DECLARATION OF TAKING
North Middleton Authority, by its attorneys, Broujos & Gilroy, P.C., sets forth the following:

North Middleton Authority (NMA) is a Municipal Authority incorporated pursuant to
appropriate action of the Board of Supervisors of the Township of North Middleton,
Cumberland County, Pennsylvania, and is existing under the laws of the Commonwealth of
Pennsylvania and is governed by the Municipal Authorities Act of 1945, as amended and
supplemented, and has a current mailing address of 240 Clearwater Drive, Carlisle,
Pennsylvania.

Edward A. Lepard (hereinafter referred to as the "Condemnee") is an adult individual
residing at 1180 Newville Road, Carlisle, North Middleton Township, Cumberland County,
Pennsylvania.

The Condemnee is the owner by Fee Simple Deed and by a separate Quit-Claim Deed two
tracts of ground located at 1180 Newville Road, Carlisle, North Middleton Township,
Cumberland County, Pennsylvania, a description of which are attached hereto and marked
Exhibits "A" and "B".

NMA, the Condemnor in these proceedings, is authorized to exercise the power of
Eminent Domain pursuant to 53 P.S. Section 5601 et seq. and in accordance with the
Eminent Domain Code, 26 P.S. Section 1-101 et seq.

This condemnation proceeding was authorized by appropriate action of the Board of
NMA adopted at its regularly scheduled meeting on October 17, 2005. The record of said
meeting may be examined by the review of the minutes of the meeting, which minutes
may be found at the office of NMA located at 240 Clearwater Drive, Carlisle,
Cumberland County, Pennsylvania.

The purpose of condemnation is to construct a sewage collection line.

The property which is being condemned consists of a 5 foot wide temporary Construction
Easement extending approximately 85 feet on the southern boundary line of the land of
the Condemnee described in paragraph 3 above and noted on Exhibit "A", along with a
General Utility Easement along a paper alley on property purchased by Condemnee via a
Quit-Claim Deed as described in paragraph 3 above and noted on Exhibit "B", which
General Utility Easement is approximately 7 feet wide and 80 feet long. Said Easements
are as shown on the attached Exhibit "C".

The nature of title acquired by NMA shall be a permanent Utility Right-of-Way and a
temporary Construction Easement along with the general right for ingress and regress for
purposes of maintenance and repair of mentioned sewer line which will be constructed
within the Utility Easement.

A written legal description of the general Utility Easement and ternporary Construction
Easement area is as set forth on the attach Exhibit "D".

A plan showing the condemned property and a plan showing the entire sewage collection
line project may be inspected at the offices of NMA at 240 Clearwater Drive, Carlisle,
Curnberland County, Pennsylvania upon reasonable request by the Condemnee or his
designated agents.

Just Compensation to the Condemnee has been offered by NMA to the Condemnee and is
secured by the filing of a Bond without surety in accordance with the Eminent Domain
Code, 26 P.S. Section 1-403.

($112.000.00), in hand paid, the receipt whereof is hereby acknowledged, ttle said Grantor do
hereby grant and convey to the said Grantee, his heirs and assigns:
ALL THOSE CERTAIN two certain tracts of land with the improvements thereon erected
situated in North Middleton Township, Cumberland County, Pennsylvania bounded and
described as follows:
TRACT I: BEGINNING at a point in the South Side of the Newville~Carlisle Road,
Pennsylvania Highway Route #641 at corner of lands of Francisus; thence in a Southerly
direction along the Francisus land 182 feet to the Northern side of an alley; thence by the
Northern side of said alley in a Westerly direction 75 feet to an iron pin; thence by other land
retained by Grantors in a Northerly direction 182 feet to the South Side of said Road; thence
the South Side of said road in an Easterly direction 75 feet to the place of BEGINNING.
BEING the same premises which Richard W. Collins and Mildred P. Collins, his wife, by
their dated May 31, 1962 and recorded in the Office or the Recorder of Deeds in and for
Cumberland County in Deed Book 0, Volume 20, Page 981, granted and conveyed unto
Anthony Gromack and Marie E. Gromack, his wife. Anthony Gromack died January 6, 1986
thus vesting full fee simple title in Marie E. Gromack, grantor herein.
TRACT 2: nEGINNING at a point on the Soulh side of the Newville-Carlisle Road,
Penna. Highway Route No. 641, at the Northwest corner of land heretofore conveyed to the
within Grantees, which point of beginning is 75 feet West of land of Franciscus; thence in a
Southerly direction along said other 1000nd of the within Grantees, a distance of 182 feet 10 the
Northern side of an alley; thence by the Northern side of s<lid <lUey in a Westerly direction, a

of BEGINNING.
CONTAINING 10 feet in front along the Southern line of the Newville-Carlisle Road and
extending Southwardly therefrom at an even width a distance of 182 feet to the North side of
an alley.
DEING the same premises which Richard W. Collins and Mildred P. Collins, husband and
wife, by their deed dated November 26, 1963, and recorded in the Office of the Recorder of
Deeds in and for Cumberland County in Deed Book at Volume 21, Page 199, granted and
conveyed unto Anthony Gromack and Marie E. Gromack, husband and wife. Anthony
Gromack died January 6, I986lhus vesting full fee simple title in Marie E. Gromack, grantor
herein.
And the said Grantor hereby covenant and agree that they will warrant specially the property
hereby conveyed.

Grantee, his heirs and assigns:
ALL THAT CERTAIN situate in North Middleton Township, Cumberland County.
Pennsylvania described as follows:
BEGINNING at a point which point is 182 feet from the South Side of the Newville-Carlisle
Road. Pennsylvania Route 641 and which point Is in lhe Southeast corner of other lands
conveyed by the herein grantor to the herein grantee referenced therein as an alley; thence
directly South 16 feet to the Southern side of the property previously referenced as an alley;
thence along the Southern side of the previously referenced alley in a Westerly direction 8.5
feet, more or less, to a point; thence in a Northerly direction 16 feet to a point in the
Southwest corner of land conveyed by the herein grantor to the herein grantee; thence along
the Southern boundary line of the property conveyed by the herein grantor to the herein
grantee in an Easterly direction 85 feet.
The premises herein conveyed being a tract of 16 feet by 85 feet and previously set forth as a
proposed alley behind the premises and adjoining said premises conveyed by the herein grantor
to the herein 2rantee by even date hereof.

GENERAL UTILITY EASEMENT

All that certain strip of land to be used as a general utility easement and being situated
along the north side of a 16 foot wide alley, in North Middleton Township, Cumberland
County, Pennsylvania, said strip of land extending in an easterly direction from lands of
Jay Snyder to lands of Terry and Patricia Arbegast, said strip of land being more
particularly bounded and described as follows:
Beginning at a point on the northern line of a 16 foot wide alley, said point being the
southwest corner of the grantor, said point also being a corner of lands of Jay Snyder;
thence along lands of Jay Snyder, North 02 degrees 50 minutes 22 seconds West a
distance of 7.03 feet to a point; thence crossing the lands of the grantor the two
following courses and distances: 1) North 86 degrees 16 minutes 40 seconds East a
distance of 70.35 feet to a point; 2) North 87 degrees 04 minutes 13 seconds East a
distance of 14,66 feet to a point on line of lands of Terry and Patricia Arbegast; thence
along lands of Terry and Patricia Arbegast, South 02 degrees 50 minutes 22 seconds
East a distance of 6.85 feet to a point on the northern line of 16 foot wide alley; thence
along the northern line of a 16 foot wide alley, South 86 degrees 17 minutes 25 seconds
West a distance of 85.00 feet to a corner of lands of William and Jennifer Ortmyer, the
point of beginning,
Area of Easement: 597 Sq. Ft. (0.014 Acres)
An additional 5 foot wide temporary construction easement exists along the northern
side of the above described easement as shown on a "Plan Of General Utility Easement
Over Lands Of Edward A. Lepard - 1180 Newville Road To Be Acquired By The North
Middleton Authority", prepared by D.L. Reiber Associates, Drawing No. 03078-019,
attached hereto and made a part of this description.

MOTION FOR WRIT OF POSSESSION
North Middleton Authority, by its Attorneys Broujos & Gilroy, P.c., set forth the following:
1. North Middleton Authority (NMA) is the Municipal Water and Sewer Authority for
North Middleton Township, Cumberland County Pennsylvania.
2. NMA is in the process of constructing a Sewage Collection Line within the area of
Newville Road located in North Middleton Township, Cumberland County,
Pennsylvania.
3. The construction of the mentioned Sewage Collection Line requires NMA to obtain
from Condemnee, Edward A. Lepard, a 5 foot wide by 85 foot long temporary
Construction Easement along the Southern boundary of the Condemnee's property
and a 7 foot wide by 85 foot long General Utility Easement along a Paper Alley to the
rear of Condemnee's property over which Condemnee claims an interest by virtue of a
Quit Claim Deed.
4. NMA is authorized to exercise the Power of Eminent Domain pursuant to 53 P.S.
Section 5601 et seq and in accordance with the Pennsylvania Eminent Domain Code, 26
P.S. Section 1-101 et seq.
5. NMA originally approached Mr. Lepard verbally and in writing requesting that he
sign a written Right-of-WaylEasement authorizing the mentioned temporary
Construction Easement and permanent General Utility Easement. Mr. Lepard denied
those requests.
6. Approximately 62 other l)roperty owners in the vicinity of the Lepard project who
have been requested to provide similar Right-of-Ways/Easements to NMA have
willingly signed those Right-of-Way documents for the nominal consideration of$I.OO.
7. In light of Mr. Lepard's unwillingness to execute a Right-of-Way document as
requested, NMA initiated Condemnation Proceedings against Mr. Lepad by virtue of
filing a Declaration of Taking with the Cumberland County Prothonoatry on
November 29, 2005, at the above term and number.
8. Pursuant to 26 P.S. Section 1-403, NMA filed a Bond with the Prothonotary, without
surety, to the Commonwealth of Pennsylvania for the use of Mr. Lepard, the condition
of which is that NMA shall pay such damages as shall be determined by law.
9. Notice of the initiation of the mentioned Declaration of Taking along with a copy of the
Declaration of Taking, a copy of the Bond and a copy of the Notice of Taking was
served on Mr. Lepard, said service being accomplished by the Cumberland County
Sheriff on December 9, 2005.
10. A survey of Mr. Lepard's property showing the proposed Right-of-WaylEasement
areas which are subject to the Declaration of Taking is attached hereto and marked
Exhibit "A".
II. Mr. Lepard filed Preliminary Objections to the Declaration of Taking on January 9,
2006. A copy of the Preliminary Objections are attached hereto and marked Exhibit
"B". Those Preliminary Objections have been listed for Argument with Argument
Court scheduled to take place February 15th.
12. Pursuant to 26 P.S. Section 1-407 and after the filing by NMA of a Praecipe for Writ of
Entry for Possession, the Cumberland County Prothonotary issued a Rule to Show
Cause on Condemnee, Edward A. Lepard, directiug that he show cause why a Writ of
Possession should not be issued. Pursuant to 26 P.S. Section 1-407(a) the Rule was
returnable five days after service.
13. The mentioned Rule to Show Cause was served on Condemnee, Edward A. Lepard, by
the Cumberland County Sheriff on January 13,2006.
14. Five days has elapsed from the date of service of the mentioned Rule to Show Cause
and Condemnee, Edward A. Lepard, has not filed any response to the mentioned Rule
to Show Cause.
15. The Condemnor, NMA, has previously tendered to Condemnee, Edward A. Lepard, an
offer to pay Just Compensation for the Condemnation, which Condemnor estimates to
be $1.00, said offer being set forth in a letter to Condemnee, Edward A. Lepard, of
copy of which is attached hereto and marked Exhibit "Coo.
16. Condemnee, Edward A. Lepard, has refused to deliver possession of Permit Right-of-
Entry to the Condemnee.
17. The Pennsylvania Eminent Domain Law 26 P.S. Section 1-407(a) provides in part as
follows:
"...the Prothonotary upon Praecipe of the Condemnor shall issue a Rule,
returnable within five days after service upon the Condemnee, to Show Cause
why a Writ of Possession should not issue, upon which the Court, unless
Preliminary Objections WARRANTING DELAY are pending, may issue a
Writ of Possession conditioned upon payment to the Condemnee or into Court
of such estimated Just Compensation and on such other terms as the Court may
direct". (Emphasis added)
18. It is the position of NMA that the Preliminary Objections filed by Condemnee, Edward
A. Lepard, are not such that they "warrant delay" of the Writ of Possession for the
following reasons:
a. The Eminent Domain Law at 26 P.S. Section 1-406(a) indicates that Preliminary
Objections shall be limited to the power or right of the Condemnor to
appropriate the condemned property, the sufficiency of the security, any other
procedure followed by the Condemnor or the Declaration of Taking.
Condemnee, Edward A. Lepard, has not raised any of these issues in his
Preliminary Objections.
b. The Preliminary Objections appear to suggest that the Condemnee, Edward A.
Lepard, objects to the potential mandatory connection of his residential
property to the Sewage Collection Line and the costs he may incur in connection
with said connection. The fact is that the NMA has not yet issued a Notice to
Connect to Condemnee, Edward A. Lepard, or to any other property owner
affected by construction of the Sewage Collection Line in question. The
obligation of Mr. Lepard and other property owners to connect to the Sewage
Collection Line and any costs that may be imposed on a property owner by
NMA with regards to the connection of the residential property to the Sewage
Collection Line are not issues currently before the Court and are more
appropriately litigated when and if any Notice of Connection is issued to Mr.
Lepard or any other property owner.
19. As mentioned, approximately 62 other property owners in the vicinity of the Lepard
property have already willingly signed Right-of-Way documents and the construction
project for the installation of the meutioned Sewage Collection Line is underway. Mr.
Lepard's refusal to executl, a Right-of-Way document and the delay associated witb
obtaining a Writ of Possession pursuant to tbese Condemnation Proceedings is causing
delays in connection with the construction project and will cause additional costs to be
associated with the construction project which costs must be borne by all of the users
of the North Middleton Authority Sewage Collection System.
20. The proposed taking of a 5 foot wide temporary Construction Easement on
Condemnee's property and the taking of a 7 foot wide General Utility Easement on a
Paper Alley over which Condemnee makes a claim pursuant to a Quit Claim Deed do
not constitute a dramatic intrusion in the ownership rights of the Condemnee or in the
use of his property by the Condemnee. Upon the completion of the construction, NMA
shall have the obligation of returning the Condemnor's land to the grading as
previously existed and to reseed the Condemnor's land. The sewer line in question will
be underground and, upon completion, there will be no visible evidence of the sewer
line on Condemnee's land or within the Paper Alley over which Condemnee asserts a
claim, except for a 26 inch manhole cover which will be surface level in the Paper
Alley.
WHEREFORE, Condemnor, North Middleton Authority, requests your Honorable Court to
issue a Writ of Possession as requested above.

I previously wrote to you on October 20, 2005, in my capacity as Solicitor for
North Middleton Authority (Authority), requesting that you cooperate with respect
to signing right-of-way documents relating to your property.
You called me on the telephone on October 21" and advised me that you would not
cooperate with the Authority in connection with this matter and that you had no
intention of signing any right-of-way documents.
Accordingly, the Authority has directed our office to proceed with the filling of
condemnation in connection with the requested right-of-way. We will be filing
those documents, and I believe the Cumberland County Sheriff will be contacting
you in connection with service of all of our mings.
In accordance with applic.able provisions of the Eminent Domain Code, the
Authority is required to offer "Just Compensation" to you prior to any filing.
Please accept this letter as the offer from the Authority to pay you $1.00 as Just
Compensation as it relates to the taking of a five foot temporary Construction
Easement on the southern end of your property and the taking of a permanent
eight foot wide Utility Easement within the sixteen foot alley immediately south of
your property for which you mayor may not have an interest. This offer of $1.00
is consistent with agreements the Authority reached with approximately 50 of your
neighbors in the area who signed the requested right-of-way documents.

OBJECTIONS OF CONDEMNEE EDWARD A. LEPARD
Condemnor, North Middleton Authority, by its attorneys, Broujos and Gilroy, P.c., sets forth
the following in response to the Preliminary Objections filed by Condemnee, Edward A.
Lepard:
1. The stated Preliminary Objections are not valid Preliminary Objections under the
law. Pursuant to 26P.S. Section 1-406(a), Preliminary Objections and
Condemnation Proceedings are limited to a challenge to the power or right of the
Condemnor to appropriate the condemned property, the sufficiency of the security,
any other procedure followed by the Condemnor, or the Declaration of Taking. The
Preliminary Objections filed by Condemnee do not raise any of these issues and are
not appropriate Preliminary Objections.
By way of further answer, Condemnor has not "demanded" any sums from
Condemnee, Edward A. Lepard, at this time. It is admitted that Mr. Lepard will
receive a Connection Notice at some point in the future. Mr. Lepard may challenge
the appropriateness of the Connection Notice at that point, and any objection with
respect to a potential future Connection Notice for the charges that may be assessed
by North Middleton Authority may not be appropriately challenged in connection
with the Condemnation Proceedings for the Right-of-Way in question.

Denied that the Condemnor has entered into any agreement with a railroad
associated corporation. Admitted that Condemnor has entered into an agreement
with DP Partners and, by way of further answer, said DP Partners has contributed
appropriate fees towards construction of the proposed sewer line. By way offurther
answer, the entering into of an agreement with another property owner in
connection with construction of the sewer line in question is not a valid Preliminary
Objection. By way of further answer, the Condemnor, North Middleton Authority,
notes that approximately 62 other property owners in the vicinity of Mr. Lepard's
property have signed Right-of-Way documents and granted at consideration of
$1.00 or nominal consideration a Right-of-Way to North Middleton Authority
identical to the Right-of-Way taken by North Middleton Authority on Mr.
Lepard's land in this Condemnation Proceeding.
WHEREFORE, North Middleton Authority respectfully requests that the
Preliminary Objections filed by Defendant, Edward A. Lepard, be dismissed.

Condemnor, North Middleton Authority, by its attorneys, Broujos & Gilroy, P.c., sets forth
the following:

The Declaration of Taking (Declaration) filed in the above matter suggested at paragraph 7
that Condemnor was taking a 5 foot wide temporary Construction Easement and a 7 foot
wide permanent General Utility Easement over property owned or claimed to be owned by
Condemnee, Edward A. Lepard.

Condemnor desires to amend the Declaration of Taking by amending the area over whicb a
general Utility Easement is being taken. The Condemnor desires to take a 5 foot wide
temporary Construction Easement and an approximately 23 foot wide permanent General
Utility Easement as shown on the attached Exhibit "A" and the legal description for which is
shown on attached Exhibit "B".

The permanent General Utility Easement will consist of the original 7 feet on land owned by
the Condemnee Edward A. Lepard pursuant to Fee Simple Deed as noted on Exhibit "A" of
the Declaration, and the remaining ]6 feet for the permanent General Utility Easement is over
a Paper Alley located immediately behind property of Condemnee Edward A. Lepard but for
which Edward A. Lepard claims legal title pursuant to a Quit Claim Deed as noted on Exhibit
"B" of the Declaration.

The amended area of taking does not materially affect the original Declaration in that it is
only an extension of the area of the permanent General Utility Easement over the entire
16 foot Paper Alley which is behind Condemnee Edward A. Lepard's property. A copy of
the sketch for the original Taking is attached hereto and marked Exhibit "C".
WHEREFORE, Condemnor requests yonr Honorable Court to enter a Rule upon
Condemnee to Show Cause as to why the area of the Declaration of Taking should not be
amended as set forth herein.

NORTH MIDDLETON AUTHORITY
All that certain strip of land to be used as a general utility easement, said strip including
a 16 foot wide alley and a portion of land on the north side of said 16 foot wide alley. in
North Middleton Township, Cumberland County, Pennsylvania, said strip of land being
more particularly bounded and described as follows:
Beginning at a point on the southern line of a 16 foot wide alley, said point being the
southwest corner of the grantor; thence crossing a 16 foot wide alley and along a
portion of lands of Jay Snyder, respectively, North 02 degrees 50 minutes 22 seconds
West a distance of 23.03 feet to a point; thence crossing the lands of the grantor the two
following courses and distances: 1) North 86 degrees 16 minutes 40 seconds East a
distance of 70.35 feet to a point; 2) North 87 degrees 04 minutes 13 seconds East a
distance of 14.66 feet to a point on line of lands of Terry and Patricia Arbegast; thence
along a portion of lands of Terry and Patricia Arbegast and crossing a 16 foot wide alley,
respectively, South 02 degrees 50 minutes 22 seconds East a distance of 22.85 feet to a
point on the southern line of said 16 foot wide alley; thence along the southern line of a
16 foot wide alley, South 86 degrees 17 minutes 25 seconds West a distance of 85.00
feet to the point of beginning.
Area of Easement: 1,957 Sq, Ft. (0.045 Acres)
An additional 5 foot wide temporary construction easement exists along the northern
side of the above described easement as shown on a "Plan Of General Utility Easement
Over Lands Of Edward A. Lepard - 1180 Newville Road To Be Acquired By The North
Middleton Authority", prepared by D.L. Reiber Associates, Drawing No. 03078-019A.
