; and
WHEREAS, the property that is the subject of this action is louted at 395 Peiper Road.
Shippensburg. P A 17257 (the "Property"); and
WHEREAS) Defendant did not respond to the complaint; and
WHEREAS, Plaintiff entered a default judgment against Defendant on February 1, 2006; and
WHEREAS, Plaintiff thereafter scheduled the Property to be sold at the June 7, 2006
Cumberland County Sheriff s sale; and
WHEREAS, on June 6, 2006, Defendant had wired funds to Plaintiff in an amount suffic,ient to
prevent the Property from being sold at Sheriff s sale; and

WHEREAS, as a result, the Property should have been removed from the Sheriff's sale list; and
\VHEREAS. due to a miscommWlication between Plaintiff and its cOWlsel, the Property was
sold to Plaintiff at said Sheriff's sale; and
WHEREAS, the parties bave reached a settlement of tlus matter;
MU NOW, it is hereby stipulated and agreed by and between the undersigned as follows:
1 The Sheriff's sale of the Property shall be set aside.
2. Plaintiff shall bear all costs associated with filing and presenting this Stipulation.
3. This Stipulation may be executed in counterparts, each of which shall be
considered an original.
4. lbis Stipulation is effective upon execution.
