ORPHANS' COURT DIVISION NO. , 1978 PETITION UNDER SECTION 3102 OF THE PROBATE, ESTATES AND FIDUCIARIES CODE FOR THE SETTLE- MENT OF A SMALL ESTATE TO THE HONORABLE JUDGES OF SAID COURT: 1. Dorothy Elizabeth Wanner, your Petitioner, files this her petition for settlement of a small estate under the provision of Section 2103 of the probate, Estates and Fiduciaries and in support thereof avers that: 1. Your petitioner is Dorothy Elizabeth Wanner, a competent adult residing at 121 Parker Street, Carlisle, Cumberland County, Pennsylvania, and is the surviving daughter of the above decedent. 2. Jack W. Biggs is a competent adult residing at 6109 Riley Road, clay, New York, and is the surviving son of the above decedent, who joins in this petition. 3. Lilian M. Biggs died on AprilS, 1978 at the age of eighty-two years, while a resident of Manor Home, Newville, Cumberland County, Pennsylvania, but prior thereto was domiciled with Petitioner at 121 Parker Street, Carlisle, Pennsylvania. 4. The decedent died with a Will, a copy of which is attached hereto. Said Will has not been probated. 5. A copy of the Appraisal, which has been filed with the Register of Wills, is attached hereto and shows a gross estate of $3,375.75. 8't,} 6. A copy of the Debts and Deductions, which has been filed with the Register of Wills, is attached hereto and shows debts in the amount of $2,370.90. 7. The net taxable estate is $1,004.85. Tax in the amount of $60.29 has been paid on same. A copy of the receipt is attached hereto. 8. The balance remaining in said estate is $944.56, and the sole heirs entitled to distribution of the same are Dorothy Elizabeth Wanner and Jack W. Biggs. 9. Your Petitioner avers that all creditors of the decedent have been paid, and there are no claims unpaid known to your Petitioner. WHEREFORE, your Petitioner prays that an order be made authorizing distribution of the sum of $944.56 to Dorothy Elizabeth Wanner and Jack W. I give and bequeath my ring and other jewelry to my daughter, OOROTHY ELIZABETH WANNER. 2. All of the rest, residue and remainder of my estate, real and personal, I give, devise and bequeath in equal shares to my daughter DOROTHY ELIZABETH WANNER and my son JACK W. BIGGS. 3. In the event that my daughter DOROTHY ELIZABETH WANNER, predecease me, I give the share she would have received to her children in equal shares. 4. In the event that my son JACK W. BIGGS predecease me, I give the share he would have received to his issue, if any. If he is not survived by issue, then I give his share to my grandchildren in equal shares. 5. I nominate, constitute and appoint my daughter DOROTHY ELIZABETH WANNER and my son JACK W.
