WHEREAS, DANIEL E. BIER and STEPHANIE M. BIER, HUSBAND AND WIFE of 42 CARLTON AVENUE,
CARLISLE, PENNSYLVANIA 17013, is about to execute contemporaneously herewith a contract with
BASTIAN HOMES of , for the erection of a story building upon a lot of land
situate
SEE EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF FOR ALL PURPOSES
NOW, NOVEMBER 29, 2005, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said OWNER to the said CONTRACTOR to
commence work on the said building, or purchase materials for the same in consideration of the making of
the said contract with OWNER and the further consideration of one Dollar, to CONTRACTOR paid by
OWNER it is agree that no lien shall be filed against the building by the contractor. or any subcontractor,
nor by any of the material men or workmen or any other person for any labor, or materials purchased, or
extra labor or materials purchased for the erection of said building, the right to file such iiens being
expressly waived.

ALL THAT CERTAIN tract of land situate in the Township of West Pennsboro, County of Cumberland,
and Commonwealth of Pennsylvania, being more particularly bounded and described as follows, to wit
BEGINNING at a steel pin set on the southernmost right-of-way line of Watson Drive, at the common
point of adjoiner of Lots #11 and #12 on the hereinafter mentioned plan; thence extending along said right-of-way
line, South eighty-four (84) degrees thirty-four (34) minutes ten (10) seconds East, for a distance of one hundred
ninety-seven and six hundredths (194,06) feet to a steel pin at Lot #13; thence departing from Watson Drive and
extending along Lot #13, South five (5) degrees twenty-five (25) minutes fifty (50) seconds West for a distance of
three hundred forty and zero hundredths (340,00) feet to a steel pin at lands now or formerly of Dennis Willey;
thence extending along lands now or formerly of Willey, North eighty-four (84) degree thirty-four (34) minutes ten
(10) seconds West for a distance of one hundred ninety-seven and six hundredths (197,06) feet to a steel pin at
Lot #12; thence extending along Lot #11, North five (5) degrees twenty-five (25) minutes fifty (50) seconds East,
for a distance of three hundred forty and zero hundredths (340.00) feet to a steel pin set on the southernmost
dedicated right-of-way of Waston Drive, said pin marking the place of BEGINNING.
