I. The Petitioners are citizens and qualified electors of New Cumberland Borough, of
Cumberland County, Pennsylvania.
2. A municipal election ("general election") was held therein on November 8, 2005 for the
office of Borough Council, New Cumberland Borough.
3. Upon information and belief which they consider reliable, Petitioners aver that fraud or error,
although not manifest on the general return of votes made therefrom, was committed in the
canvassing of the votes cast on the ballot in said Election Precinct.
4. The vote scanner system has a history of miscounting votes, In this very month of November
of2005, in Cumberland County, a District Judge election was deemed to be more than 190
votes in error. For the 2001 primary election 25% of the precincts had to be recounted,
including New Cumberland 2W, 3P. In the Republican count tliere, error was found with
three votes that were miscounted, making up approximately 1.2% of the total there. In this
2005 municipal election for New Cumberland Borough Council the margin between
victory and defeat is half that, .6 of 1% of the total votes cast. A hand count would ensure an
accurate and fair election result.
5, Your Petitioners believe that the return of votes of said election precincts is a false return
and untrue.
6, This petition for a recanvass of the votes of said election district is being filed pursuant to 25
P.S. 3261.
WHEREFORE, Petitioners pray that your Honorable Court enter an Order directing the
recanvassing of tlie vote by a hand count in the said Election Precinct, appointing a time
and place for the proposed recanvass of the votes in said Election Precinct, that notice of
the time and place of the proposed recanvass be given by registered mail to each candidate
whose name appears on the ballot for the office of Borough Council of New Cumberland
Borough.

REPORT OF THE CUMBERLAND COUNTY BOARD OF ELECTIONS
MOTION FOR CONFIRMATION OF RECANV ASS OF VOTES
And now comes, the Cumberland County Board of Elections through its Solicitor,
Edward L. Schorpp, Esquire, and states the following:
1. This matter concerns the 2005 election for the office of Borough Council for New
Cumberland Borough, Cumberland County, Pennsylvania.
3. Petitioner filed a Petition for recanvass accompanied by a deposit of cash or
security pursuant to section 3261 of the Election Code, 25 P.S. 3261, in the total amount of
$200.00.
4. The Court entered an Order on December 2,2005, directing the Board of
Elections to conduct a recount for the office of Borough Council of New Cumberland Borough,
Cumberland County, Pennsylvania.
5. The time and place of the recanvass was set for 9:00 a.m., December 8, 2005, at
the Cumberland County Board of Elections, 37 E. High Street, Carlisle, PA.
6. All candidates for the office of Borough Council for New Cumberland Borough
received Notice of the time and place of the recanvass.
7. The official canvass of the Return Board that were on display were as follows:

8. The recanvass was conducted as scheduled.
9. In New Cumberland 1 W, 1P, New Cumberland 2W, IP and New Cumberland
2W, 3P the total votes cast per precinct and total votes received by each candidate remained the
same.
10. New Cumberland, 2W, 2P results changed during the hand count/electronic
scanner count because a straight Republican ballot was marked lightly. When included in the
vote totals, each Republican candidate received one (1) more vote than indicated on the official
results. The total of 511 votes cast remained the same.
11. Listed below are the updated results from the court ordered hand count/electronic
scanner count.

12. The recount did not change the vote differential between the fourth and fi fth
place candidates, to wit, 12 votes, and did not change the outcome of the Election.
13. The recount did not reveal fraud or substantial error, nor did it affect the res lIlts
of the election for New Cumberland Borough Council.
l4. In accordance with Section 3261(e) of the Election Code, 25 P.S. 3261(e), upon
certification of the court that fraud or substantial error was not discovered, the Protlionotary shall
pay the sum deposited with him to the County Treasurer.
WHEREFORE, the Cumberland County Board of Elections prays that this Honorable
Court:
(a) Direct that the sum deposited by Petitioner pursuant to Section 3261 of the
Election Code, 25 P.S. 3261 be paid to the County.
(b) Direct the Board ofE1ections to certify the election for the office of Borough
Council for the Borough of New Cumberland, Cumberland County, Pennsylvania,
according to the recount results set forth in Paragraph No..11 above.

9. In New Cumberland I W, IP, New Cumberland 2W, IP and New Cumberland
2W, 3P the total votes cast per precinct and total votes received by each candidate remained the
same.
lO. New Cumberland, 2W, 2P results changed during the hand count/electronic
scanner count because a straight Republican ballot was marked lightly. When included in the
vote totals, each Republican candidate received one (I) more vote than indicated on the official
results. The total of 511 votes cast remained the same.

12. The recount did not change the vote differential between the fourth and fifth
place candidates, to wit, 12 votes, and did not change the outcome of the Election.
13. The recount did not reveal fraud or substantial error, nor did it affect the results
of the election for New Cumberland Borough Council.
14. In accordance with Section 3261(e) of the Election Code, 25 P.S. 3261(e), upon
certification of the court that fraud or substantial error was not discovered, the Prothonotary shall
pay the sum deposited with him to the County Treasurer.

WHEREFORE, the Cumberland County Board of Elections prays that this Honorable
Court:
(a) Direct that the sum deposited by Petitioner pursuant to Section 3261 of the
Election Code, 25 P.S. 3261 be paid to the County.
(b) Direct the Board of E]ections to certify the election for the office of Borough
Council for the Borough of New Cumberland, Cumberland County, Pennsylvania,
according to the recount results set forth in Paragraph NO.ll above.
