Eppley, Jr., Executor of the Estate of Catherine M. Eppley, Deceased, having been duly filed and advertised according to law and rules of court, and that said Account was duly confirmed and said Schedule of Proposed Distribution duly approved by this Court on November 22,2005; and it further appearing that said Executor has proposed in said Schedule of Proposed Distribution to distribute certain of Decedent's interest in real estate in kind to himself as named beneficiary by devise specified in Paragraph 3 of Decedent's Last Will and Testament, and said Court having decreed distribution in accordance with said Schedule of Proposed Distribution; IT IS ORDERED, ADJUDGED AND DECREED that all right, title and interest of the said Catherine M. Eppley, Deceased, in and to the below described real estate, which said right, title and interest, being an undivided one-half interest therein, is hereby awarded in fee simple to Robert M. Eppley, JI.: ALL THA T CERTAIN piece, parcel or tract ofland situate in the Township of Stewardson, County of Potter, Commonwealth of Pennsylvania, more particularly bounded and described pursuant to a survey by Manley C. Ackerman, R.S., dated August 3, 1979, as follows: BEGINNING at a point in land now or formerly of Floyd H. Weary, Blaine L. Shatto, John E. Suffel and Robert Books, which point is South 45 degrees 11 minutes 58 seconds West 146.82 feet from the Northeast corner of said land of Messrs. Weary, Shatto, Suffel and Books herein, which corner is in line of State Forest lands; thence South 45 degrees 11 minutes 58 seconds G~ r West 790.0 feet to a point; thence continuing by land of Messrs. Weary, Shatto, Suffel and Books herein, North 16 degrees 51 minutes 35 seconds West 125 feet to a point; thence continuing by land of Messrs. Weary, Shatto, Suffel and Books herein, North 53 degrees 47 minutes 06 seconds East 739.72 feet to a point, the Place of BEGINNING. CONTAINING 1.00 acres ofland. TOGETHER with the right of ingress and egress to the Grantees herein, their heirs and assigns, in common with the Grantors herein, their heirs and assigns, over that portion of an unimproved private drive situate west of the within premises and lying within an extension of the northern and southern boundaries of the within tract to the centerline of Pennsylvania Route No. 44. BEING the same premises which Robert M. Eppley and Catherine M. Eppley, his wife, by their Deed dated January 16, 1989 and recorded January 23,1989 in the Office of the Recorder of Deeds in and for Potter County, Pennsylvania in Deed Book 229, Page 849 granted and conveyed unto Robert M. Eppley, Jr. and Catherine M. Eppley as tenants in common. IT IS FURTHER ORDERED AND DIRECTED that a certified copy of this Decree shall be recorded in the Office of the Recorder of Deeds in and for Potter County, Pennsylvania, among the deeds recorded in said Office, said Decree to be indexed in the Grantor Index for Deeds against the Estate of Catherine M. Eppley, Deceased, and in the Grantee Index for Deeds to Robert M. Eppley, Jr., pursuant to Section 3536 of the Decedents, Estates and Fiduciaries Code (20 Pa. C.S.A.. ~3536). BY THE COURT: J.
