Hereinafter referred to as Contractor,
AND
BRIAN K. TITUS AND LINDA L. TITUS, 502 Francis Drive Mechanicsburg,
Pennsylvania 17013, hereinafter referred to as Owner, whereby the former undertook and
agreed to erect and construct a
SINGLE F AMIL Y DWELLING on that certain lot of ground situate in
Lot 248 Francis Drive Mechanicsburg Cumberland County, Pennsylvania. (SEE
ATTACHED LEGAL DESCRIPTION)
NOW THEREFORE, THIS AGREEMENT WITNESSTH: That the said Contractor,
for and in consideration ofthe sum of ($1.00) Dollar to FRED A. TIDA Y BUILDERS,
INe. in hand paid by Owner, the receipt whereof is hereby acknowledged, and further
consideration mentioned in the agreement aforesaid, for themselves and their
subcontractors, and all parties acting through or under them, covenant and agree that no
mechanics liens or claims shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on account of any work
done or materials furnished by them or any of them under said contract or otherwise, for,
towards, in, or about the erection and construction of the said buildings on the lot above
the said Contractor, for themselves, their subcontractors and others under them hereby
expressly waive and relinquish the right to have, file, and maintain any mechanic's liens
or claims against the said buildings or any of them, and agree that this instrument,
waiving the right oflien, shall be an independent covenant.

ALL THAT CERTAIN, piece, parcel or lot od land, together with improvements, situated in Hampden Township,
Cumberland County, Pennsylvania, and bounded and described as follows:
BEGINNING at a point on the Southern right-of-way line of Francis Drive (50.00 feet wide); said point being in
line of other lands now or formerly of The McNaughton Company; then along said right-of-way line of Francis
Drive, on the arc of a circle curving to the right, having a raidus of 525.00 feet, and an arc length of 34.80 feet, to
a point along same; then North 75 degrees 40 minutes 13 seconds East, for a distance of 50.23 feet, to a point
on the arc of a circle curving to the right, having a radius of 25.00 feet, and an arc iength of 39.27 feet, to a point
on the Western right-of-way line of South Deerfield Avenue (50.00 feet wide); thenc along said Western
right-of-way, South 14 degrees 19 minutes 47 seconds East, for a distance of 85.00 feet,to a point in line of
other iands now or formerly of The McNaughton Company; then along said other lands of McNaughton, South
75 degrees 40 minutes 13 seconds West, for a distance of 110.00 feet, to a point in line of other lands now or
formerly of The McNaughton Company; then along said other lands of McNaughton, North 14 degrees 19
minutes 47 seconds West, for a distance of 108.85 feet, to a point and the place of BEGINNING.
This piece, parcel or lot of land contains approximately 11,953 square feet of land, and is known and numbered
as Lot No. 248 on the Final Subdivision Plan for Good Hope Farms South- Phases X and XI, which is recorded
in Cumberland County in Plan Book 89, Page 90.
BEING A PART of the same premises which Thomas W. Gaughen, d/b/a TWG Real Estate Management
Services, conveyed to The McNaughton Company, a Pennsylvania Corporation, by deed dated October 5, 1994
and recorded in Cumberland County in Record Book 112, Page 1058.
UNDER AND SUBJECT TO:
(a) Any and all easements, Iicenses,leases, exceptions, reservations, covenants, agreements, conveyances and
restrictions which affect the premises and are visible by inspection of the premises.
(b) Any and all easements, licenses, leases, exceptions, reservations, covenants, agreements, conveyances
and restrictions contained in any and all prior documents, agreements, instruments, deeds, grants and
conveynaces affecting premises.
(c) Declaration of Covenants and Restrictions, recorded in Cumberland County in Miscellaneous Book 711,
Page 1307 as may be applicable to the above described property.
