COMPLAINT
The Plaintiff. MARMOT MOUNTAIN LLC, by its attorneys, KNUPP, KODAK & IMBlUM, P.C., brings this
action of Assurnpsit against the Defendant to recover the surn of SEVENTY ONE THOUSAND NINE HUNDRED
ONE DOLLARS AND THIRTY FIVE CENTS ($71.901.35), along with interest thereon at the statutory rate from
August 10, 2004, upon a cause of action of which the following is a statement:
1. The Plaintiff. MARMOT MOUNTAIN LLC, is a corporation organized and existing under the laws
of the State of Delaware, having its principal office and place of business at 2321 Circadian Way, Santa Rosa,
California 95407,
2. The Defendant, AMERICAN OUTFITTERS, INC., is a corporation organized and existing under the
laws of the Commonwealth of Pennsylvania, having its principal office and place of business at 5202 Business
Route 220 North, Bedford, Bedford County, Pennsylvania 15522,
3. At all tirnes pertinent hereto, Defendant maintained an office and place of business at the Capital
City Mall, Camp Hill, Cumberland County, Pennsylvania.
4, On March 26, 2004, Defendant submitted a Credit Application to Plaintiff, which credit was granted.
A true and correct copy of said Credit Application is attached hereto, marked Exhibit "A" and made a part hereof,
5. On the dates, in the arnounts. and for the prices set forth in a true and correct copy of the Plaintiff's
invoices hereto attached, marked Exhibit "B" and made a part hereof, Plaintiff, at the special instance and oral

request of the Defendant, sold and delivered goods, wares and merchandise of the kind and description set forth
on said Exhibit to the total amount of Seventy One Thousand Nine Hundred One Dollars and Thirty-Five Cents
($71,901.35),
6. The prices charged for said goods, wares and rnerchandise were just and reasonable, were the
legal and market prices therefor and were the prices which the Defendant orally promised and agreed to pay to
Plaintiff,
7, The balance due and owing by Defendant to Plaintiff is the sum of SEVENTY ONE THOUSAND
NINE HUNDRED ONE DOLLARS AND THIRTY FIVE CENTS ($71,901.35), as appears by Plaintiff's Statement
of Account attached hereto as Exhibit "C".
8. Plaintifffrequenlly demanded paymentfrom Defendant of said arnount due and owing as aforesaid,
but Defendant refused and neglected and still refuses and neglects to pay said arnount of any part thereof.
WHEREFORE, Plaintiff brings this suit to recover frorn Defendant the sum of SEVENTY ONE
THOUSAND NINE HUNDRED ONE DOLLARS AND THIRTY FIVE CENTS ($71,901.35), along with interest
thereon at the statutory rate from August 10, 2004,
