1. ) Your petitioners are executors of the estate ofN. Ruth Sponsler, who'-"
died January 28, 2005.
2.) The executors completed the administration of the estate and have
prepared the First and Final Account of their administration; they are prepared to
make fmal distribution according to the will.
3.) Jessica S. Aitkins, a legatee entitled to a one twelfth share of the
residue, is a minor, born September 21,1989; her distributive share is $21,950.67.
4.) On July 13, 1993, Executor Eleanor S. Peffer, the maternal guardian of
Jessica S. Aitkins, was appointed her guardian by Order of Court, attached as
Exhibit A.
5.) Decedent's will provides in Paragraph 3(g):
I give and bequeath one half (l/2) of one such
equal share to my good friend Jessica S. Aitkins,
with the stipulation that the same be place' (sic)
~ in a local banking or other financial institution
where the same shall remain until such time as
the said Jessica S. Aitkins shall attain the age of
twenty-one (21) years, at which time the same
shall be paid over to her, free and clear of any
further restrictions.
6.) The distributive share of the minor is not large enough to form the
corpus of a trust which a bank will administer until she is age twenty-one (21).
Wherefore, your petitioner prays your Honorable Court to make an Order
directing the distributive share of Jessica S. Aitkins be deposited in an interest
bearing account not to be withdrawn until September 21, 2007, without further
Order of Court.

Aitkins, to stipulate as follows:
Eleanor Peffer and Jody
(1) Petitioner is Eleanor Peffer, an adult individual who
currently resides at 109 E. Keller Street, Mechancisburg,
Cumberland County, Pennsylvania.
(2) Respondent is Jody Aitkins, an adult individual who
currently resides at 109 E. K~ller Street, Mechancsburg,
Cumberland County, Pennsylvania.
(3) The Respondent is the natural mother of Jessica Susan
Aitkins, D.C.B. September 21, 1989.
(4) , The Petitioner is the maternal grandmother of the
child.
(5) The natural ~ather of the child, Cleon Aitkins, whose
last known address was 48 West Main Street, Mechanicsburg,
Cumberland County, Pennsylvania, has not seen the child since
December of 1991. At the present time, he is unable to be
located.
(6) The Petitioner has had custodial duties with the
child since the child's birth.
(7) The parties agree that the Petitioner, the maternal
grandmother, shall have full and permanent custody of the

child.

(8) The parties further agree that periods of partial
custody and visitation by the Respondent shall be at times as
mutually agreed upon by the parties.
(9) The parties further agree that the Petitioner will be
responsible for all health, support, welfare, and maintenance
at all times provided this Stipulation is still in affect.
(6) The parties desire that this Agreement be evidenced
by an Order of Court.
WHEREFORE, the parties hereto request Your Honorable COurt
to enter an Order awarding custody of Jessica Susan Aitkins to
Eleanor Peffer.
