THIS AGREEMENT made the 21ST day of August, 2001, by and
between FOGARTY HOMES, INC., of 4701 North Front Street,
Harrisburg, PA 17110, hereinafter referred to as Contractor, i%ND
TODD M. SPRINGMAN and TAMMY M. SPRINGMAN, husband and wife, of 36
Southmont Drive, Enola, PA 17025, hereinafter referred to as
Owner, whereby the former undertook and agreed to erect and
construct a residential dwelling on that certain lot of ground
situate on Pagoda Court, in East Pennsboro Township, Cumberland
County, Pennsylvania, being Lot No. 23 on the Final Subdivision
Plan of Penn Valley, Phase 4, said plan being recorded in Plan
Book 82, Page 67. Being part of the same premises which Penn
Valley Corporation, a Pennsylvania corporation, by Deed dated
June 23, 1998 and recorded June 30, 1998 by the Cumberland County
Recorder of Deeds Office in Deed Book 180, Page 263, granted and
conveyed unto Logan's Run Associates, a Pennsylvania General
Partnership comprised of Logan's Run Corporation, a Pennsylvania
Business Corporation, and Haubert Homes, Inc., a Pennsylvania
Corporation. The said Logan's Run Corporation, a Pennsylvania
Business Corporation, has assigned interest in the partnership of
Logan's Run Associates, a Pennsylvania General Partnership, to
Fogarty Homes, Inc., a Pennsylvania Corporation, by Bill of Sale
dated August 23, 2000. Also being the same premises which
Logan's Run Associates by Deed dated J ~i~ 5% , 2001 and
recorded , 2001 in the Cumberland County Recorder
of Deeds Office in Deed Book , Page , granted and
conveyed unto Todd M. Springman and Tammy M. Springman, husband
and wife.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of One ($1.00)
Dollar to it in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and
all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or maintained by
them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.

caused these presents to be signed by its proper corporate
officers and its corporate seal to be affixed hereto, the day and
year above written.
