Royal Bank America, formerly known as Royal Bank of Pennsylvania ("Royal Bank") is a banking institution with an address of 401 Fairmount Avenue, Philadelphia, PA 19123. 2. Upon information and belief, Ahmad Mohmand and Jeannie Bo Yo Mohmand are husband and wife, who along with Javid Mohmand are all adult individuals who reside at 817 Meadow Lane, Camp Hill, P A 170 II. . On or about September 14,1999, in consideration of monies lent, Ahmad Mohmand and Javid Mohmand ("Borrowers") executed and delivered to Crusader Bank ("Crusader") a note in the original principal sum of $152,000 (the "Note"). A true and correct copy ofthe Note is attached hereto as Exhibit "A". 4. In order to secure their obligations under the Note, Borrowers executed and delivered to Crusader a mortgage (the "Mortgage") on certain real property located 817 Meadow Lane, Camp Hill, P A 170 II (the "Property"), which Mortgage is recorded in the Office of the Recorder of Deeds Office for Cumberland County as Mortgage Book 1571, Page 94 et seq. A true and correct copy of the Mortgage is attached hereto as Exhibit "B". 5. At the time the Borrowers executed the Mortgage, Borrowers were the owners of the Property. 6. A description of the Property covered by the Mortgage is attached hereto as Exhibit "C". 7. On or about December 4, 2002, the Note and Mortgage were assigned to Royal Bank of Pennsylvania ("Royal Bank"). Royal Bank is the current holder of the Note and Mortgage. A true and correct copy of the assignment is attached hereto as Exhibit "D". 8. Subsequently, Javid Mohmand executed a quit claim deed for his interests in the Property. 9. The current and real owners of the Property are the Borrowers, Ahmad Mohmand and Jeannie Bo Yo Mohmand, as husband and wife. 10, Borrowers have defaulted on their obligations to Royal Bank pursuant to the terms of the Note and Mortgage by virtue of various events, including without limitation, failing to make payment as and when due. - 3 - . As a result of Borrowers' default, the following amounts are immediately due and payable under and in connection with said Note and Mortgage as of November 21,2005: Principal Interest as of 11/21/05 Late charges Fee balance Estimated Attorney's Fees TOTAL $145,763.52 $ 4,886,67 $ 204.30 $ 1,733,13 $ 1.200,00 $153,587.62 Interest continues to accrue from November 21, 2005, at the per diem rate of $41.50. 12. Pursuant to the terms of the Note and Mortgage, the Bank is entitled to recover all reasonable costs and expenses of suit including, but not limited to reasonable attorneys' fees. As set forth above, at this time, the attorneys' fees are estimated to be $1,200.00. The Bank is entitled to recover reasonable attorneys' fees it incurs in excess of$I,200.00. 13. The notice requirements of 35 P.S. ~1680.403(c) ("Act 91") have been complied with, true and correct copies of the Act 91 Notice are attached hereto as Exhibit "E". The notice requirements of 41 P.S. ~403(a) ("Act 6") are not applicable. - 4- . Those expenses include, for example, reasonable attorneys' fees. 7. GIVING OF NOTICES Unless applicable law requires a different method, any nolice that must be given to me under this Note will be given by delivering it or by mailing it by first class mail to me at the Property Address above or at a different address if 1 give the Note Holder a nolice of my different address. Any notice that must be given to the Note Holder under this Note will be given by mailing it by first class mail to the Note Holder at the address stated in Section 3(A) above or at a different address if I am given a notice ofiliat different address. 8. OBLIGATIONS OF PERSONS UNDER THIS NOTE If more than one person signs this Note, each person is fully and personally obligated to keep all of the promises made in this Note, including the promise to pay the full amount owed. Any person who takes over these obligations, including the obligations of a guarantor, surety or endorser of this Note, is also obligated to keep all of the promises made in this Note. The Note Holder may enforce its rights under this Note against each person individually or against aU of uS together. WAIVERS I and any other person who has obligations under this Notewaivethe rights of presentment and notjce of dishonor. "Presentment" means the right to require the Note Holder to demand payment of amounts due. "Notice of dishonor ' means the right to require the Note Holder to give nmice to other persons that amounts due have not been paid. 10. UNIFORM SECURED NOTE This Note is a uniform instrument with limited variations in some jurisdictions. In addition to the protections given to the Note Holder under this Note, a Mortgage, Deed of Trust or Security Deed (the "Security Instrument"). dated the same date as this Note, protects the Note Holder from possible losses which might result in do not keep the promises which I make in this Note. That Security Instrument describes how and under what conditions I may be required to make immediate payment in full of aU amounts I owe under this Note. Some of those conditions are described as follows: Transfer of the Property or a Beneficial Interest in Borrower.
