AAA MID ATLANTIC INSURANCE COMPANY, hereinafter referred to as plaintiff, is an automobile insurance company doing business at the above captioned address. 2. Plaintiff believes and therefore avers that ARTHUR R. DUNKELBERGER, III, is an adult individual residing at the above captioned address. 3. At all times herein, plaintiff is the assignee and subrogee of their insured, PATRICIA CANTERINO, and had an appropriate policy of insurance on the vehicle set forth herein. 4. On or about December 26, 2003, plaintiffs insured was operating a motor vehicle at or about 1704 Bridge Street, New Cumberland, PA. 5. At the aforesaid time and place, a vehicle driven by the defendant collided with plaintiffs insured's vehicle, causing property damage in the amount of $4,625.96. 6. It was the duty of the defendant to operate the aforesaid vehicle so as not to carelessly, recklessly or negligently cause injury or damage to others lawfully upon the highway, but defendant was then and there guilty of the following careless, reckless and negligent acts: (a) Failing to keep proper lookout for others using the highway. (b) Failing to keep the motor vehicle under property control at all times; (c) Failing to heed the traffic control signs/signals governing the roadway; (d) Operating the motor vehicle in violation of the various statutes of the Commonwealth of Pennsylvania pertaining to the operation of motor vehicles upon the highways and roadways; (e) Operating the motor vehicle at a speed in excess of that which was safe under the circumstances then and there existing; (f) Failing to take proper measures to avoid the collision; (g) Entering plaintiff's insured's lane of traffic.
