COMPLAINT IN MORTGAGE FORECLOSURE
Plaintiff, Citizens Bank of Pennsylvania. by its attorneys. Silverman Bernheim & Vogel.
files the within complaint in mortgage foreclosure and represents as follows:
I. Plaintiff, Citizens Bank of Pennsylvania. ("Citizens"). is a state chartered
banking institution with a place of business at 801 Market Street. Philadelphia, PA 19106.
2. Defendants, John Ivanoff and Cynthia Ivanon; ("Defendants"), are adult
individuals who reside at 322 West Perry Street, Enola, PA 17025.
3. Defendants are the owners of reeord of a certain parcel of residential real estate
located in Cumberland County known by the following street address: 322 West Perry Street,
Enola, P A 17025 (the "Property").

4. On April 10, 1996, Defendants executed and delivered to Mellon Bank.
N.A.("Mellon"), assignee to Citizens Bank of Pennsylvania ("Citizens"), a Promissory Note
(the "Note") in the principal amount of $56,325.00. Thc Note was secured by a mortgage (the
"Mortgage") granting a lien upon the Property which was executed by Del"endants. and given to
Mellon on the same date and duly recorded in thc Office ofthc Recordcr of Decds. Cumberland
County, Pennsylvania on April 12. 1996. in Land Record Book 1313, page 610 ct SCq. True and
correct copies of the Note and Mortgage are attached hereto as Exhibits "}\" and "13:'
respectively, and incorporated herein by reterence.
5. On December 1.2001, Mellon assigned its rights in the Note and Mortgage to
Citizens and said Assignment was recorded on January 10,2002 in Land Rccord Book 687.
page 4012.
6. The Cull legal description of the Property is set forth in Exhibit "C" which is
attached hereto and incorporated herein by reference.
7. Defendants defaulted under the terms of the Note and Mortgage by virtue of
their failure to pay to Citizens the sums due and owing thereunder. whereby Citizens dcmanded
complete payment and performance of all orthe Defendants' obligations.
8. Pursuant to the terms ofthe Note and Mortgage. as of November 30. 2005.
Detendants are obligated to Citizens for the following sums:

mailed to the Defendants on October 27. 20D5. as evidenced by thc Certificates of Mailing
attached hereto and incorporated herein as Exhibit "D."'
WHEREFORE, Plaintiff, Citizens Bank of Pennsylvania. demands Judgment in
Mortgage Foreclosure in its favor and against Defendants, .lohn and Cynthia IvanofI in the
amount of $45,602.25, plus continuing interest at the per diem rate of $8.6 I from November 3D,
2005, plus eontinuing late charges, attorneys fees and costs for foreclosure and sale of the
Property.
