CIVIL ACTION - COMPLAINT IN MORTGAGE FORECLOSURE American Home Mortgage Servicing, Inc., successor in interest to Columbia National Incorporated, by its attorneys, Grenen & Birsic, P .C., files this Complaint in Mortgage Foreclosure as follows: 1. The Plaintiff is American Home Mortgage Servicing, Inc., successor in interest to Columbia Nationallncorporated, which has its principal place of business at 4600 Regent Blvd., Suite 200, Irving, Texas 75063 and is authorized to do business in the Commonwealth of Pennsylvania. 2. The Defendants, Billy T. Lindsey, Jr. and Barbara R. Lindsey, are individuals residing within the Commonwealth of Pennsylvania, whose last known addresses are 7759 Hanover Dale Drive, Harrisburg, Pennsylvania 17112 and 3 Lenox Court, Silver Spring, Pennsylvania 17050, respectively. 3. On or about February 16, 2001, Defendants executed a Note in favor of Plaintiff in the original principal amount of $120,400.00. 4. On or about February 16, 2001, as security for payment of the aforesaid Note, Defendants made, executed and delivered to Plaintiff a Mortgage in the original principal amount of$120,400 .00 on the premises hereinafter described, said Mortgage being recorded in the Office of the Recorder of Deeds of Cumberland County on February 23,2001 in Mortgage Book Volume 1673, Page 154. A true and correct copy of said Mortgage containing a description of the premises subject to said Mortgage is marked Exhibit "A", attached hereto and made a part hereof. 5. Defendants are the record and real owners of the aforesaid mortgaged premises. 6. Defendants are in default under the terms of the aforesaid Mortgage and Note for, inter alia, failure to pay the monthly installments of principal and interest when due. Defendants are due for the January 1, 2005 payment. 7. On or about October 21, 2005, Defendants were mailed Notices of Homeowner's Emergency Mortgage Assistance Act of 1983 ("Act 91 Notices"), in compliance with the Homeowner's Emergency Mortgage Assistance Act, Act 91 of 1983, as amended. 8. Plaintiff was not required to send Defendants separate Notices of Intention to Foreclose Mortgage in compliance with Act 6 ofl974, 41 P.S. SIOI, et seq., as a result of sending the Act 91 Notices. 9. The amount due and owing Plaintiff by Defendants is as follows: Principal Interest to 11/28/05 Late Charges to 11/28/05 Escrow Deficiency to 11/28/05 Suspense Balance Attorneys' Fees Title Search, Foreclosure and Execution Costs TOTAL $115,337.96 $ 7,985.20 $ 382.09 $ 1,007.56 $ (188.50) $ 850.00 $ 2.500.00 $127,874.31 WHEREFORE, Plaintiff demands judgment in mortgage foreclosure for the amount due of$127,874.31 with interest thereon at the rate of$22.12 per diem from November 28,2005, and additional late charges, additional reasonable and actually incurred attorney's fees, plus costs (including increases in escrow deficiency) and for foreclosure and sale of the mortgaged premises.
