Grimes, Jr., by their attorney, ~.:- Harold S. Irwin, III, Esquire, and present this petition for appointment of guardians over the estate of Darron L. Barrick, a minor, representing as follows: 1. Petitioners are John E. Grimes, maternal grandfather of the minor, and John E. Grimes, Jr., maternal uncle of the minor, adult individuals residing at 68 Big Springs Terrace, Newville, Cumberland County, Pennsylvania 17241 and 100 Yates Street, Mt. Holly Springs, Cumberland County, Pennsylvania 17065. 2. The minor is Darron L. Barrick, born March 30, 1996 (age 9 years), residing at 68 Big Springs Terrace, Newville, Cumberland County, Pennsylvania 17241. 3. The following persons are the minor's next-of-kin: Brian L. Barrick, father of the minor, and Jennifer R. Grimes, mother of the minor, both of which have signed consents to this guardianship which consents are incorporated herein and attached hereto as Exhibit "A". 4. Petitioners have no knowledge of any other Court within this Commonwealth which has appointed a guardian for the minor. 5. The minor is the beneficiary of 25% of the proceeds of two life insurance policies with American United Life Insurance Company, one for $50,000 and one for $35,000. See AUL statements incorporated herein and attached hereto as Exhibit "B". Said policies insured the life of the minor's maternal grandmother, Judy R. Grimes, who died on October 21, 2005. 7. By letter of November 21,2005, AUL notified petitioners that in order for the proceeds of the policies to be paid to or for the benefit of the minor, a guardianship must be established. See letter from AUL incorporated herein and attached hereto as Exhibit "C". 8. Petitioners have no interest adverse to the minor and have agreed to act as guardians if this Honorable Court shall so appoint. The minor resided with petitioner John E. Grimes and the decedent since his birth and continues to reside at that address. The consent of the proposed guardians is incorporated herein by reference and attached hereto as Exhibit "D". 9. If appointed as guardians, petitioners will act in compliance with all appropriate laws and regulations as required by law. After appointment of the petitioners as guardians, petitioners will establish a bank account for these funds and obtain a bond in the amount of $25,000.00. WHEREFORE, petitioners respectfully request this Honorable Court set a hearing at which the averments of this petition may be documented and the appointment of petitioners as guardians for the estate of the child may be considered, with notice thereof to the next-of-kin. Petitioners further request that a guardian ad litem be appointed to act for the minor regarding any necessary hearings. HAROLD s.
