COMPLAINT IN CIVIL ACTION - QUIET TITLE
I. Plaintiffs, Robert E. Smith and Latricia A. Smith, husband and wife, are adult
individuals who reside at 40 Pine Grove Road, Gardners, Dickinson Township,
Cumberland County, Pennsylvania 17324.
2. Defendants, Lloyd G. McCorkel and Douglas L. McCorkel, father and son, are
adult individuals who reside, respectively, at 327 North East Street, Carlisle,
Pennsylvania 17013 and 48 Pine Grove Road, Gardners, Pennsylvania 17324.
3. Plaintiffs acquired title to real property, known as and numbered 40 Pine Grove
Road, Gardners, Pennsylvania 17324, ("PREMISES"), in which Plaintiffs
presently reside through a deed dated April 21, 1962 and recorded in the Office of
the Recorder of Deeds of Cumberland County in Deed Book M, Volume 20, Page
643, a copy of which is attached as Exhibit "A."
4. Defendants acquired title to real property, known as and numbered 48 Pine Grove
Road, Gardners, Pennsylvania 17324, ("ADJOINER"), in which defendant
Douglas L. McCorkel presently resides through a deed dated January 6, 2003 and
recorded in the Office of The Recorder of Deeds of Cumberland County in Deed
Book 255, Page 1135, a copy of which is attached as Exhibit "8."

5. Since Defendant Douglas 1. McCorkel has occupied ADJOINER next to
Plaintiffs' PREMISES, Plaintiffs have sought to reconcile the common boundary
line between their corresponding real properties by mutual agreement, but have
exhausted reasonable means to settle same formally..
6. Plaintiffs' deed, Exhibit "A," to PREMISES recites the conveyance thereby as
being the same as that granted and conveyed to their Grantors (parents) by Clyde
C. Starner and Eva M. Starner through deed dated September 6, 1957 and
recorded in Deed Book D, Volume 20, Page 600, a copy of which is attached as
Exhibit "C." Exhibit "C" recites a separate deed for an additional "triangular
portion" ofland ("PARCEL"), previously conveyed between the same parties
which was intended to be a companion conveyance through Exhibit "C" for the
"entire tract of I acre and 145 perches" (I acre 145/160 perches=1.906 acres).
Said separate deed is neither held by Plaintiffs nor found to be of record; its
existence and whereabouts are unknown, and no adverse for said "triangular
portion" was made otherwise.
7. Defendants' ADJOINER, Exhibit "B," derives of an entirely different chain of
title and does not include in any respect any connection with PARCEL except as
an adjoiner since PARCEL is a triangular portion of land lying between the
respective legal descriptions of record for Plaintiffs (Exhibit "A") and Defendants
(Exhibit "B").
8. Plaintiffs engaged the professional services of John R. Williams, P.L.S. No.
22360-E, to survey the land involved in order to confirm the relationships of
Plaintiffs' PREMISES, including PARCEL, vis-a-vis Defendants' ADJOINER,
by courses and distances. A true and correct copy of this Property Survey by John
R. Williams for Robert E. and Latricia A. Smith, dated April 13, 2004, drawing
No. C-050490, is attached as Exhibit "D" ("SURVEY").
9. A reformation of Exhibit "A," deed for PREMISES of Plaintiffs, was prepared in
accordance with SURVEY and is attached as Exhibit "E." This proposed
corrective deed consolidates current legal descriptions of the real properties to
which Plaintiffs claim rightful ownership, including PARCEL as a second tract
and lot addition to PREMISES. This documentation conforms with the intent of
the original conveyance to Plaintiffs, and when executed would confirm the
favorable determination of Plaintiffs' within claim for Quiet Title on the
"triangular portion" in the Office of the Recorder of Deeds.
10. Plaintiffs have in the past and continue to pay Cumberland County real estate
taxes on Parcel Identifier No. 08-39-2216-002 for land size "1.80 acres or
approximately 2 acres," which area reasonably coincides with the 1.911 acres
total as determined by recent SURVEY including PARCEL, as well as the 1.906
acres/l acre 145 perches "entire tract" originally intended for conveyance to
Plaintiffs by Exhibit "A" and its recital of Exhibit "C." See Exhibit "F,"
effective county-wide assessment notice, attached.
11. Defendants are the only persons known to Plaintiffs who have any adverse
interest in this action.
WHEREFORE, Plaintiffs respectfully request this Court to enter an ORDER (a)
prohibiting Defendants, Lloyd G. McCorkel and Douglas 1. McCorkel, from asserting
any right, lien, title, or interest in these premises claimed by Plaintiffs; (b) decreeing that
the Plaintiffs, Robert E. Smith and Latricia A. Smith, are the legal owners of these entire
premises as described in accordance with the provisions above stated, and to be recorded
upon the execution of a corrective or confirmatory deed proposed herein as Exhibit "E,"
a true and correct unsigned copy; and (c) directing that these proceedings or an
authenticated copy thereof, shall at all times hereafter be taken as evidence of the facts
decreed and established.

BEGINNING at a steel pin set in common with the within de:scribed tract of land now or
formerly of Robert E. and Latricia A. Smith, another parcel (Lot No.2) as shown on the
aforementioned Property Survey recorded as aforesaid, State forest lands of the
Commonwealth of Pennsylvania, and lands now or formerly of Lioyd G. and Douglas L.
McCorkel; thence along the dividing line between Lot No.1 and Lot No.2 as shown on
the said Property Survey, North 30 degrees 59 minutes 11 seconds East 242.53 feet to a
point in Pine Grove Road (S.R. 3008); thence along said Pine Grove Road, the following
three courses and distances; (1) South 63 degrees 45 minutes 00 seconds East 74.25 feet,
(2) South 67 degrees 45 minutes 00 seconds East 99.00 feet, and (3) South 73 degrees 00
minutes 00 seconds East 99.00 feet to a point at line oflands now or formerly of Karl E.
Sowers; thence by said lands now or formerly of Karl E. Sowers and through a pipe

BEING the same lot ofland which Lloyd D. Smith and Evelyn R. Smith, by their deed
dated April 21, 1962 and recorded in Cumberland County Deed Book "M" Volume 20
Page 643 granted and conveyed to Robert E. Smith and Latricia A. Smith, husband and
wife, Grantors herein.
AND BEING all of Lot No.1 of the Property Survey for Robert E. and Latricia A. Smith
by John R. Williams, P.L. S., dated April 13, 2004, and recorded as aforesaid.
ALSO BEING improved with a single family dwelling with garage and outbuildings,
known and numbered 40 Pine Grove Road, Gardners, Pennsylvania 17324.
LOT NO.2
BEGINNING at a steel pin set in common with the within described parcel ofland;
another parcel, Lot No.1 as shown on the aforementioned Property Survey recorded as
aforesaid, State Forest lands ofthe Commonwealth of Pennsylvania, and lands now or
formerly of Lloyd G. and Douglas 1. McCorkel; then by said lands now or formerly of
McCorkels and through a steel pin set 25.00 feet distant from the end of this course North
7 degrees 54 minutes 11 seconds East 260.70 feet to a point in Pine Grove Road (S.R.
3008); thence along said Pine Grove Road South 59 degrees 30 minutes 00 seconds East
77 .55 feet to a point; thence continuing along said Road, South 63 degrees 45 minutes 00
seconds East 24.75 feet to a point at the dividing line between Lot No.1 and Lot No.2 as
shown on said Property Survey; thence along said dividing line between Lot No. 1 and
Lot No.2 South 30 degrees 59 minutes 11 seconds West 242.53 feet to the steel pin set in
common with Lot No.1 and Lot No.2 of the said Property Survey, lands now or

BEING a lot addition only to Lot No. I above, which parcel ofland by recital within the
chain of title of a certain separate deed therefore was intended but failed to accompany
the conveyance of said Lot No.1 (deed from Lloyd D. Smith and Evelyn R. Smith dated
April 21, 1962 and recorded in Cumberland County Deed Book "M" Volume 20 Page
643), to Robert E. Smith and Latricia A. Smith, husband and wife, Grantees herein.
AND BEING all of Lot No.2 of the Property Survey for Robert E. and Latricia A. Smith
by John R. Williams, P.L.S. dated April 13, 2004, and recorded as aforesaid.
ALSO BEING the same parcel of land that the Court of Common Pleas of Cumberland
County, Pennsylvania, in Civil Action to Quiet Title, No. by Order dated 200 ,
decreed the legal owners to be Robert E. Smith and Latricia A. Smith, husband and wife,
Grantees herein.
Executors ofthe Estate of Evelyn R. Smith, Deceased, join in the signing of this deed for
purposes of conveying all right, title and interest which the decedent may have retained in
Lot No.2 by virtue of the absence of documentation orrecord of any transfer of said Lot
No.2.
AND the said Grantors hereby covenant and agree that they will warrant specially the
property hereby conveyed.
This deed is a corrective or confirmatory deed in accordance with Order of the Court of
Common Pleas of Cumberland County, Pennsylvania, dated 200 , and is
thus exempt from Pennsylvania and similar realty transfer taxes.
