CERTIFICATE OF SERVICE
George W. McKee hereby certifies that he is a member of the Bar of the Supreme
Court of Pennsylvania and of the Court of Common Pleas of Dauphin County, Pennsylvania,
and that he is the Attorney for the petitioner in the above matter, and that on December 8,
1978, he gave notice by certified mail to the Director of the Veterans Administration
Hospital, Coatesville, Pennsylvania, to the Chief Attorney of the Veterans Administration,
Veterans Administration Regional Office, Wilkes-Barre, Pennsylvania, and to the
General Counsel, Social Security Administration, Baltimore Ntaryland, that a Citation
had been awarded on John W. Ellenberger, an alleged incompetent, to show cause
why he should not be adjudged an incompetent and a guardian of his Estate appointed,
and that said Citation was returnable on January 11, 1979, at which time a hearing
would be held; there are hereto attached a copy of said notices and the receipts for the
certified mail sending the same and for the delivery of the same to the Director of the
Veterans Administration Hospital and the Chief Attorney, Veterans Administration.

NOTICE is hereby given that a Citation has been issued by the
Orphans. Court Division of the Court of Common Pleas of Cumberland County,
Pennsylvania, to No. 619 Orphans' 1978, requiring John W. Ellenberger to
appear before said Division of said Court to show cause why he should not be
adjudged an incompetent and a guardian of his Estate be appointed. Said
Citation is returnable on January 11, 1979, at 1 :30 P. M. in Court Room No.2,
Cumberland County Court House, Carlisle, Pennsylvania, at which time a hearing
will be held. Copies of said Citation, the Petition for the same, and the
Prel iminary Decree awarding the same are herein enclosed. John W. Ellenberger
has been a patient at the Veterans Administration Hospital, Coatesville,
Pennsylvania, since w.arch 24, 1947. He has received Social Security payments
but is not receiving the same at this ti me.

AND NOW, January \, , 1979, upon consideration of the Petition of
Robert M. Ellenberger for the appointment of a guardian for John W . Ellenberger, who is
domiciled in Cumberland County, Pennsylvania, an alleged incompetent, and a Citation
thereon having been issued on said John W. Ellenberger, returnable on January 11, 1979,
at which time a hearing was held in open Court on said Petition, showing that due and
proper notice of said Citation and hearing was given, and it appearing that because of
the condition of said John W. Ellenberger, his welfare would not be promoted by his
presence in Court, and that he is not able because of mental illness, mental deficiency
or retardation, and because he lacks sufficient capacity to make or communicate reasonable
decisions concerning his person, to manage his property and is liable to dissipote it and
become the victim of designing persons, IT IS HEREBY ORDERED AND DECREED that
the prayer of said Petition is hereby granted and John W. Ellenberger is adjudged an
is appointed guardian of his Estate.
